HomeMy WebLinkAbout02 127 amen zon.underwood.con21 e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE .BI No. 2002 -127 BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 2001-112, BEING AN AMENDMENT TO THE COMPREHENSIVE ZONING BY-LAW FOR THE TOWNSHIP OF BRUCE 76-13 (UNDERWOOD FARMS LOT 21, CONCESSION 11), MUNICIPALITY OF KINCARDINE (FORMER TOWNSHIP OF BRUCE) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Township of Bruce has enacted By-law 76-13, a zoning by-law enacted under Section 34 ofthe said Planning Act; AND WHEREAS the Corporation of the Township of Bruce has restructured to now be a part of the Corporation of the Municipality of Kincardine; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend by-law 76-13; NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS as follows: 1. By-Law No. 2001-112, being a By-law Amendment to the Comprehensive Zoning By-Law for the Township of Bruce 76-13, is hereby further amended by amending paragraphs (ak) and (al) of subsection 5.11 thereof: (ak) Notwithstanding their 'Rural-A' zoning designation, the lands delineated as 'A-55a' on Schedule 'A' to this By-Law may be used for rural residential purposes in accordance with the 'Rural-A' zone provisions contained in this by-law, excepting however that: (i) the 'minimum lot area' shall be 2.13 hectares (5.2 ac) (ii) all future development must comply with the requirements of the by-law (iii) no intensive livestock operations (over 1.5 livestock units per acre) shall be permitted. (al) Notwithstanding their 'Rural-A' zoning designation, the lands delineated as 'A-55b' on Schedule 'A' to this By-Law shall be used in accordance with the 'Rural-A' zone provisions contained in this By-Law excepting however that: (i) no residential buildings or residential structures shall be permitted. .../2 ~ e e e e By-law No. 2002-127 Amendment to Comprehensive Zoning By-law 76-13 and 2001-112 lIot 21, Con. 11, Ward 3) Page 2 of 2 3. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 4. This By-law may be cited as the "Amendment to Comprehensive Zoning By-law 76-13 and 2001-112, (Lot 21, Con. 11, Ward 3), By-Law.
