HomeMy WebLinkAbout02 161 amend zoning alexander e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2002 -161 BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 82-08, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE TOWNSHIP OF KINCARDINE (ALEXANDER, LOT 34, CONCESSION 11), MUNICIPALITY OF KINCARDINE (FORMER TOWNSHIP OF KINCARDINE) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Township of Kincardine has enacted By-law 82-08, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Corporation of the Township of Kincardine has restructured to now be a part of the Corporation of the Municipality of Kincardine; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine deems it expedient to amend by-law 91-34, an amendment to zoning by-law 82-08; NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A'to By-law No. 82-08 as amended, is hereby further amended by changing thereon from 'A1' to 'A1-2002-161 a', 'A1-2002-161b'and 'EP', the zoning designation of those lands described as Lot 34, Concession 11, Municipality of Kincardine (former Township of Kincardine) which are outlined on the attached Schedule 'A'. 2. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law for the Township of Kincardine, is hereby further amended by adding the following paragraphs to subsection 9.3 thereof: Notwithstanding their A1 (General Agriculture)' zoning designation, the lands delineated as 'A1-2002-161a' on Schedule 'A' to this By-Law may be used for rural residential purposes in accordance with the 'A1' zone provisions contained in this by-law, excepting however that: (i) the 'minimum lot area' shall be 0.69 hectares (1.71 acres) (ii) all future development must comply with the requirements of the by- law (iii) no intensive livestock operations (over 150 livestock units or 1.5 livestock units per tillable acre) shall be permitted. .../2 e e e e By-law No. 2002 - 161 Amendment to Comprehensive Zoning By-law 82-08, (Lot 34, Con. 11, Ward 2) Page 2 of 2 Notwithstanding their 'A1'-zoning designation, the lands delineated as 'A-2002-161b' on Schedule 'A' to this By-Law shall be used in accordance with the 'A1' zone provisions contained in this By-Law excepting however that: (i) no residential buildings or residential structures shall be permitted. 3. That By-law Number 2002-148 of the Municipality of Kincardine is hereby repealed . 4. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 5. This By-law may be cited as the "Amendment to Comprehensive Zoning By-law 82-08, (Lot 34, Con. 11, Ward 2), By-Law.
