A e e e e THE CORPORATION OF THE MUNICIPALITY OF KINC~INE KBT No. 2002- 21 BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 82-0 ,BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE TOWNSHIP F KINCARDINE (EURO-CANADA IC PROPERTIES PART LOT 28, CON ESSION A), MUNICIPALITY OF KINCARDINE (FORMER TOWNSHIP 0 KINCARDINE) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Cha~ter 13 authorizes the Councils of Municipalities to enact and amend zoning by-14ws which comply with an approved official plan; I AND WHEREAS the Council of the Corporation of the MunicipLlity of Kincardine has enacted By-law 82-08, a zoning by-law enacted under se~on 34 of the said Planning Act; I AND WHEREAS the Council of the Corporation of the MuniciP~lity of Kincardine desires to amend By-law 82-08; I , . ¡ NOW THEREFORE the Council of the Corporation of th~ Municipality of Kincardine ENACTS as follows: I I . 1. Schedule 'A' to By-law No. 82-08 as amended, is hereby further amended by changing thereon from 'A1-General Agriculture' and' P-Environmental Protection' to 'A-2002-21 a', 'A-2002-21b' and 'EP', the z ning designation of those lands described as Part of Lot 28, Concession ,Municipality of Kincardine (former Township of Kincardine) which are 0 tlined on the attached Schedule 'A'. By-Law No. 82-08, as amended, being the Comprehensi e Zoning By-Law for the Township of Kincardine, is hereby further amend d by adding the following paragraphs to Subsection 9.3 thereof: I Notwithstanding their 'Agriculture Zone 1 (Genera;AgriCulture) A l' zoning designation, the lands delineated as 'A-20 2-21a' on Schedule 'A' to this By-law may be used for rural esidential purposes in accordance with the 'Agriculture Zon11 (General Agriculture) A1' zone provisions contained in this fy-Iaw, excepting however that: I I I (i) the 'minimum lot area' shall be 3.72 ha (9.~ acres) (Ii) all future development must comply with thþ requirements of the By-law I (Iii) no intensive livestock operations (over 150¡IiVestock units or 1.5 livestock units per tillable acre) shall be permitted. (iv) th~ two (2) existing dwelling units shall be ermitted on the same lot. I 2. Notwithstanding their 'Agriculture Zone 1 (Genera Agriculture) A1' zoning designation, the lands delineated as 'A-20 2-21 b' on Schedule 'A' to this By-Law shall be used in acco ance with the 'Agriculture Zone 1 (General Agriculture) A1' zon provisions contained in this By-Law. .../2 _L e e e e By-Law No. 2002 - 21 I Amendment to By-law 82-08 (Part Lot 28 Con. 4) (Ward2) Page20f2 ' I I I , I This By-law takes effect from the date of passage by Co~ncil and comes into force and effect pursuant to the provisions of the PI~nning Act, R.S.O. 1990. I This By-law may be cited as the "Amendment to compr~hensive Zoning By-law 82-08, (Part Lot 28 Con. A, Ward 2), By-Law.
