THE CORPORA TION OF THE TOWN OF KINCARDINE
BY-LAW
BY-LAW NO. 1996-29
A BY-LAW TO PROVIDE REGULATIONS FOR PRESCRIBING TIMES FOR
SETTING FIRES AND PRECAUTIONS TO BE TAKEN
WHEREAS in accordance with section 210, subsection 35 of the
Municipal Act, R.B.a. 1990, chapter m.45, the municipality
considers it necessary enact regulations to control fires in
the Town of Kincardine;
NOW THEREFORE the Council for The Corporation of the Town of
Kincardine ENACTS as follows:
1. That all of The Corporation of the Town of Kincardine
is hereby designated as a restricted fire area.
2. No person shall set out fire or set fire to any brush,
building, heap or other combustible material in any
field, clearance or place in the designated area where
fire would be likely to spread without first having
obtained a burning permit from the Fire Chief of The
Corporation of the Town of Kincardine and paid the
burning permit fee set out in the "Consolidated Fee
By-Law" .
3.
That the Fire Chief of The Corporation of the Town of
Kincardine or his designate be authorized to issue
burning permits for the Corporation of the Town of
Kincardine in respect to starting fires.
4.
That the Fire Chief or his designate may enter upon any
grounds in the Town of Kincardine for the purpose of
inspection and determination as to whether or not the
provisions of this by-law are being observed.
5. Any person contravening this by-law is guilty of an
offence and a summary conviction for a first offence to
a minimum fine of $25.00 exclusive of costs and for
second and subsequent offence to a minimum fine of
$50.00 exclusive of costs, but not to exceed $300.00.
6. This by-law shall come into full force and effect upon
its final passage.
7. This by-law may be cited as the "Burning permit
By-law" .
READ a FIRST and SECOND time this 4th day of April, 1996.
READ a THIRD time and FINALLY PASSED this 18th day of
April, 1996.
