THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2007 - 293
BEING A BY-LAW TO AMEND BY-LAW NO. 2003 -136, THE
MUNICIPALITY OF KINCARDINE SIGN (2003) BY-LAW
WHEREAS Section 9 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended,
provides that a munIcipality has the capacity, rights, powers and privlleges of a
natural person for the purpose of exercising its authority under this or any other
Act;
AND WHEREAS Section 11 of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended, provIdes that a lower tier municipality may provide any service or thing
that the municipality considers necessary or desirable for the public and
authorizes a lower-tier municipality to pass by-laws respecting matters within the
sphere of jurisdiction of structures, including fences and signs, both subject to
certain rules;
AND WHEREAS SectIon 23.1 of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended, authorizes a municipality to delegate Its powers and duties under this
or any other act to a person or body subject to certain restrictions;
AND WHEREAS the Council for the Corporation of the Municipality of Kincardine
passed By-law 2003 -136 to regulate or prohibit signs and other advertising
devices within the Municipality;
AND WHEREAS Council deems it advisable to amend By-law No. 2003 - 136;
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That Section 1.0 Definitions be amended by adding the following:
1.8 (a) "Committee" means the Building and Planning Committee for
the Municipality of Kincardine.
2.
That Section 2.14 be deleted and the following Section added:
2.14 No person shall erect a permanent sign on public property without
the permission of the Building and Planning Committee. No
person shall erect a temporary sign on public or private property
without the permission of the CBO. Signs may only be attached
to utility poles by the use of staples or tape. Posters advertising
an event may be attached to public property up to three months
prior to the said event. Any such posters must be removed within
three days following the event.

3. That Section 2.25 be deleted and the following Section added:
2.25 No person shall erect non-Accessory signs without the approval
of the Committee, with the exception of private yard and garage
sales.
4. That Section 2.31 be deleted and the following Section added:
2.31 Exemptions to this by-law will be allowed only upon resolution of
the Committee.
5. That the following Section be added:
2.32 Within a reasonable time frame. the applicant may file an appeal
of the Committee decision to Council. The appeal must be
in writing with supporting documentation for the appeal,

That Section 3.1 (iii) be deleted and the following Section added:
3.1 (iii) Signs shall be permitted for condominium. apartment and
townhouse developments by resolution of the Committee.
7.
That SectIon 3.4 be deleted and the following Section added:
3.4 No person shall place any sign for a legal non-conforming
commercial use as set out in the zoning by-law except by
resolution of the Committee.
8. That this By-law shall come into fuil force and effect at the time of its
passing.
9. That this By-law may be cited as the "Sign By-law Amendment (2007)
By-law'.
