BY-LAW NO. 1994-29
A BY-LAW TO AUTHORIZE THE SIGNING OF A CONTRACT WITH THE
ONTARIO PROVINCIAL POLICE FOR THE PROVISION OF POLICE SERVICES
WHEREAS the Council for The Corporation of the Town of
Kincardine deems it advisable to enter into a contract for the
provision of police services;
NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:
1. That The Corporation of the Town of Kincardine enter into
an agreement with the ontario provincial Police for the
provision of police services for the Town of Kincardine.
2. That the mayor and clerk be authorized to sign, on behalf
of The Corporation of the Town of Kincardine, the
agreement with the ontario Provincial Police which is
attached to this by-law and to affix the Town's Corporate
seal as and when required.
3. This by-law shall come into full force and effect upon
its final passage.
4.
This by-law may be cited as the "oPP, Police services
Agreement By-law".

a) Under section 4 of the Police Services Act, R.S.O.
1990 c.P. 15 ("the Act"), Kincardine is required to
provide adequate and effective police services in
accordance with its needs;
b) Under . section 5 of the Act, Kincardine's
responsibility for providing police services may be
discharged by entering into an Agreement with Ontario
under section 10 of the Act;
c) Kincardine proposes to provide pOlice services, in
pursuance of its responsibilities under section 5 of
the Act, by means of this Agreement;
d)
The Kincardine Police Services Board (the "Board") by
Resolution Number 150 passed on the 13th day of July
, 1993, a copy of which is attached hereto as Schedule
"A", has consented to this Agreement pursuant to
subsection 1'()(2) of the Act;
e)
This Agreement reflects the intent of the parties to
provide a level of police service for Kincardine
as set out in the "Proposal for Policing Services"
dated 13 April,1993, ( Schedule - B -).

This Agreement reflects the intent of 'the parties that
the proportion of the total cost of maintaining the
Kincardine detachment of the Ontario Provincial Police
(-O.P.P.") which are paid by Kincardine, is directly
, attributable to the cost of providing police services
in and for Kincardine.
NOW TBBREFORB, in consideration of the premises and the covenants
herein, the parties agree as follows:

The parties Warrant that the recitals are true.
Definitions
2.
In this Agreement:
i)
"Annual Budget" means a budgetary estimate of the
annual Kincardine police cost showing the
budgetary estimate for each component and the
service levels and equipment and all other
matters prepared by Ontario, the O.P.P. or the
Commissioner and submitted to the Board for
approval by Kincardine 'under this Agreement.

ii) "Annual Pinancial Statement" means a financial
statement which presents the annual Kincardine
police costs incurred in the same year, in
accordance with generally accepted accounting
principles, subject to this Agreement, prepared
by Ontario, the O.P.P. or the Commissioner and
submitted to the Police Services Board for
approval by Kincardine under this Agreement.
iii) "Board" means the Kincardine Police Services
Board.
iv) "Commissioner" means the Commissioner of the
O.P.P.
v) "Detachment Commander" means the O.P.P. officer
in charge of Kincardine Detachment.

General provisions
3. Ontario shall provide adequate and effective police services
in accordance with the needs of Kincardine in compliance with the
.erms and conditions of the Agreement. Kincardine shall pay Ontario
. for the police services provided under this Agreement in accordance
with the terms and conditions of this Agreement.

.4. The Board shall advise Ontario and the Detachment Commander
directly or through the Detachment Sergeant, regarding police services
in Kincardine, and may generally determine priorities in Kincardine
in respect to police services, in accordance with this Agreement and
provincial pOlicies affecting the O.P.P.
5. The Commissioner shall ensure that the Detachment Commander
responds appropriately to the Board's advice and priorities in a
manner consistent with the Board's identified concerns, expectations
and needs. .
6. The parties agree that. the Chair of the Board, or their
Board member representative, shall be a member of the Selection
Committee to select a new Detachment Commander should a vacancy in
,that position arise.
7. For the purposes of subsection 10(4) of the Act, Kincardine
shall be deemed the municipality in respect of which the O.P.P. are
assigned to provide pOlice services under this Agreement which shall
include the enforcement of mutually agreed upon by-laws. The parties
shall annually review this part of the Agreement with a view to
. revising or updating the list of by-laws requiring O.P.P. enforcement.
~icipal building code violations overseen by Kincardine's building
code inspector and those by-laws related to animal control will not
form part of this Agreement.
8. On at least a monthly basis and as additionally requested
by the Board, Qntario shall cause representatives of the O.P.P., with
the appropriate rank and authority as the circumstances require, to
report to the Board regarding the provision of police services in and
for Kincardine.
Service Levels
9. Ontario shall cause the Commissioner to assign police
officers and other persons to duties relating to the police services
in and for Kincardine so as to meet the service level requirements set
out in Schedule "B" attached hereto and forming part of this
Agreement. Kincardine shall provide a Full Time clerical position (35
hours per week) .
10. Ontario shall cause the Commissioner to provide a minimum
.Of 1456 hours of actual work per calendar year by the appropriately
ranked persons at regular non-overtime rates for each actual position
as is outlined in Schedule -B". When less than 100% of the time of
an actual position is dedicated to providing service to Kincardine,
then the minimum'costshall be reduced accordingly.
.1. The parties shall yearly review the service levels as are
" . ound in Schedule "B" and shall make the appropriate adjustments to
the Annual Budget.

4Þ 12. Ontario shall deliver to the Board each calendar month, a
statement with respect to statistical information as required by the
Board with respect to police services as provided under this
Agreement. Ontario shall keep or cause to be kept such records as may
be necessary to support and verify the statement provided.
13 Agreements pertaining to Auxiliary's and Court Room Security
are outlined in Schedule " B "
Bauiament and Facilities
14. Ontario shall supply or cause to be supplied at Ontario's
cost all vehicles and equipment reasonably necessary and appropriate
for the use of "the O.P.P. in providing police services under this
contract. Appropriate amounts in respect of the depreciation of the
capital cost of such veh~cles and equipment, if any, may be included
in the Annual Budget.
15. The parties will enter into negotiations with regard to the
provision and payment of appropriate buildings and rental agreements.
. Cost of Police Services
16. Ontario shall prepare and deliver to the Board for review
and for the apProval of Eincardine, on or before the first day of
December in each year,the Annual Budget for the following year
(Schedule ·C-), together with sufficient documentation and information
reasonably necessary to explain and support the services levels, the
adequacy of equipment and facilities and all other matters ,affecting
the Annual Budget. Unless and until the Annual Budget for any year
is approved by Kincardine, the Annual Budget for that year shall be
deemed to be the Annual Budget for the previous year, increased only
by inflation determined in accordance with the change in the Ontario
consumer price index for the latest 12 month period at time of
quarterly invoice provided that any known increases in wage rates or
benefit levels pursuant to a collective agreement shall be used for
those labour costs rather than inflation, whichever is lower.
kincardine, the Board and Ontario shall negotiate in good faith to
resolve any differences which may arise concerning the approval of the
Annual Budget with a view to resolving any differences no later than
the 31st day of May in the year to which it relates.
.17. Kincardine shall make quarterly instalment payments to
Ontario on the last days of March, June, September and December in
each year, each being one quarter of the Annu.al Budget for that year
subj ect to adjustment in accordance with the Annual Financial
Statement as set out below. If any instalment ,is made in respect of
.~ calendar year before the approval of the Annual Budget for that
. ~ear, following the approval of the Annual Budget, at the time of the
. . payment of the next instalment for that year, an adjustment shall be
. made so as to bring all instalments in conformity with the Annual
Budget.

-18.
On or before the 31st day of March in each year following
a year to which this Agreement applies, Ontario shall deliver to the
Board an Annual Financial Statement for the preceding calendar year,
for the approval of Kincardine. Ontario shall keep all records,
statements of account, invoices and any other such documents necessary
to support the Annual Financial Statement and all such records shall
be kept for a period of six years. Ontario shall permit the Board and
Kincardine, upon notice to Ontario, to examine all such records and
books of account and conduct a review of the Annual Financial
Statement.
19. Should Kincardine fail to notify Ontario of its approval of
the Annual Financial Statement within 90 days following its delivery
to them,it shall be deemed to be approved. However, should either
the Board or Kincardine deliver to Ontario a request to review the
Annual Financial Statement within 90 days following its delivery to
them, it shall only be approved or amended and approved in accordance
with paragraph 19.
20. Where the Board or Kincardine has delivered to Ontario a
. request to review the Ann\1al Financial Statement the party requesting
the review shall carry it out expeditiously and all parties shall
cooperate to permit such a review to be carried out. If the parties
are unable to agree on the Annual Financial Statement, then either
pàrty may submit the màtter to the dispute resolution mechanism
contained in paragraph 24.
21. Upon the approval, deemed approval or adjudicated approval
of the Annual Financial Statement, as hereinafter provided, an
adjustment shall be made in the amounts paid by Kincardine by
instalment so that the total amount paid is equal to the amount as
shown on the approved Annual Financial Statement. Any amounts payable
by one party to the other as a result of such adjustment shall be paid
within 60 days following the approval, deemed approval or adjudicated
'approval of the Annual Financial Statement. Any amounts which have
become due and owing by one party or the other according to the
adjustment shall bear interest at the rate set by the Treasurer of
Ontario, from time to time for the purpose of repayment of taxes, from
30 days following the date of invoice by one party to the other.
22. Notwithstanding anything in this Agreement, the total amount
. of money paid by Kincardine for police services in respect of any
. calendar year shall not exceed the Annual Budget for that year,
whether approved or not, and the Annual Financial Statement shall be
amended to reduce or eliminate any such excess shown therein unless
the costs or expenses incurred which have caused the excess have been
.' incurred as a result of:
a) an emergency where the emergency area includes the
whole or any part of Kincardine and an emergency has been
.

declared under the EMERGENCY PLANS ACT R.S.O. 1990, c.E.9,
and all contributions to defray any costs incurred in that
connection from any provincial or federal government
sources which may be reasonably expected have been
accounted for;
b) the implementation of collective agreements or the
imposition of an award under interest arbitration in
respect of any wages, benefits or other labour related
matters;
c) compliance with any laws, by-lëlws or regulations which
become applicable to this Agreement or the provision of
police services following the'approval of the Annual Budget
for that year; or
d) any other matters which require the provision of municipal
police services in Kincardinè and which were beyond the
control of Ontario, the Commissioner and the O.P.P., and
. which were unforeseeable at the time of the approval of the
Annual Budget.

23. Ontario shall indemnify and keep indemnified and save
harmless Kincardine and the Board of and from any and all claims,
demands, actions, causes of action, other proceedings, liability for
damages, compensation, costs and expenses, including its own legal
fees and disbursements, which may be brought against them or for which
they become liable or incur in respect of any personal injury,
(including personal injury causing death or psychological trauma),
property damage, breach of contract, the breach of any statute or law
of Canada, the Province of Ontario or municipal by-law, or the
infringement. of any rights under the Constitution of Canada, any
labour agreement or employment practice or anything related thereto
or for any cause whatsoever arising out of any act or omission by
Ontario, the Commissioner or the O.P.P. or anyone for whom they are
responsible at law in any year to which this Agreement applies,
whether or not occurring in Kincardine or anywhere else.
24. Notwithstanding anything else in this Agreement, the Annual
Financial Statement shall not include any amounts paid or payable by
. Ontario under this indemnity and without limiting the generality of
the foregoing, shall not include any compensation, damages or costs
ordered or awarded by any court or tribunal to be paid by Ontario, the
Commissioner or the O.P.P. and shall not include any legal costs and
disbursements incurred by Ontario, the Commissioner or the O.P.P. in
~. .... respect of the defence or prosecution of any action or proceeding

4IÞDiSDute Resolution MechAnism
25. In the event a dispute arises between the parties regarding
the interpretation, application, administration or alleged violation
of this Agreement, the Detachment Commander or his representative
agrees to meet with the Board and or Kincardine at the earliest
available opportunity to discuss the dispute. If the dispute remains
unresolved at the Detachment level, the District Commander or his
representative agrees to meet with the Board and or Kincardine at the
earliest available opportunity. If the dispute remains unresolved at
the District level, the Commissioner or, in his absence, a Deputy
Commissioner, agrees to meet with the Board and or Kincardine at the
earliest available opportunity.
Notice
26. Any notice, statement, invoice or account to be delivered
or given by any of the below listed groups to any other of them shall
be delivered to all other groups in writing and sent by prepaid first
class mail addressed to those groups at their respective address as
listed hereunder, or sent by fax transmission sent at the respective
. fax number listed herein. Any notice, statement, invoice or account
sent by mail shall be deemed to be received on the third day following
the date of mailing unless shown to the contrary and if sent by fax
shall be deemed to be received on the date of transmission. Any group
may change its address and fax number by giving notice provided
herein:

27. This Agreement comes into force on 2nd day of May ,
1994 and shall apply to the provision of police services in and for
Kincardine µntil the 1 st day of May . 1999.
28. At the time of the signing of this Agreement, Ontario will:
(a) offer employment to all serving constables of the
Kincardine Police Service at the rank previously held;
(b) offer employment to all other serving police officers
of the Kincardine Police Service as first-class
constables with the opportunity for them to attain
higher ranks;
(c) recognize all service and seniority accumulated with
the K4ucardine Police Service for all purposes except
pension;
(d)
enror in the Public Service Pension Plan all persons
accepting employment with the O.P.P.

29. Either party to this Agreement may terminate this Agreement
upon one year written notice of termination to the other party, in
which case this Agreement shall terminate one year following the
delivery of such notice. Should a notice to terminate be given,
Kincardine. shall continue to be obligated to pay for the cost of
providing police services under this contract to and including the
date of termination and Ontario shall continue to be responsible to
provide the services outlined in this Agreement and to indemnify and
save harmless Kincardine under' the terms of the indemnification
sections of this Agreement in respect of anything occurring prior to
the termination notwithstanding the termination.
30 Should Kincardine'. designated responsibility to provide
policing under the Act be changed either by statute or government
interpretation, Kincardine maintains its right upon being so informed
to give written notice of its intention to terminate this Agreement
forthwith.
Entire Aareement
.31. This Agreement and the schedules attached constitute the
entire Agreement between the parties hereto, and there are, no
representations, warranties, collateral agreements or conditions
affecting this Agreement or the relationship of the parties or
~pported hereby other than as expressed herein in writing. This
. reement may only be amended in writing, duly executed by the parties

EXECUTIVE SUMMARY
The Council of the Corporation of the Town of Kincardine advised
the Ministry of the Solicitor General by way of resolution dated
March 7, 1991, that they wished to obtain a costing quotation for
the provision of OPP policing services pursuant to Section 10 of
the Police Services Act.
Further, the Kincardine Police Services Board confirmed Council's
request with a Board motion dated June 11, 1991 for the provision
of a comparative opp costing based on a jointly prepared profile of
the Town detailing the levels of service to be costed.
On October 28, 1992, a meeting was conducted in the Town of
Kincardine by the Policing Standards Branch, Policing Services
Division, Ministry of the Solicitor General for the purpose of
explaining the costing procedures as detailed in the report
entitled Policy and Protocol on Regular Contract Policing, dated,
July 1991.
The costing process oommenced on October 28, 1992, with staff from
First Nations and Contract Policing Branch and Mount Forest
District Headquarters providing the analysis of service and
associated costs for opp policing. The process involved an
examination of workload and financial data, provincial comparative
evaluations and interviews of a cross section of community
residents, business persons, members of the Kincardine Police
Services Board and Municipal Council.
The Ontario Provincial Police is committed to providing a community
oriented style of policing that would consult regularly with the
Kincardine Police Services Board; the purpose of which, to jointly
determine policing priorities and requirements that affect the
quality of life within the community.
The options presented for consideration within this document
reflect different complement configurations, two of which, address
the service require.ents as established by the Kincardine Police
Services Board. They are;
24 hour policing coverage
identification of all foreseeable capital costs
response times
by-law enforcement
court security
employment of Kincardine Police Services personnel
the provision of community programs.
Estimated policing cost. are calculated using 1993 costing data.
All salaries identified in the costing reflect the top salary range
for their respective positions and reflect 1993 salaries recently
awarded by the Government of Ontario to the Ontario Provincial
Police Association (OPPA) and the Ontario Public Service Employee's
Union (OPSEU).

THE PROPOSAL
The Kincardine Police Services Board agreed with the Kincardine
Municipal Council in their request for an OPP costing proposal.
Agreed upon, was a level. of service needed to ensure adequate
policing to the residents and visitors of Kincardine.
In the document attaohed to the Kincardine Police Services Board
Motion Form, dated June 11, 1991 and entitled "Reauest for OPP
CaRting Bv The Kincardine Police Services Board Town of
Kinoardine, under the heading "Conoerns/Considerations", the joint
requirements of the Board and Council state;
"In the development and preparation of costs for the
provision of policing services by the O.P.P., there
are a number of concerns and considerations whioh need
to be addressed to ensure a fully informed and intelligent
choice from available options. These include the
following:
Identification of any foreseen capital
costs; i.e. are existing O.P.P. and
Kincardine faoilities and equipment
adequate, in excess of needs, or in-
adequate, and would the Town be required
to incur any costs in addition to
contractual expenditures, if they are
required?
Would existing vehicles and equipment
be taken over by the O.P.P. at a
reasonable consideration?
dispatch location and response time;
by-law enforcement and court security
to be costed separately to permit a
decision regarding exclusion from any
contractual agreement;
future employment of Kincardine Police
Service personnel;
continuation of ·Community Relations"
programs such as:

As well, there is a need to consider the pros and cons of
policing by officers resident in the co..unity."
This proposal addresses the foregoing concernB and details those
services that would be provided under contract exclusively to the
Town of Kincardine as well as those provincial services that are
available to all opp detachments and municipal pOlice services.
An arbitration decision was recently rendered that awards uniformed
officers an increase in salary of one per cent in 1992 and two per
cent in 1993. This agreement concludes December 31, 1993.
Benefit enhancements were also part of the accord which recognizes
an increase in shift Dremium. service badae allowance. BUDDlemental
health and hosnital coverage and lana term income nroteation.
Additionally, OPP dental plans in reSDect to ma;or restorative
service and vision care Dlans have also been enhanced. Uniformed
benefits are costed as a percentage of salary and for 1993 have
been determined to be 23'. .
· Civilian salaries for the identified clerical and caretaking
positions also reflect the latest salary awards for 1992 and 1993.
The civilian contract expires December 31, 1993. Similarly,
benefits are also shown as a percentage of salary and are currently
set at 2a.
Direct Operating Requirements are represented in the reBpective
costing summaries and identify costs associated to vehicle usage,
uniform and equipment, furniture and office equipment, janitorial
supplies, office supplies, telephone usage and acco_odation costs.
OVertime e,stimates represent the provincial average per OPP officer
for the last completed fiscal year and are affected by such
variables as the number of officers currently on staff, complexity
of investigations and major occurrences. Thus, these estimates
vary from year to year. For 1993, the annual estilRate for overtime
per officer is unchanged from 1992 and has been determined to be
$4,580.

Badge Allowance is a financial award which recognizes years of
service. This amount has been increased from $7.50/month in 1992
to $8.50/month in 1993. Additionally, shift premiums have been
increased from $0.41/hr. in 1992 to $0.43/hr. in 1993. Both of
theBe increases were th~result of contract negotiations recently
settled by arbitration. Ancillary services such as guard/matron
duties and prisoner meals are not identified in the costing
summary. Costs associated to these functions would be assigned to
the municipality and individually accounted at the detachment
level.

PERFO~M~~CE EVALUATIONS
Annual evaluations would be completed on all uniformed and civilian
employees.
REPORTING RESPONSIBILITY. POLICE SERVICE ACT
Section 11 of the Act states that the detachaent commander has the
responsibility to report to the Police Services Board on a regular
basis and as determined by the Board. The Board is empowered to
give direction and set priorities with respect to policing
services.
REVENUES
Revenues accruing to Kincardine as the result of policing activity
such as, parking fines and provincial grants per household have NOT
been considered in this proposal.
METHOD OF POLICING
option 1 would provide for 20 hours of ·on duty" coverage with
the remaining 4 hours of "off duty" coverage provided on a
call back basis for which overtime would be charged at the
rate of time and one-half. The existing Kincardine police
building located in Kincardine's downtown core would be used
by the opp stand alone complement as its base of operation
(see page 10 for option specifics).
Qption 1B would be configured in the same manner as Option 1
but would provide complete 24 hour "on duty· coverage with an
additional complement of officers (see page 12 for option
specifics) .
Qption 2 would provide 24 hours of "on duty· coverage from an
integrated complement based at the Kincardine OPP detachment
situated on Highway 21. The Town of Kincardine would become
an ,assigned patrol zone with members of the Kincardine
detachment detailed to provide the contract servioe.
Complement could be rotated in and out of the provincial and
contract obligations as deemed suitable by the Board and the
Detachment Commander (see page 12 for option specifics).

GENERALIZED DUTIES
The following describes generalized police duties and would be
provided to the Town of Kincardine in all options except as
otherwise ,noted.
Patrol. And Of~~ð.r Saf.ty
One officer patrol cars would provide services to the Town
except on Friday and Saturday nights which would require two
officer cars. With the exception of the Friday and Saturday
night requirements as stipulated by the Memorandum of
Understanding, patrol car complements could be altered at the
direction of the Board. The Ontario Provincial Police would
be responsible to dispatch sufficient back up and safety to
occurrences deemed hazardous.
Com.uni~y Poliði~ Olfið.r
The Ontario Provincial Police strongly endorse the cODlDlitment
to co_unity involvement by its members and in turn the
comaitaent of the co_unity's citizens to the OPP. The OPP
would work closely with the Kincardine Police Services Board,
Council, co_unity service groups and members of the co_unity
at large, to foster good working relationships.
Cour~ and Pri_ðnAr R.ððr~.
Routine court and prisoner escorts would be provided by the
complements identified in Option 1, 1B and Option 2.
SAðuri~y Eøðor~R
The contract complement in all options could provide this
service as required at the discretion of the Board.
Court Officer
This function would be provided by a constable position. We
have identified an estimated 408 hours of municipally
generated court officer duties annually which have been
considered in the policing options of this proposal.
Ry-law EnforðAmAn~
The Ontario provincial Police would enforce Municipal By-laws
agreed upon in a seRarate schedule, which would be attached to
the Agreement, should an agreement be signed. This would
become a matter for negotiation. It is reco_ended that the
Board consider retaining the services of the civilian special
constable for the purpose of by-law enforcement as this would
reduce the need for a more expensive constable position.

The opp would provide additional by-law enforcement to
enhance the service provided by the Town's special constable.
Court: SAourity
The OPP would provide courtroom security as required with the
identified complement in each option. Once again, it is
recommended that the special constable be retained to auqment
the opp in this task.
BrAathalY£Ar QpArators
Kincardine detachment presently has four trained breathalyzer
operators performing this specialized function. These members
would be part of the integrated complement and would be
available to perform this service when required. 'In the event
that Kincardine contracts for a stand alone detachment, it
would be necessary to ensure that at least two members were
trained in this capacity.

Also known as detachment planning, this ooncept is practised
at the detachment level. Strategies are developed by
detachment members with input from the community, Police
Services ,Board, and Council, to address identified problems
occurring within their area of policing responsibility. These
plans are monitored to ensure accountability and
effectiveness. The detachment planning concept has formed a
part of the opp II&nave.ent proçess since January, 1976 and has
yielded good results.
EMBaGBNCY RBSPOIISE SEllVICES
Specially training members of the Ontario provincial Police posted
at Kincardine detachment, district headquarters or other areas
within the district or province would provide the following
specialized emergency' response services when required. Many of
these services have traditionally been available to other agencies
upon request. They are;
TAotioal and RASOUA Unit (TRU)
This service would be available to Kincardine should the need
arise to control, contain and defuse serious occurrences. For
example, barricaded/hostage situations or the escort of
dangerous or violent prisoners. The nearest Tactics and
Rescue Unit is located at London, Ontario. The estimated
response time from London to Kincardine is 3 hours.

The Mount Forest District Headquarters containment team is
currently being developed and is expected to be operational in
the 1993 calendar year. Response time from Mount Forest is
estimated to be 50 minutes.

Ontario Provincial Police personnel specifically trained to
perform this function would be made available to Kincardine if
required.

major occurrences to ensure the proper and timely direction of
resources and would be made available to Kincardine if,

Personnel identified and trained in criminal investigation

personnel could be called upon to assist detachment members.

O.P.P. Telecommunications system to accomplish these tasks. Local

OPTION 1
Hum.an RAllourOAS
This policing alternative is given at the request of the Board and
is a direct comparison with the existing Kincardine Municipal
Police Service in teras of staffing and patrol car usage. It most
closely emulates the service now being provided by the Kincardine
Police Service and addresses all specialized services identified by
the Board and Council's joint submission to the Ministry detailing
their policing requirements. The total cost for this policing
option is 81.136.701.
This option dòes NOT, provide for 24 hour "on duty coverage".
However 24 hr. police service is available by having officers on
call when the detachment is closed.
It is important to note, that there is an impact on policing
service levels created through absences. It is recognized that
each member works a forty hour week. However, a variety of factors
such as training, sick leave, annual leave, maternity/adoption
leave, workers' compensation, lunch periods and statutory holidays
reduce the actual number of hours available per officer to respond
to calls for service or to be available for patrol. OPP historical
data indicate that each officer, is on average, available for calls
and patrol approximately 28 hours per week. This factor must be,
taken into consideration when determining complement for twenty-
four hour "on duty" coverage. OPP backup and safety requirements
are also a consideration in this determination.
The following OPP human resources would be required to provide a
"direct comparison" stand alone opp service providing 20 hours of
"on duty· availability.

In addition, civilian clerical staff would be provided by the Board
to support the opp co~lement to the extent that the Board and the
opp deem appropriate. These costs have not been identified in the
oosting as they would be provided and funded by the municipality.
'1'0 clarify this point, the OPP recommend a minimum complement of
one full time and one part time clerical position. These positions
would also be responsible for receptionist duties. It would remain
the prerogative of the Board, to increase the complement. For
example, the Board may r~quire 24 hour receptionist duties. It is
important to note, that civilian staff would remain employees of
the Kincardine Police Services Board and as such would be
remunerated directly by the municipality.

Janitorial support would also be provided and funded by the Town to
maintain the premise utilized by the Ontario provincial Police.
PhYRiðAl RAROUrð8.
The existinq Kincardine Police Service Buildinq owned by the
Corporation of the Town of Kincardine would continue to be used as
the police service headquarters. The Town would assume all costs
for the operation and maintenance of the facility. Aqain, these
costs have not been identified in the costinq summary. Other costs
, such as the provision of office furniture and equipment, janitorial
supplies, telephone and accommodation costs would also be the
financial responsibility of the municipality.
Uniform and associated equipment, vehicles (subject to further
neqotiation), opp stationary and reports would be provided by the
OPP on a cost recovery basis.
A telephone link to the district co_unication dispatch centre
would be required on the exterior of the existinq Kincardine police
building to provide the public with immediate access to the OPP
Communication Centre in Mount Forest. The cost for this equipment
includinq installation and annual service rates are identified in
the Option 1 and lB costing sUDllllary.,
Some of the existine¡ OMPPAC equipment used by the Kincardine Police
Service could be retained for use by the OPP. This equipment would
remain the property of the Town of Kincardine. A review of the
existinq equipment has been completed by Systems Support Branch of
the OPP. They have determined that some of the equipment Blust
either be replaced or upqraded to comply with OPP specifications.
In this instance, the cost for the additional hardware and
installation would be char~ed to the municipality.
Vehicle costs would be assessed at the rate of 29.05 cents per
kilometre. These costs take into consideration qasoline, oil,
repair, preventive aaintenance, insurance, and depreciation costs.
It is estimated that Kincardine would require one marked and one
unmarked unit to provide coverage to the Town. The OPP reviewed
the suitability of utilizinq theexistinq Kincardine Police Service
fleet which would bear OPP markinqs and equipment. Transport
Branch conducted the review and they determined that one 1992
Chevrolet Caprice was suitable for use by the OPP. In the event
that the opp assumes this vehicle, the cost for its purchase would
be separately neqotiated and could be deducted from the' total
annual cost of this proposal.

OPTION 1B
This option provides for complete 24 hour, "on duty" pOlice coverage
and provides for proactive and reactive policing needs in addition
to the specialized requirements set out by the Board. This
alternative is identical to that being offered in Option 1 except
for the enhanced staffinq levels. The total cost for this policinq
option is 81.433.506.
This standalone alternative requires an enhanced staffinq level to
provide a sufficient buffer for absences that might occur as the
result of short term sickness, training, vacation leave, court
attendance and statutory holidays as well as ensuring sufficient
complement to address safety needs. Ontario provincial Police
detachments, as stand alone operations, require a minimum of 15
available constables to provide 24 hour policing coverage to their
respective areas of responsibility. This is a stand alone, 24 hour
option hence, the need for increased staffing levels.

It is proposed, in Option 2, to integrate the human resources
required to service both the contract and provincial
responsibilities at Kincardine detachment. This option parallels
the existing service in Kincardine and is more cost effective than
option 1. Human and physical resources would be apportioned on a
cost share basis. This is accomplished by assigning a percentage
of total resources to fulfill Kincardine's contract needs; thereby
reducing the duplication of services. A detailed workload analysis
(see attached appendices) supports the following complement that
addresses both the Board's and Council's requirements for an opp
contract service. The total cost for this policing option is
8969.142.
The following human resources are required;
44.56' of one staff sergeant position
41.67' of three sergeant positions
100' of 10 provincial constables
41.77' of 2 full time OAG 8 clerical positions
44.56' of one caretaker 1 position.
This complement would be utilized to provide 24 hours of "on duty·
coverage daily to the Town of Kincardine including all identified
specialized services. In addition, police officers responsible for
providing- provinoial policing services are also available to assist
the Kincardine complement as required.
Supervision would be proVided on a shared basis 24 hours per day to
both the provincial a~ contract complements.

1. Dedicated 24 hour contract policing service shall be provided to
the Town of Kincardine seven days per week.
2. This schedule is based on 40 hours per week per officer.
Absences may affect service delivery.
3. The Board in consultation with the Detachment Commander, may

special needs such as Halloween, parades etc.
4. This example provides for a two person patrol car complement to

required between the hours of 2200 and 0600 in the municipal
policing environment on Friday and Saturday nights.

CONDITIONS OF EMPLOYMENT - MUNICIPAL POLICE OFFICERS

Provincial Police must meet the following requirements:'

Section 43, subsection 1, of the Police Services Act states:
"No person shall be appointed a police officer
unless he or she,
(a) is a Canadian citizen or a permanent
resident of Canada;
(b) is at least eighteen years of age;
(c) is physically and mentally able to
perform the duties of the position,
having regard to his or her own safety
and the safety of members of the public;
(d) is of good moral character and habits; and
(e) has successfully completed at least four
years of secondary school education or ;its
equivalent."
Further, subsection 2,' states;
"A cand;idate for appointment as a police officer
shall provide any relevant information or material
that is lawfully requested in connection with his
or her application."
2) On~ario Provinoial Polio. Polioy
As stated in the Ministry of the Solic;itor General, Policy and
Protocol on Policing in Mun;icipalities, "The OPP will hire all
serving uniformed municipal police officers who meet the
requirements of section 43 of the Polic. S.rvices Ac~ and are
not facing cr;iminal charges."
3) Offer of E~loymen~ - Kincardine Police Servic.
Should the Town of Kincardine opt for OPP contract policing, all
current sworn members of the Kincardine Police Service would be
offered employment with the Ontario provincial Police. The
Agreement between the.Ontario Public Service Employees Union and
the Government of Ontario precludes any offer of employment to
the civilian members of the Kincardine Police Service. However,
Option 1 and lB allow the lIIunicipality to provide the clerical
and maintenance staff needed to support an opp complement.

The Board may approve such support over and above our minimum
recomllendations of one full time and one part time clerical
positions as detailed in the respective costing summaries.
4) Probationary Period - Ontario Civil Service
The Public Service Act of Ontario stipulates that all positions
in the classified service shall be sUbject to a probationary
period of service. Section 6 and 7 of the Act state;

"When a vacancy exists in the
classified service, the deputy

the vacancy exists shall nominate
in writing froll the list of eligibles
of the Commission a person to fill
the vacancy." And,
(2)
The Commission shall appoint the
person nominated under subsection

The Commissioner of the Ontario Provincial Police reserves the
right to set the probationary period at a point less than one year.

Some by-law enforcement would not be provided, such as those
traditionally DQt enforced by the OPP in contract locations.
For example, municipalbuildinq code violations overseen by the
buildinqs code inspector(s). Enforcement would include those
municipal·by-lawl as aqreed upon from time to time by the opp
and the Board.

Auxiliary Program
The parties agree that upon disbandment of the Kincardine
Police Service the three members of the former ,Kincardine Auxiliary
Police unit will become members of the O.P.P. auxiliary program.
These three members will be attached to the Owen Sound Auxiliary
unit and will receive their individual training at that location.
The parties agree that OPP has training and operational
standards that must be understood and met before these three
individuals can commence duty with the OPP.
The parties agree that for the purpose of this agreement the
three members formerly members of the Kincardine PD Auxiliary' will
accompany OPP members assigned to patrol the Kincardine integrated
detachment area and will nQk be limited to patrols, solely within
the boundaries of the Town of Kincardine. The parties agree further
that in some situations, e.g. Air Shows , Fairs , emergency
situations etc., the Town may receive at no cost the services of
OPP Auxiliary personnel other than these three.
The cost of this program is based on a one time cost of
$ 1500.00 per member for uniform and equipment. An additional cost
of $ 300.00 per member will be paid annually by the Town to
reimburse costs for Meals, Travel, and Administration expenses.
These costs will be forwarded direct to the Owen Sound Auxiliary
Unit at the commencement of this agreement and annually thereafter.

This agreement comes into force as of the 2nd day of May 1994.
Court roam security for Provincial Court held in Kincardine shall
be provided by the Ontario Provincial Police. Costs for this
service shall be limited to those incurred by the detachment if an
officer is required to attend court for security purposes on
overtime. It is understood that, for the immediate future, the
current court officer will provide this service. If this
arrangement should cease or become inappropriate during the term of
the contract, alternative solutions shall be investigated by the
Town and Ontario Provincial Police at that time.
