THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
NO. 2007 - 067
BEING A BY-LAW TO APPOINT JAMIE MacKINNON AS
ADMINISTRATIVE FIRE CHIEF FOR THE MUNICIPALITY OF
KINCARDINE
WHEREAS Section 6(1) of the Fire Protection and Prevention Act, 1997, S.D.
1997, Ch. 4, as amended, provides that if a fire department is established for the
whole or a part of a municipality, the council of the municipality, as the case may
be, shall appoint a fire chief for the fire department;
AND WHEREAS Section 8 (1) of the Municipal Act, 2001, S.D. 2001, c. 25, as
amended, provides that the powers of a municipality under this or any other Act
shall be interpreted broadly so as to confer broad authority on the municipality to
enable the municipality to govern its affairs as it considers appropriate and to
enhance the municipality's ability to respond to municipal issues;
AND WHEREAS pursuant to the said Municipal Act, Section 9 provides that a
municipality has the capacity, rights, powers and privileges of a natural person
for the purpose of exercising its authority under this or any other Act;
AND WHEREAS The Council for the Corporation of the Municipality of
Kincardine deems it expedient to appoint an Administrative Fire Chief for the
Municipality of Kincardine;
AND WHEREAS The Council for The Corporation of the Municipality of
Kincardine deems it advisable to appoint Jamie MacKinnon as the Administrative
Fire Chief for the Municipality of Kincardine effective June 30, 2007;
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That Jamie MacKinnon be appointed as Administrative Fire Chief for the
Corporation of the Municipality of Kincardine effective June 30, 2007.
2. That subject to any limitations prescribed by law or agreed by Council,
Jamie MacKinnon shall hold the position of Administrative Fire Chief
during the pleasure of Council and while holding such position shall be
paid commensurate with the Tripartite Agreement as adopted by By-law
No. 2006-021.
3.
That the position of Administrative Fire Chief shall be subject to all
legitimate personnel related by-laws and policies of the Council of the
Municipality of Kincardine.
4.
That Jamie MacKinnon shall be classified as a regular, full-time employee.

5.
That By-law No. 2003 - 80 be repealed as of June 30,2007. Despite this
repeal, John Wall remains an employee of the Municipality of Kincardine
until his retirement date and as such is entitled to, and shall receive, the
salary benefits to which he was entitled as Administrative Fire Chief.
6. This by-law shall come into full force and take effect upon its final passing.
7. This by-law may be cited as the "Jamie MacKinnon Administrative Fire
Chief Appointment By-law".
READ a FIRST, SECOND, and THIRD time and FINALLY PASSED this 16th day
of May, 2007.
