HomeMy WebLinkAboutKIN 95 078 OMB Galbraith Decisi THE CORPORATION OF THE TOWN OF KINCARDINE e BY-LAW BY-LAW NO. 1995-78 - A BY-LAW TO RECOGNIZE THE OMB DECISION REGARDING THE GALBRAITH PROPERTY LOTS 28 & 29, REGISTERED PLAN 61 WHEREAS the Ontario Municipal Board has granted the appeal of the Galbraiths with respect to the rezoning of those lands being Lots 28 & 29, registered Plan 61 in the Town of Kincardine; AND WHEREAS this decision amends the Town's Comprehensive Zoning By-Law 1988-1, as amended; AND WHEREAS it would be expedient to maintain a permanent record of this decision within the Town municipal By-Laws; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1- 2. - 3. THAT the Ontario Municipal Board decision attached as schedule "A" to this By-Law be recognized. A BY-LAW TO AMEND BY-LAW NO. 1988-1, AS AMENDED, BEING THE COMPREHENSIVE ZONING BY -LAW OF THE CORPORATION OF THE TOWN OF KINCARDINE. The council of the Corporation of Ole Town of Kincardine pursuant 10 Section 34 of lite Plamung Act, 1990, ENACTS as follows: 1. By-law No. 1988-1, as amended, being lite Comprehensive Zoning By-law for the Corporation of the Town of Kincardine , is hereby further amended, by adding thefollowing Subsection 5.3.11.8 to Section 5.3 thereof: 5.3.11.8 Notwithstanding their "RJ" zoning designations, those lands described as Lots 28 and 29, Registered Plan 61, in the Town of Kincardine, and delinealed as "RJ-8" may be used in compliance willt Ole "RJ" zone provisions contained in UUs by-law excepting, however. lIta!: (i) The lands shall only be used for row houses and/or selllÎ-detached dwellings; (H) No dwelling unit shall contain more than three (3) bedrooms; (Hi) Parking spaces or areas may be permitted in all yards provided no parking space is located closer than 7.5 metres to any street line or closer than 1.5 metres 10 any side lot line; (iv) Any multiple falllÎly project be subject to Site Plan Control in accordance willt lite provisions of Section 41 of lite Planrling Act, 1990; (v) That lite maximum number of dwelling units shall not exceed Twelve (12); (vi) A minimum play space area of 90 square metres be provided; (vii) A planting strip be provided in accordance willt Section 4.13 of the Comprehensive Zoning By-law No. 1988-1. 2. For the purposes of this by-law, "play space" shall mean a landscaped area lhal is to be provided on site for children's recreational activities, which may include one or more of lhe following facilities: (a) (b) (c) (d) Sand box; Climbing apparatus; Swings; Atltletic fields. 3. Schedule "A" to by-law No. 1988-1, as amended, is hereby further amended by changing lItereon from "RI-l" to "RJ-S", lite zoning designation of Lots 28 and 29, Registered Plan 61, North side of Queen Street, in the Town of Kincardine, as shown oullined in the heaviest black broken line on lite attached Schedule" A". 4. This by-law shall come into force and take effect pursuant to the provisions of the Planning Acl, 1990.
