BY-LAW BY-LAW NO. 1994-3 A BY-LAW TO AUTHORIZE THE SIGNING OF AGREEMENTS WITH THE BRUCE AREA SOLID WASTE RECYCLING ASSOCIATION WHEREAS the Council for The Corporation of the Town of Kincardine deems it advisable to enter into an agreement with the Bruce Area Solid Waste Recycling Association to provide recycling services; AND WHEREAS such services may only be provided if the Town of Kincardine is a member of the Bruce Area Solid Waste Recycling Association; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. That The Corporation of the Town of Kincardine enter into agreements with Bruce Area Solid Waste Recycling Association to provide regular pick-up of recyclable materials, and to determine the funding arrangement in order to establish the Town's membership in the Association. 2. That the mayor and clerk of The Corporation of agreements with Bruce Association and to affix when required. be authorized to sign, on behalf the Town of Kincardine, the Area Solid Waste Recycling the Town's Corporate seal as and 3. READ a THIRD time and FINALLY PASSED this 20th day of January, 1994. ~~~ ~ ,'. -/ .. . . . . , , , Recycling Collection Agreement This Agreement made in triplicate this~D~ BETWEEN: Bruce Area Solid Waste Recycling Assoèi¡{t'.~....I'¡ of the Township of Saugeen, in the County of Bruce hereinafter called "The Contractor" of the First Part; AND The Corporation of the Town of Kincardine hereinafter called the Municipality of the Second Part; WITNESSES THAT: L-Tli.·contractt'ir fir andTnconsì.aeratlon"o"f the confract"piice of 30.30 dollars per hour of collection, agrees to collect recyclable material from blue boxes and depot bins at residential households and commercial businesses for a period from the 2nd day of January 1994 to the 1st day of January 1995. Estimated hours of collection for 1994 are 1456. Estimated collection costs for 1994 are $44,116.80. 2. The contractor hereby agrees to the following conditions: a) Recyclable materials to be picked up shall include, all food and beverage cans, newspapers and magazines, coloured and clear glass bottles and jars, plastic containers with screw on 1 ids. The contractor has the right to refuse any unacceptabl e materials. Fine white paper shall be collected from depots only and the schedule for collection shall be set by the contractor. ... b) Recyclable materials to be picked up on a bi-weekly schedule as set by the -contractor for allresi-dential blue boxes and on an as required basis for all commercial businesses. Wì-l-h¡n 4-hì...~ (30) d0-L 5. e) this agreement shall come into force and take effect on the 2nd day of January, 1994 and shall expire on the 1st day day of January, 1995. f) Any disputes arising from this agreement, shall be forwarded, by letter, to the next regular committee meeting of Bruce Area Solid Waste Recycling Association Inc.. All disputes shall be settled by resolution of the board. BETWEEN: BRUCE AREA SOLID WASTE RECYCLING ASSOCIATION INC., of the Township of Saugeen, in the County of Bruce, hereinafter called the "Contractor", of the first part. AND: The Corporation of the Town of Kincardine hereinafter called the "municipality", of the second part. WITNESSES THAT : 1. The Contractor for and in consideration of ..th'~.~__.~ a8Sessment:-è~:tõr-·the---m.lñ15ership ~and . admfnstration in the Association, has set a tee of eight dollars and twenty-four cents ($8.24) per household, for each member municipal i ty, for the year 1994. 2. The Contractor shall invoice this 1 evy to each member municipality on February 1, 1994. This levy shall be assessed as per the unconditional grants act, of the Regional Assessment Office for the household count of each member municipality, for 1994. 3. This agreement shall be signed and payment received at the office of Contractor, by the member municipal i ties by the first day of March, 1994. Non-compliance by any member municipality, shall result in written notice that the municipality has sixty days, from the date of written notice, to comply to the terms of this agreement. On the sixty-first day of non-compliance of this agreement, collection service shall cease. ---4. Any disputêW"pertainin9·tothis agreement, shall be settled by resolution of the Board of the Contractor.
