HomeMy WebLinkAboutKIN 95 047 Annexed Lds Zoning - e - e THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 1995-47 A BY-LAW TO AMEND BY-LAW NO.82-08, AS AMENDED, BEING THE COMPREHENSIVE ZONING BY-LAW OF THE TOWNSHIP OF KINCARDINE AS IT APPLIES TO CERTAIN LANDS RECENTLY ANNEXED BY AND NOW WITHIN THE TOWN OF KINCARDINE WHEREAS Section 34 of the Plannina Act, R.S.a. 1990, Chapter P.13 authorizes the councils of municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of The Corporation of the Town of Kincardine has recently annexed certain lands from The corporation of the Township of Kincardine; AND WHEREAS the Council of The Corporation of the Town of Kincardine desires to amend By-law No. 82-08, as amended, being the comprehensive of the Township of Kincardine; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law for The Corporation of the Township of Kincardine, as it applies to lands within the Town of Kincardine, is hereby amended by adding the following subsection to Section 10.1 thereof: "10.1.7 (a) Notwithstanding their 'A2' zoing designation, those lands delineated as 'A2-1995-47' on Schedule 'A'to this By-Law may be used for restrictive agricultural purposes, in accordance wi th the ' A2" zoning provisions, excepting however that: (i) The minimum lot area shall be 1.88 hectares (4.65 acres); (ii) The minimum lot area shall be calculated as the horizontal area within the lot lines, and, (iii) A telecommunication tower and ancillary equipment shall be a permitted use. ~ · · · · · e Page 2 2. Schedule 'A' to By-law No. 11-82, as amended, is hereby futher amended by changing theron from 'A2-Restrictive Agriculture' to 'A2-1995-47 -Restrictive Agriculture Special' Part Lots 2 and 3, Concession 3, S.D.R., in the Town of Kincardine, which are outlined in the heaviest black broken line of the attached Schedule 'A'. 3. This by-law shall take effect from the date of final passage by Council and comes into full force and effect pursuant to the provisions of the Plannina Act. 4. This by-law may be cited as the "Annexed Lands Zoning By-Law Amendment - Telecommunications Tower". READ a FIRST and SECOND time this 3rd day of August, 1995.
