THE CORPORATION OF THE TOWN OF KINCARDINE

BY-LAW
BY-LAW NO. 1993-4
A BY-LAW TO AUTHORIZE THE FINANCING OF A PORTION OF THE
COSTS ASSOCIATED THE UNDERTAKING OF A SLOPE STABILITY
PROJECT BY THE SAUGEEN VALLEY CONSERVATION AUTHORITY ON THE
PENETANGORE RIVER SLOPE WEST OF QUEEN STREET AND SOUTH OF
BARBOUR STREET AT AN ESTIMATED COST OF $3,850,000.
WHEREAS The Corporation of the Town of Kincardine has requested
the Saugeen Valley Conservation Authority to undertake a slope
stability study in the Town of Kincardine;
AND WHEREAS the Saugeen Valley Conservation Authority retained
Golder Associates (Eastern Canada) Ltd. who prepared a report
entitled "Slope Stability and Erosion Control Study" in July
1987, which stated that "This may result in sudden and dramatic
loss of ground with little or no prior warning." and "Existing
structures or facilities located immediately adjacent to
presently unstable slopes are considered to be at imminent
risk.";
AND WHEREAS the Saugeen Valley Conservation Authority further
retained D. H. Braun Consulting Engineers Ltd. to undertake
and prepare the Environmental Study Report and the Preliminary
Engineering Study for the Penetangore River Slope Stabilization
Project which were completed in 1990 and April, 1989
respectively;
AND WHEREAS Subsection 26(6) of the Conservation Authorities
Act, R.S.O. 1990, c.C.27 permits municipalities to charge the
municipality's costs against the rateable property in that part
of the municipality.
AND WHEREAS The Corporation of the Town of Kincardine wishes to
proceed with this project and to apportion the municipal costs
of the project between The Corporation of the Town of
Kincardine and the benefiting property owners;
NOW THEREFORE the Council for The Corporation of the Town of
Kincardine ENACTS as follows:
The penetangore River Slope Stabilization project
(hereinafter called the "Project") shall be constructed
under the provisions of the Conservation Authorities Act,
R.S.O. 1990, c.C.27.
2. That the Saugeen Valley Conservation Authority are hereby
requested to call tenders for the Project once
confirmation is received from the Ministry of Natural
Resources that a capital grant has been allocated at the
rate of 85%.

That the Saugeen Valley Conservation Authority, the mayor
and clerk are authorized to cause a contract for the
completion of the project to be made and entered into
with some person or persons, firm or corporation, subject
to the approval of this Council, to be declared by
by-law.

4. That The Corporation of the Town of Kincardine will cover
90% of the balance of the costs after deduction of the
grant from the Ministry of Natural Resources.
5. That the rateable property owners outlined on Schedule
"A" to this by-law shall pay 10% of the balance of the
costs after deduction of the grant from the Ministry of
Natural Resources.
6. That the special assessment for works completed shall be
paid by rateable property owners either by ten annual
installments with an applicable interest rate established
by the Council of The corporation of the Town of
Kincardine factored into each installment or by one lump
sum payment due on the final tax billing date of the year
in which the project commences.
7. Any debenture to be issued for a loan to be effected to
pay for the cost of the project when completed, shall
bear interest at such a rate as the Council The
Corporation of the Town of Kincardine shall determine and
be made payable within ten years.
8. That the lands fronting on the said project are hereby
declared to be an area and ten (10) percent of the
municipal share of the cost of the work, including
debenture charges and the cost of management of the work,
shall be assessed upon the lands fronting or abutting
directly on the work and any debenture By-Law shall
provide accordingly.
9. This By-Law shall come into full force and effect upon
the approval of the Minister of Natural Resources.
10. This by-law may be cited as the "penetangore River Slope
Stability Cost Apportionment By-Law".
