BY-LAW NO. 1994-41
A BY-LAW TO AUTHORIZE THE SIGNING OF AN EASEMENT AGREEMENT
WITH THE KINCARDINE PUBLIC UTILITIES COMMISSION
WHEREAS the Council for
Town of Kincardine deems it
easement agreement;

NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:
1. That The Corporation of the Town of Kincardine enter into
an agreement with the Kincardine Public utilities
Commission to establish an easement in the Town's favour
over the lands formerly known as the Durham street Road
Allowance.
2. That the mayor and clerk be authorized to sign, on behalf
of The Corporation of the Town of Kincardine, the
agreement with Kincardine Public utilities Commission
which is attached to this by-law and to affix the Town's
Corporate seal as and when required.
3. This by-law shall come into full force and effect upon
its final passage.
4.
This by-law may be cited as the "Durham street Easement
Agreement By-law".
READ a FIRST and SECOND time this 19th day of June, 1994.
READ a THIRD time and FINALLY PASSED this 7th day of July, 1994.

THE CORPORATION OF THE TOWN OF KINCARDINE
hereinafter called the "Town"
of the First Part,
-and-
THE
~~IIB PUBLIC UTILITIES COMMISSION OF THE TOWN
OF KINCARDINE
hereinafter called the "PUC",
of the Second Part.
WHEREAS the PUC is the owner of the lands, more
particularly described in Schedule "A" attached hereto;
AND WHEREAS the Town is a municipal Corporation owning and
operating a sewage system;
AND WHEREAS for the proper distribution of sewage, the
Town requires a right and easement in, over and through
the lands described more particularly in Schedu e "A"

NOW THEREFORE THIS AGREEMENT WITNESSETH THAT in considera-
tion of the premises and mutual promises and covenants
hereinafter contained, the parties hereby agree as follows:
The PUC grants to the Town in the lands described in
Schedule "A", the free, uninterrupted and· unobstructed
right and easement in perpetuity to carry, pass,
direct, conveyor transport sewage through a covered
pipe or pipes on, over or upon the lands described in
Schedule "A" and connect with the water distribution
system operated by the Town and also the right of the
Town's agents, workmen, employees, independent
contractors and servants, at any time or times, to
enter upon said lands with or without machinery and/or
equipment to excavate, dig, clear, clean, remove
debris, keep open, lay down pipes, maintain pipes and
replace pipes and all other appurtenances necessary to
maintain a flow of sewage and all other work required
incidental to the operation of a sewage system at all
times is deemed necessary by the Town.
2. In addition to the right in the land and the use
thereof, the PUC covenants that they shall not
obstruct, build upon, or in any way encumber the lands
in any manner in priority to this agreement or the
rights contained herein and will not place upon the
surface of these lands any matter or material other
than soil and an acceptable surface material.

The Town upon receipt hereof covenants that it will
restore the surface from time to time if and when
disturbed by the Town and such restoration shall be as
close as reasonably possible to the original state and
texture and completed as expeditiously as possible.
4. On or before execution of this Agreement, the Town
agrees to pay the Town's costs for the preparation of
this Agreement, title searches at the Registry Office
and the registration of this Agreement.

This Agreement shall enure to the benefit
binding upon the parties hereto and their
successors and assigns and shall run with
land owned by the parties.
IN WITNESS WHEREOF the parties hereto have hereunto
their corporate seals attested by the hands of their
authorized officers.
