THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2007 - 068 BEING A BY-LAW TO DEDICATE LAND AS PART OF THE PUBLIC HIGHWAY SYSTEM FOR THE MUNICIPALITY OF KINCARDINE (Parts 10,11 & 12, RP 3R-8413) WHEREAS Section 31 (2) of The Municipal Act, 2001, 5.0. 2001, c. 25, as amended, provides that land may only become a highway by virtue of a by-law establishing the highway; AND WHEREAS pursuant to the said Municipal Act, Section 31 (6) provides that land acquired for the purpose of widening a highway forms part of the highway to the extent of the designated widening; AND WHEREAS pursuant to the said Municipal Act, Section 9 provide a municipality with the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS The Corporation of the Municipality of Kincardine previously acquired land for the purpose of widening and improving the existing highway system of the Municipality of Kincardine; AND WHEREAS it is desirous to accept and dedicate Parts 10, 11 and 12 on Reference plan 3R-8413 as part of the public highway system; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the said lands described in Schedule "A" attached to this by-law are hereby dedicated as part of the public highway system of the Municipality of Kincardine. 2. That this by-law shall become effective upon its final passage by the Council of the Municipality of Kincardine and upon its registration in the Registry Office for the Registry division of Bruce (No.3). 3.
