TIIE CORPORATION OF THE MUNICIPALITY OF KINC INE
BY-LAW
NO. 2002 - 73
BEING A BY-LAW TO ACCEPT A TENDER TO PURC ASE A
ROADSIDE MOWER WITH TRACTOR LOADE
(Coleman Equipment Inc.)
WHEREAS the Council for The Corporation of the Municipal of Kincardine
deems it expedient to accept a tender for the purchase of a roa side mower with
tractor loader.
NOW THEREFORE the Council for The Corporation of th
Kincardine ENACTS as follows:
of
1. That the tender of Coleman Equipment Inc. in the otal amount of
$122,588.56 including all applicable taxes, be hereby acc pted.
2. That the Mayor and CAO be hereby authorized to sign, on behalf of the
Council for The Corporation of the Municipality of Kincard ne any contracts
and other documents required to authorize such work to c mmence, and to
affix the corporate seal of The Municipality of Kincardine.
This by-law shall come into full force and effect upon its fi1al passage.
This by-law may be cited as the "Roadside Mower Wit~ Tractor Loader,
Tender Acceptance By-law". I·

hereinafter called the "MUIÙcipality"

WITNESSETH, that the party of the first part, for and in consideration of the payment or payments
specified in the Tender for this work, hereby agrees to furnish all ~ry ßlIIí".h;nery, tools,
equipment, supplies, labour, and other means of consIructÎon and, to the satiAfaction of the Public
WOIks Manager, to do all the work as described hereafter, furnish all the materials except as herein
othecwise specified, and to compIde such works in strict accordance with the plans, specifications and
Tender therefore, which are identified and acknowledged in the Schedule of Provisions, Plans,
Specifications and Conditions attached to the Tender and all ofwhich are to be read herewith and form
part of this present Agreement as fully and completely to all intents and purposes as though all the
stipulations hereofhave been embodied herein.

IN CONSIDERATION WHEREOF, said party of the second part agrees to pay to the Contractor for
all work done, and the UIÙt prices on the Tender.
This agreement shall ensure to the benefit of and the binding upon the heirs, executors, administrators
and assigns of the parties hereto.
IN WITNESS WHEREOF, the Contractor and the Municipality have hereunto signed their names and
set their seals on the day first above written.
