THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2007 - 076 BEING A BY -LAW TO AUTHORIZE THE PURCHASE OF LOTS 5, 6 & 7, PLAN 210, QUEEN S/S, [GEOGRAPHIC VILLAGE OF TIVERTON], MUNICIPALITY OF KINCARDINE, FOR THE ESTABLISHMENT OF A PARKETTE WHEREAS Sections 11 (1) and (3) of the Municipal Act, 2001, S.D. 2001, c. 25 as amended gives broad authority to lower-tier municipalities to provide any service or thing that the municipality considers necessary or desirable for the public and respecting matters within the sphere of jurisdiction of culture, parks, recreation and heritage; AND WHEREAS pursuant to the said Municipal Act, Section 8 (1) and 9 provide that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues and has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS the Council for The Corporation of the Municipality of Kincardine deems it advisable to establish a parkette within the geographic Village of Tiverton for the enjoyment of the residents of the Municipality; AND WHEREAS the Council for The Corporation of the Municipality of Kincardine deems it expedient to purchase Lots 5, 6 & 7; Plan 210, [geographic Village of Tiverton), Municipality of Kincardine, County of Bruce, for the establishment of a parkette; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the Mayor and CAD be hereby authorized to execute, on behalf of The Corporation of the Municipality of Kincardine, an Agreement of Purchase and Sale with Patricia Anne Morency, for Lots 5, 6, & 7, Plan 210, [geographic Village of Tiverton), Municipality of Kincardine, County of Bruce, attached hereto as Schedule "Au. 2. That the lands referred to are more particularly set out in the attached Schedule "Au, Agreement of Purchas and Sale. 3. That the purchase price for the said lands shall be $50,000.00, plus any applicable taxes. 4. This by-law shall come into full force and effect upon its final passage. . . ./2 . . . .
