BY-LAW NO. 1993-35
A BY-LAW TO AMEND BY-LAW NO. 1988-1 IN ORDER TO REZONE LOTS 9,
10 AND PART OF LOT 11 EAST OF PRINCES STREET, REGISTERED PLAN
61, FROM R3-1 TO R3-7
WHEREAS Section 34 of the Planninq Act, R.S.O. 1990,
Chapter P.13 authorizes the councils of municipalities to enact
and amend zoning by-laws which comply with an approved official
plan;
AND WHEREAS the Council of The
Kincardine has enacted By-law No.
enacted under Section 34 of the said
Corporation of the
1988-1, a zoning

AND WHEREAS the Council of The Corporation of the Town of
Kincardine desires to amend By-law No. 1988-1;
AND WHEREAS this By-law complies with the
Kincardine's Official Plan which was approved by the
of Municipal Affairs on January 31, 1989;
NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:

1. By-law Number 1988-1, as amended being the Comprehensive
Zoning By-Law for The Corporation of the Town of
Kincardine is hereby further amended by adding the
following Subsection 5.3.11.7 to Subsection 5.3.11
thereof:
5.3.11.7
Notwithstanding their 'R3-1' Zoning
designation, where lands are delineated as
'R3-7' on Schedule "A" to this By-Law, they
may be used for the purposes of a funeral
home with an addition including a chapel,
in addition to those uses normally
permitted in the 'R3-1' Zone in accordance
with the 'R3' Zone provisions contained in
this By-Law, provided however that:
i) the subject lands have a minimum lot
area of 27,221 square feet;

ii) a minimum lot frontage of 135 feet;
iii) a minimum front yard of 9 feet
6 inches;
iv) a minimum of 20 parking spaces be
provided on site;
v) a minimum northerly side yard of 10
feet;
vi) a minimum southerly side yard of 8
feet;

2. Schedule "A" to By-Law Number 1988-1, as amended, is
hereby further amended by changing thereon from 'R3-1' to
'R3-7' the zoning designation on Lots 9, 10 and Part of
Lot 11, East of Princes street, Regitered Plan 61, in the
Town of Kincardine, which is dhown outlined in the
heaviest black broken line on the attached Schedule "A".

This by-law
passage by
pursuant to
final
effect
shall take effect from the date of
Council and comes into full force and
the provisions of the PlanninG Act.
4. This by-law may be cited as the "Davey Linklater Rezoning
By-law" .
