THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE NO. 2007-282 BEING A BY-LAW TO ACCEPT A TENDER FOR IMPROVEMENTS TO THE INTERSECTION OF TIE RD AND CONCESSION 2, INCLUDING VEHICLE TURNING, STORAGE LANES, AND INSTAllATION OF TRAFFIC SIGNALS WITHIN THE MUNICIPALITY OF KINCARDINE (Rankin Construction Inc.) WHEREAS Section 11 (3) of the Municipal Act, 2001, 5,0. 2001, c. 25, as amended, provides that lower-tier municipalities may pass by-laws within the sphere of jurisdiction of highways, including parking and traffic on highways; AND WHEREAS pursuant to the said Municipal Act, Sections 8 and g (1) provide that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipalIty to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues and has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this oranyotherAct; AND WHEREAS it has been determined that upgrades to the Tie Road and Concession 2 intersection, are required in order to provide safe passage for all motorists within the Municipality; AND WHEREAS the Council for The Corporation of the MunIcipality of Kincardine deems it expedient to accept a tender from Rankin Construction Inc. for improvements to the Tie Road and Concession 2 intersection, including vehicle turning, storage lanes and the installation of traffic signals within the Municipality of Kincardine, geographic Township of Bruce; AND WHEREAS this project is to be wholly funded by Bruce Power, including the provision of electricity to power the traffic signals and to provide temporary signage at the intersection in the instance of a power outage as set forth in the Memorandum of Understanding by means of By-law 2007-139; NOW THEREFORE the CouncU for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the lender of Rankin Construction Inc. in the amount of $180,091.88, including GST, be hereby accepted. 2. That the Mayor and CAO be hereby authorized to sign, on behalf of the Council for The Corporation of the Municipality of Kincardine any contracts and other documents required to authorize such work to commence. 3.
