HomeMy WebLinkAbout02 129 td landscape design e e e e mE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2002 - 129 BEING A BY -LAW TO ACCEPT A TENDER FOR THE LANDSCAPE DESIGN FOR TIVERTON AND KINCARDINE DOWNTOWN AREAS (Stemski Kelly Associates Inc.) WHEREAS the Council for The Corporation of the Municipality of Kincardine deems it expedient to accept a tender for the conceptual design stage of a Tiverton and Kincardine downtown landscape revitalization project. NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the tender of Stemski Kelly Associates Inc. in an amount not to exceed $20,000.00 plus all applicable taxes, be hereby accepted. 2. That the Mayor and CAO be hereby authorized to sign, on behalf of the Council for The Corporation of the Municipality of Kincardine any contracts and other documents required to authorize such work to commence, and to affix the corporate seal of The Municipality of Kincardine. 3. This by-law shall come into full force and effect upon its final passage. 4. This· by-law may be cited as the "Landscape Design (Tiverton and Kincardine Downtown) Tender Acceptance By-law·. Chief Administrative Officer Municipality of Kincardine 1475 Concession 5, RR #5 Kincardine, Ontario N2Z 2X6 BY HAND Dear John: Re: Landscape Archltec:tural Services Streetscape Redevelopment Concepts - Kincardine & Tiverton The purpose of this letter is to confirm the arrangements between the Municipality of Kincardine and Stempski Kelly Associates Inc. for professional landscape architectural services related to Streetscape Redevelopment. The project areas being both Kincardine's and Tiverton's 'main' streets including the stretch of Queen St. from Broadway south to the Geddes Environmental Park in the Town of Kincardine and from Robinson St. west to King St. south to Manse St. in the Village of Tiverton. The Municipality of Kincardine hereby authorizes Stempski Kelly to proceed with Part One and Part Two described in the Stempski Kelly Associates Inc. proposal dated 09 July 2002. Total professional fees for the completion of those services listed in the Work Plan of the proposal are not to exceed $20,000. Reimbursement for travel, printing and communication expenses directly related to the provision of these services will be computed at cost and paid for by the Municipality. Geotechnical services and/or surveys will be provided by the Municipality. Given that this letter of Agreement is signed and the accompanying retainer received by Stempski Kelly no later than 01 September 2002 and that suitable survey information received by Stempski Kelly is available by 06 September 2002, the project will proceed on a best effort basis in accordance with the schedule defined during project briefing. Expenses and percentage completion of professional fees incurred in each monthly period shall be invoiced to the Municipality of Kincardine at the end of each month. The total monthly invoice for fees and/or expenses will be due and payable within 30 days of the invoice date. Interest will be charged at a rate of 1 % per month (12.68% per annum) on overdue accounts.
