HomeMy WebLinkAboutKIN 95 035 BASWRA Annual Agree - - - e THE CORPORATION OF TH E TOWN OF KI NCARDINE BY-LAW BY-LAW NO. 1995-35 A BY-LAW TO AUTHORIZE THE SIGNING OF AN AGREEMENT WITH THE BRUCE AREA SOLID WASTE RECYCLING ASSOCIATION FOR THE PROVISION OF RECYCLING SERVICES WHEREAS the Council for The Corporation of the Town of Kincardine deems it advisable to enter into an agreement to establish the parameters for the operation of the Bruce Area Solid Waste Recycling Association; NOW THEREFORE the Council for The corporation of the Town of Kincardine ENACTS as follows: 1. That The corporation of the Town of Kincardine enter into an agreement with the Bruce Area Solid Waste Recycling Association to provide recycling service. 2. That the mayor and clerk be authorized to sign, on behalf of The Corporation of the Town of Kincardine, the agreement with the Bruce Area Solid Waste Recycling Association and to affix the Town's Corporate seal as and when required. 3. This by-law shall corne into full force and effect upon its final passage. 4. This by-law may be cited as the "BASWRA Annual Agreement By-law". SCHEDULE "A" TO BY-LAW ASSOCIATION MEMBERSHIP AND ADMINISTRATION AGREEMENT MADE IN TRIPLICATE THIS 2ND DAY OF JANUARY, 1995. BETWEEN: BRUCE AREA SOLID WASTE RECYCLING ASSOCIATION INC. of the Township of Sauqeen, in the County of Bruce, hereinafter referred to as "THE CONTRACTOR", AND: THE CORPORATION OF THE TOWN OF KINCARDINE in the County of BRUCE, hereinafter referred to as "THE MUNICIPALITY", of the SECOND PART: WITNESSETH THAT: . 1. The Contractor, for and in consideration of the assessment for the membership, administration, and collection in the Association, has set a fee of $10.83 per household, for each member municipality, for the period January 2, 1995 to January 1, 1996. 2. The Contractor shall invoice this levy to the Municipality on January 1, May 1, and September 1, 1995. This I evy shall be assessed as per the Unconditional Grants Act household count as determined by the Regional Assessment Office for the Municipality for 1995. 3. This agreement shall be siqned and payment received at the office of the Contractor by the Municipality by the first day of March, 1995. Non-compliance by the Municipality shall result in written notice that the Municipality has sixty days (60), from the date of written notice, to comply with the terms of this agreement. On the sixty-first (61st) day of non-compliance with this agreement, collection service shall cease. 4. Any disputes pertaining to this aqreement shall be settled by resolution of the Board of Directors of the Contractor. . 5. This aqreement shall be bindinq on both Parties for the duration of the term indicated in clause 1 and shall be signed under seal by the duly authorized officers of both Parties. BETWEEN: BRUCE AREA SOLID WASTE RECYCLING ASSOCIATION INC. of the Township of Saugeen, in the County of Bruce, hereinafter referred to as "THE CONTRACTOR", of the FIRST PART; AND: THE CORPORATION OF THE TOWN OF KINCARDINE of the County of Bruce, hereinafter referred to as "THE MUNICIPALITY", of the SECOND PART; WITNESSETH THAT: 1. The Contractor, for and in consideration of the contract price of $10.83 per household, agrees to collect recyclable material, in the Municipality, from Blue Boxes and depot bins at residential households and commercial businesses, for the period from the 2nd day of January, 1995 to the 1st day of January, 1996. 2. The Contractor hereby agrees to the followinq conditions: a) Recyclable materials to be picked up shall include: all food and beverage cans, newspapers and magazines, phone books, white paper, boxboard, coloured and clear glass bottles and jars and plastic containers with screw-on lids. The Contractor has the right to refuse any unacceptable materials. b) Recyclable materials are to be picked up on a bi-weekly schedule as set by the Contractor for all residential Blue Boxes and on an as-required basis for all commercial businesses. Scheduling to be by mutual agreement of both Parties. c) The Contractor shall be responsible transportation, storaqe, processing and marketing of all materials, at no extra cost to the Municipality. for all recyclable d) The Contractor shall invoice the Municipality for services of January 1, May 1, and September 1, 1995, payment shall be made by the 15th day of the following month. e) Any disputes ar1s1nq from this agreement shall be forwarded, by letter, to the next regular committee meeting of the Contractor.
