THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2007 - 018 BEING A BY-LAW TO PROVIDE FOR THE INTERIM LEVYING OF CHARGES FOR BRUCE MUNICIPAL DRAIN NUMBER 20, MUNICIPALITY OF KINCARDINE WHEREAS the construction of Bruce Municipal Drain Number 20 was authorized by By-law No. 2006 - 015 of the Municipality of Kincardine; AND WHEREAS the contract for Bruce Municipal Drain No. 20 has reached a point of substantial completion; AND WHEREAS it is deemed feasible to buy interim billings for the work completed to date; AND WHEREAS Section 8 (1) of the Municipal Act 2001, S.D. 2001, c. 25, as amended, provides that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues AND WHEREAS pursuant to the said Municipal Act, Section 9 provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; NOW THEREFORE the Council of the Municipality of Kincardine ENACTS as follows: 1. That an interim levy of assessments be made for Bruce Municipal Drain No. 20 in the total amount of $102,202.81. That all assessments shall be payable 30 days after the date of invoicing to landowners. For collecting any amount in arrears, interest will be charged at the rate of 15% per annum and if unpaid will be collected at the same time as other taxes are collected. 2. 3. This by-law may be cited as the "Bruce Drain No. 20 Interim Levy By-law". READ a FIRST and SECOND time this 1ih day of February, 2007.
