BY-LAW BY-LAW NO. 1995-65 A BY-LAW TO AUTHORIZE THE SIGNING OF A RENTAL AGREEMENT FOR THE USE OF VIcrüRIA PARK WHEREAS the Council for The Corporation of the Kincardine deems it advisable to enter into rental with Norton International Inc.; Town of agreement NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. That The Corporation of the Town of Kincardine enter into an agreement with Norton International Inc. for the use of Victoria Park. 2. That the mayor and clerk be authorized to sign, on behalf of The Corporation of the Town of Kincardine, the agreement with Norton International Inc. which is attached to this by-law and to affix the Town's Corporate seal as and when required. 3. This its upon by-law shall come into full force and effect final passage. 4. This by-law may be cited as the "Norton Use of Victoria Park Agreement By-law". THE CORPORATION OF THE TOWN OF KINCARDINE hereinafter called the "Town" of the First Part, -and- NORTON IHTERHATIONAL INC. hereinafter called the "Norton" of the Second Part. WBBRBAS the Town deems it expedient to enter into a rental agreement with Norton for the use of Victoria Park. · .. NOW TBEREFORE THIS consideration of the covenants hereinafter as follows: .AGRBBMBNT WITNESSBTH THAT in premises and mutual promises and contained, the parties hereby agree 1. The Town agrees that Norton shall have the use of the ---·-"·eãs~Yone~ñî.rd (1/3) portion õf"Victoria Park for the days of August 10 and August 11, 1996. Norton shall only have the use of the said portion of the park for the purpose of hosting a fine craft show. Norton shall be allowed to charge an admission fee to any persons entering the reserved portion of the park. 2. 3. . 4. 5. · 6. · 7. Norton agrees to dispose of any refuse created by the event in accordance with the Town's by-laws. Norton agrees to erect temporary fencing around the event. Norton shall supply adequate portable toileting facilities for the events participants and patrons. Norton shall pay a rental fee payable to the Town in the amount of $600.00. 8. The rental fee shall be paid to the Town by June 30, 1996. -"9; The Town agrees ta-"lœep its washroom facilities located in the Town Hall open for public use on the days of the event. 10.
