A BY-LAW TO AUTHORIZE THE SIGNING OF AN AMENDMENT TO A
SUBDIVISION AGREEMENT
WHEREAS the Council
Kincardine entered into

AND WHEREAS an amendment to this agreement is necessary in
order to establish provisions for the installation of a passive
gas venting sytem;
NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:
1. That The Corporation of the Town of Kincardine enter into
an amending subdivision agreement with Lurgan Holdings
Inc. to provide for the installation of a passive gas
venting system. Further that the mayor and clerk be
authorized to sign, on behalf of The Corporation of the
Town of Kincardine, the agreement with Lurgan Holdings
Inc. which is attached to this by-law and to affix the
Town's Corporate seal as and when required.
2. This by-law shall come into full force and effect upon
its final passage.
3. This by-law may be cited as the "Lurgan Holdings Venting
Amendment Agreement By-law".
READ a FIRST and SECOND time this 4th day of March, 1993.
READ a THIRD time and FINALLY PASSED this 18th day of March,
1993.

THIS AGREEMENT made in quadruplicate this 18th day of March,
1993.

hereinafter called the ·owner·,
of the First Part
- and -
THE CORPORATION OF THE TOWN OF KINCARDINE
hereinafter called the ·Town",
of the Second Part
- and -
THE KINCARDINE PUBLIC UTILITIES COMMISSION
hereinafter called the ·PUC·,
of the Third Part
WHEREAS the owner, the Town and the PUC have entered into a
subdivision agreement which is dated the twenty-first day of
February, 1991 and registered in the Land Registry Office, Land
Titles Division at Walkerton, county of Bruce (No.3) on the
twenty-second day of February, 1992 as Instrument Number 29286,
hereinafter called the ·Subdivision Agreement";

AND WHEREAS the

AND WHEREAS the Town deems it necessary to amend Schedule "C"
of the afforementioned agreement to include a passive gas
venting system;
NOW THEREFORE THIS AGREEMENT witnesseth that in consideration
of other good and valuable consideration and the sum of TWO
DOLLARS ($2.00) of lawful money of Canada, now paid by each of
the parties hereto, (the receipt whereof is hereby
acknowledged) the parties hereto covenant, promise and agree
with each other as follows:
1.0 THAT Section 3.0 of the Subdivision Agreement dated
February 21, 1991, is hereby amended to include:
3.18 The owner covenants and agrees that the passive gas
venting system required to be installed under
Schedule "c" to this Agreement shall be in
accordance with and approved pursuant to Section 9
of the Environmental protection Act.
3.19 The installation of a passive gas ventilation
system shall be such that it will be exhausting a
total ro~yimum gas flow rate of 0.216 cubic metres
per minute into the atmosphere, through nine vent
stacks spaced at intervals of approximately 23
metres, each stack having a diameter of 0.1 metre,
extending a height above grade acceptable to the
Ministry of the Environment.

3.20 The owner covenants and agrees that the Ministry of
the Environment Certificate of Approval for said
works bears Number 8-1199-92-006 and stipulates
that the system is in accordance with the
Environmental Protection Act.

3.21 The Town shall assume any costs for monitoring and
maintaining the site after installation of the
system is completed.
3.22 The Owner shall grant in favour of the Town a 20
metre easement from the limit of refuse in order to
restrict development within the easement and to
permit the Town to undertake any remedial action
deemed necessar)'.
3.23 The owner shall be responsible for the removal of
any existing refuse which must be moved in order to
make room for the installation of the passive gas
venting system. Any refuse to be moved will be
determined by the Town's engineer, and the OWner
shall move such refuse to an approved landfill
site at the owner's expense.
3.24 The owner shall classify all excavated refuse in
accordance with Ontario Regulation 347, R.R.O.
1990, and the disposal of such excavated refuse
shall be at the owner's expense.
3.25 The Owner shall ensure that all construction done
on the Town's property is returned to a state
acceptable to the Town's engineer.
2.0 THAT Schedule DC" of the Subdivision Agreement dated
February 21, 1991, is hereby amended to include:
7.0 Passive Gas Venting System for the area of the
closed Park street Landfill Site.
IN WITNESS WHEREOF the Corporate seals of the owner, the Town
and the PUC are hereunto affixed under the hands of their proper
signing officers in that behalf.
