THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2007 - 108 BEING A BY-LAW TO SET RATES AND FEES FOR SOLID WASTE MANAGEMENT, SANITARY AND WATER CAPITAL CHARGES AND SANITARY SEWER AND WATER OPERATING CHARGES FOR THE MUNICIPALITY OF KINCARDINE WHEREAS Section 391 (1) of the Municipal Act 2001, S.O. 2001, c. 25, as amended, authorizes municipalities to pass by-laws imposing fees or charges on persons, (a) for services or activities provided or done by or on behalf of it; (b) for costs payable by it for services or activities provided or done by or on behalf of any other municipality or any local board; and (c) for the use of its property including property under its control. AND WHEREAS pursuant to the said Municipal Act, Section 391 (3) provides that the costs included in a fee or charge may include costs incurred by the municipality related to administration enforcement and the establishment, acquisition and replacement of capital assets; AND WHEREAS pursuant to the said Municipal Act, Section 391 (4) provides that a fee or charge may be imposed whether or not it is mandatory for the municipality or local board imposing the fee or charge to provide to do the service or activity, pay the costs or allow the use of its property; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the rates and fees for Solid Waste Management, as described in the attached Schedule "A" ", be hereby set. 2. That the rates and fees for Sanitary Sewer Capital Charges, as described in the attached Schedule "B", be hereby set. 3. That the rates and fees for Water Capital Charges, as described in the attached Schedule "C", be hereby set. 4. That the rates and fees for Sanitary Sewer Operating Charges, as described in the attached Schedule "0", be hereby set. 5. That the rates and fees for Water Operating Charges, as described in the attached Schedule "E", be hereby set. 6. That By-law No. 2005 - 197 and By-law No. 2006 - 088 are hereby repealed. . . ./2 . . . . Page 2 Consolidated Fees Solid Waste Management, Sanitary Sewer and Water By-law No. 2007 - 108 7. That this by-law shall supercede any previous by-law inconsistent with the provisions contained herein. 8. That this by-law shall come into full force and effect upon its final passage. 9. That this By-Law may be cited as the "2007 Consolidated Solid Waste Management, Sanitary Sewer and Water Rates and Fees By-law". READ a FIRST and SECOND TIME this 11th day of July, 2007. Any property, which undertakes a re-zoning of its status, will be subject to a review of its contribution to capital as a condition of the development review. b) Contribution to Sewer Reserve Fund (GST exempt) (to be determined at time of connection based on existing per user amount on hand in the Sewer Reserve Fund) c) Sanitary Sewer Main Charge (Plus GST) i) Property owner to pay Municipality's cost including administration related to installation of the sanitary sewer main and all appurtenances d) Sanitary Sewer Lateral Charge (Plus GST) i) Property owner to pay Municipality's cost including administration related to installation of the lateral from the sewer main to the property line. . . . .
