HomeMy WebLinkAbout02 103 amen zon torn e - e e , l TIIE CORPORATION OF TIlE MUNICIPALITY OF KINCÞjRDINE No. 2002 . 103 BEING A BY·LAW TO AMEND ZONING BY·LAW NO. 82-08, BEING THE COMPREHENSIVE ZONING BY·LAW FOR THE TOWNSHIP OF KINCARDINE (THORN, PART LOT 51, CON. A, REFERENCE PLAN 3R-6599), MUNICIPALITY OF KINCARDINE (FORMER TOWNSHIP OF KINCARDINE) WHEREAS Section .34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Township of Kincardine has enacted By-law 82-08, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Township of Kincardine has restructured to be part of the Corporation of the Municipality of Kincardine; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend by-law 82-08; NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A'to By-law No. 82-08 as amended, is hereby further amended by changing thereon from 'PD-98-21, and 'Environmental Protection EP' to 'Suburban Residential R3' and 'Environmental Protection EP-2', the zoning of those lands described as Part Lot 51, Concession A, Municipality of Kincardine (former Township of Kincardine) which are outlined on the attached Schedule 'A'. 2. By-law NO.82-Q8, as amended, being the Comprehensive Zoning By-law for the Township of Kincardine, is hereby further amended by adding the following subsection to Section 31.4: 31.4.3 Notwithstanding their 'EP' zoning designation, those lands delineated as EP-2 on Schedule 'A' shall be restricted in their 'Environmental Protection' uses so that: i) The lands shall not be altered, regraded, filled or excavated; ii) No trees shall be removed except for proper forest management practices and for safety reasons. 3. That the following lands are hereby subject to Site Plan Control: (i) Those lands within the 'R3-Suburban Residential' zone, described as Part Lot 51, Concession 'A', Municipality of Kincardine (former Township of Kincardine) and attached as Schedule 'A'. .../2 e e e e By-law No. 2002-103 Amendment to Comprehensive Zoning By-law 88-01, (Part Lot 51, Con. That no person shall undertake any development unless the Municipality of Kincardine has approved of plans, drawings, agreements and other matters referred to in Section 41 of the Planning Act, R.S.O. 1990, or has passed a By- law exempting the development from such works. 5. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 6. This By-law may be cited as the "Amendment to Comprehensive Zoning By-law 82-08, (Part Lot 51, Con. A, Reference Plan 3R-6599, Ward 2), By-Law.
