BY-LAW BY-LAW NO. 1995-19 A BY-LAW TO REGULATE AND GOVERN THE OPERATION OF MOTORIZED SNOW VEHICLES IN THE TOWN OF KINCARDINE e WHEREAS Sections 7 and 14 of the Motorized Snow Vehicle Act, R.S.O., 1990 authorizes the passage of By-Laws to regulate the operation of motorized snow vehicles within municipalities¡ AND WHEREAS it is deemed expedient to regulate the operation of motorized snow vehicles within the Town of Kincardine¡ NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. No person shall operate a motorized snow vehicle, within the limits of the Town of Kincardine, at a greater rate of speed than 20 kilometres per hour. 2. No person shall operate a motorized snow vehicle within the limits of the Town of Kincardine, other than for the purpose of entering, leaving or crossing the Town in the most direct route possible, or for having such vehicle serviced, except when said person has received prior authorization from Council, or in the case of an emergency, has received prior approval from the Ontario provincial Police. e No person shall at anytime operate a motorized snow vehicle on the grounds of any hospital, church, school, nursing/retirement home, public park, athletic field, cemetery, bowling green or on any sidewalk or pedestrian right-of-way. 4. Notwithstanding Clause (2) motorized snow vehicles shall be permitted on trails established and/or affiliated with the ontario Federation of snowmobile Clubs. 3. 5. Every person who contravenes any provisions of this by-law is guilty of an offence and is subject to penalties as prescribed in the provincial Offences R.S.D. 1990, Chapter P.33. this the Act, 6. This by-law shall come into full force and effect upon its final passage. 7. This by-law may be cited as the "Snowmobile By-Law".
