BEING A BY·LAW TO AMEND ZONING BY-LAW NO. 1988- , BEING THE
COMPREHENSIVE ZONING BY-LAW FOR THE TOWN OF INCARDINE
(LANKIN LOT 35 NIS BROADWAY, REGISTERED P~N 4, 433
BROADWAY), MUNICIPALITY OF KINCARDINE (FORME TOWN OF
KINCARDINE)

WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapt~r 13 authorizes
the Councils of Municipalities to enact and amend zoning by-Ia..ys which comply
with an approved official plan; t .
AND WHEREAS the Council of the Corporation of the Municipa ity of Kincardine
has enacted By-law 1988-1, a zoning by-law enacted under S ction 34 of the
said Planning Act; I

AND WHEREAS the Council of the Corporation of the Municipa ity of Kincardine
desires to amend by-law 1988-1;
NOW THEREFORE the Council of the Corporation of the Municipality of
Kincardine ENACTS as follows:
1. Schedule 'A' to By-law No. 1988-1 as amended, is hereby further
amended by changing thereon from 'Highway Commercia' to 'C3-5', the
zoning designation ofthose lands described as Lot 35, NI Broadway,
Registered Plan 4, 433 Broadway Street, Municipality of ncardine
(former Town of Kincardine) which are outlined on the att ched Schedule
'A'.
By-Law No. 1988-1, as amended, being the Comprehensi e Zoning By-
Law for the Town of Kincardine, is hereby further amende by adding the
following paragraph to subsection 6.3.5 thereof:
(6.3.5.5) Notwithstanding their 'Highway Commercial' zonin designation,
the lands delineated as 'C3-5' on Schedule 'A' to th s By-Law may
be used for duplex dwelling purposes in accordan with the
'Highway Commercial' zone provisions contained i this by-law,
excepting however that: ,

such duplex use will be permitted only as lo~g as that use is
continuous. If the use is changed then the d~plex use will
cease to be a permitted use. ' .
the minimum lot frontage shall be 11.2 metr s (36.75 feet).
the minimum westerly side yard shall be 2.8 metres (9.3
feet).
the maximum side yard encroachment for th existing iron
steps shall be 1.93 metres (6.34 feet).
all future development must comply with the requirements of
the by-law

This By-law takes effect from the date of passage by COf'nCiI and comes
into force and effect pursuant to the provisions of the Pia ning Act, R.S.O.
1990.
This By-law may be cited as the "Amendment to Compre~ensive Zoning
By-law 88-01, (Lot 35 N/S Broadway, Plan 4 Ward 1), BytLaw.
