BY-LAW
BY-LAW NO. 1993-12
A BY-LAW TO REGULATE THE DESTRUCTION OF TREES LOCATED ON
MUNICIPAL PROPERTY
WHEREAS the Town of Kincardine has located on its property,
road allowances, parks and beaches, trees of various species
description and sizes;
AND WHEREAS the existence of these trees enhances the aesthetic
nature of the Town;
AND WHEREAS it is deemed necessary to regulate the destruction
of municipal trees;
NOW THEREFORE the Council for The corporation of the Town of
Kincardine ENACTS as follows:
1.0 DEFINITIONS
1.1 Fell - the act of cutting down a tree so as to leave
only a stump with no branches.
1.2 Prune - the act of removing particular branches so as to
allow for proper growth or as a safety measure to remove
branches that may interfere with other structure or
overhead wires.
1.3 Saplina - a young tree of deciduous or coniferous variety
whose trunk size does not exceed 7.5 centimetres.

Where permission of the Town has been received and a tree
felled, the person responsible for the action shall
ensure that the ground surrounding the area where once
the tree existed is now returned to a state similar to
the vegetation around it.
3.0
The Kincardine PUC, its agents and employees, are exempt
from the provisions of this by-law.
4.0
Every person who contravenes any provisions of
by-law is guilty of an offence and is subject to
penalties as prescribed in the Provincial offences
R.S.O. 1990, Chapter P.33.
