HomeMy WebLinkAbout02 043 amen zon bloor e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE I!, BY-LAW NO. 2002 - 43 BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 1988-1, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE TOWN OF KINCARDINE (BLOOR 841 AND 835 QUEEN STREET, MUNICIPALITY OF KINCARDINE (FORMER TOWN OF KINCARDINE) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine has enacted By-law 1988-1, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend by-law 1988-1 ; NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to By-law No. 1988-1 as amended, is hereby further amended by changing thereon from 'General Commercial C1' to 'General Commercial C 1-4', the zoning designation of those lands described as Lots 2 & 3, Registered Plan 61, Part 1 3R-6566, Municipality of Kincardine (former Town of Kincardine) which are outlined on the attached Schedule 'AI. 2. By-Law No. 1988-1, as amended, being the Comprehensive Zoning By- Law for the Town of Kincardine, is hereby further amended by adding the following paragraph (6.1.4.4) to subsection 6.1.4 thereof: (6.1.4.4 ) Notwithstanding their 'General Commercial' zoning designation, the lands delineated as 'General Commercial C1-4' on Schedule 'A' to this By-Law may be used for single detached dwelling purposes in accordance with the 'General Commercial' zone provisions contained in this by-law, excepting however that: (i) such dwelling use will be permitted only as long as that use is continuous and it is to be used in accordance with the Existing Detached Dwelling Provisions of the by-law. If the use is changed, then the single detached dwelling use will cease to be a permitted use. the minimum rear yard for the existing detached accessory structure on Lot 2, Part 1 3R-6566 shall be ° metres (0 feet). all future development must comply with the requirements of the by-law (ii) (iii) .../2 e e e e By-Law No. 2002 - 43 Amendment to By-law 1988-01 (841 & 835 Queen Street Ward 1) Page 2 of 2 3. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 4. This By-law may be cited as the "Amendment to Comprehensive Zoning By-law 88-01, (841 & 835 Queen Street Ward 1), By-Law.
