BY-LAW
NO. 2001 - 107
A BY-lAW TO AUTHORIZE THE SIGNING OF AN AGREEMENT WITH
THE KINCARDINE & AREA PHYSICIANS AND
THE MUNICIPALITY OF THE TOWNSHIP OF HURON-KIN lOSS
WHEREAS the Council for The Municipality of Kincardine deems it advisable to
enter into an Agreement with the Municipality of the Township of Huron-Kinloss
to participate with the Kincardine & Area Physicians in backing the Line of Credit
for the Community Medical Clinic.
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the Corporation of the Municipality of Kincardine enter into an agreement
with the Municipality of the Township of Huron-Kinloss and the Kincardine &
Area Physicians in backing the Line of Credit for the Community Medical
Clinic.
2. That the Mayor and CAO be authorized to sign, on behalf of The Corporation
of the Municipality of Kincardine, the Agreement with the Municipality of the
Township of Huron-Kinloss and the Kincardine & Area Physicians attached to
this by-law and to affix the corporate seal as and when required.
3. This By-law shall come into full force and effect upon its final passage.
4. This By-law may be cited as the "Tripartite Agreement, By-law".
READ a FIRST, SECOND, and THIRD time and DEEMED TO BE PASSED
this 29th day of August, 2001.

COMMUNITY MEDICAL CLINIC
TRIPARTITE AGREEMENT
Be it resolved that the following conditions for financing a $50,000.00 Line of
Credit for the Community Medical Clinic are as noted:
1. The municipalities of the Township of Huron-Kinloss and the Municipality
of Kincardine agree to participate with the Kincardine and Area Physicians
in backing the $50,000.00 Line of Credit.
2. The Line of Credit will be financed by the Municipality of Kincardine with
both interest and capital to be repaid from joint fundraising efforts.
3. In the event that fund raising efforts fail to repay the Line of Credit, the
following obligations shall be borne by the three signatory parties:
a) Kincardine and Area Physicians to pay $7,000.00 from their
medical education fund.
b)
The Township of Huron-Kinloss to then fund 30% of the
balance of funds outstanding.
c)
The Municipality of Kincardine to fund 70% of the balance of
funds outstanding.
4. The policies of the Municipality of Kincardine are to be followed with
respect to both the Committee's funds and actions.
5. All funds from the Kincardine line of credit shall be paid back upon the
expiry of a 12-month period (August 8, 2001 to August 8, 2002).
