HomeMy WebLinkAboutKIN 95 046 Annexed Lds Zoning e e e e THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 1995-46 A BY-LAW TO AMEND BY-LAW NO.82-08, AS AMENDED, BEING THE COMPREHENSIVE ZONING BY-LAW OF THE TOWNSHIP OF KINCARDINE AS IT APPLIES TO CERTAIN LANDS RECENTLY ANNEXED BY AND NOW WITHIN THE TOWN OF KINCARDINE WHEREAS Section 34 of the Plannincr Act, R.B.O. 1990, Chapter P.13 authorizes the councils of municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of The corporation of the Town of Kincardine has recently annexed certain lands from The Corporation of the Township of Kincardine; AND WHEREAS the Council of The Corporation of the Town of Kincardine desires to amend By-law No. 82-08, as amended, being the comprehensive of the Township of Kincardine; NOW THEREFORE the Council for The corporation of the Town of Kincardine ENACTS as follows: 1. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law for the Corporation of the Township of Kincardine, as it applies to lands within the Town of Kincardine, is hereby amended by adding the following subsection to Section 10.1 thereof: "10.1.6 (a) Notwithstanding their 'A2' zoning designation, those lands delineated as 'A2-1995-46a'on Schedule 'A' to this By-Law may be used for restrictive agricultural purposes, in accordance with the 'A2' zoning provisions, excepting however that: (i) The minimum lot area shall be 1858 square metres (20000 square feet); (ii) The minimum lot frontage shall be 30.48 metres (100 feet); (iii) A telephone switching station shall be a permitted use; and, ../2 · · · · · e (b) (iv) A telephone switching station shall be defined as a building designed and used for the sole purpose of containing equipment necessary for the operation of a telecommunication system, but shall not include an office as defined in this by-law. Notwithstanding their 'A2' zoning designation, those lands delineated as 'A2-1995-46b' on Schedule 'A' to this By-law may be for restrictive agricultural purposes, in accordance with the 'A' zoning provision, excepting however that: (i) The minimum lot area shall be 34 hectares (84 acres); and, (ii) The minimum lot area shall be calculated as the horizontal area within the lot lines. 2. Schedule 'A' to By-Law No. 11-82, as amended, is hereby further amended by changing thereon from 'A2-Restrictive Agriculture' to 'A2-1995-46a'- Restrictive Agriculture Special' and 'A2-1995-46b'- Restrictive Agriculture Special' the zoning of those lands described as Part Lots 1,2,3, Concession 3 S.D.R., in the Town of Kincardine, which are outlined in the heaviest black broken line of the attached Schedule 'A'. 3. This By-Law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, 1990. 4. This by-law may be cited as the "Annexed Lands Zoning Amendment By-law - Telephone switching station." READ a FIRST and SECOND time this 3rd day of August, 1995.
