THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
No. 2007 - 297
BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 2003-25,
BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE
MUNICIPALITY OF KINCARDINE
Part Lots 2 & 3, Concession 3 SDR (being Part 1, RP 3R-7416),
Municipality of Kincardine (geographic Township of Kincardine)
WHEREAS the Council of the Corporation of the Township of Kincardine enacted
By-law No. 82-08, a zoning by-law enacted under Section 34 of the said Planning
Act;
AND WHEREAS the Council for the Corporation of the Township of Kincardine
adopted By-law No. 2001-26, amending By-law No. 82-08, the Zoning By-law for
the Township of Kincardine;
AND WHEREAS the Corporation of the Township of Kincardine has restructured
to now be a part of the Corporation of the Municipality of Kincardine;
AND WHEREAS By-law No. 82-08, the Zoning By-law for the Township of
Kincardine, was repealed and replaced by By-law No. 2003-25, the
Comprehensive Zoning By-law for the Municipality of Kincardine;
AND WHEREAS By-law No. 2001-26 placed certain lands in a 'R1-h -
Residential Special Holding' category, and specified the use to which lands,
buildings or structures may be put until such time as the holding symboi is
removed pursuant to Section 36 of the Pianning Act, R.S.O. 1990, c. P. 13;
AND WHEREAS the provisions relating to the removal of the holding symbol
contained in By-law No. 2001-26 Paragraphs 2 (i) have been satisfied;
NOW THEREFORE the Council of the Corporation of the Municipality of
Kincardine, ENACTS as follows:
1. Schedule 'A' to By-law No. 2003-25 as amended, is hereby further
amended by changing thereon from 'R1-m-h' to 'R1-m' the zoning
designation of those lands described as Part Lots 2 & 3, Concession 3
SDR (being Part 1, RP 3R-7416), Municipality of Kincardine (geographic
Township of Kincardine) which are outlined on the attached Schedule 'A'.
2.
This By-law shall come into force and effect on the final passing thereof by
the Council of the Corporation of the Municipality of Kincardine, subject to
compliance with the provisions of the Planning Act, R.S.O. 1990.

3.
This By-law may be cited as the "Amendment to Comprehensive Zoning
By-law No. 2003-25 (Part Lots 2 & 3, Con 3 SDR, Municipality of
Kincardine [geographic Township of Kincardine]) By-law".
READ a FIRST and SECOND time this 10th day of October 2007.
