HomeMy WebLinkAboutKIN 96 060 Rezoning - Stewart - e e e THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW BY-LAW NO. 1996-60 A BY-LAW TO AMEND BY-LAW NO. 82-08, AS AMENDED, BEING THE COMPREHENSIVE ZONING BY-LAW OF THE TOWNSHIP OF KINCARDINE AS IT APPLIES TO CERTAIN LANDS RECENTLY ANNEXED BY AND NOW WITHIN THE TOWN OF KINCARDINE. WHEREAS Section 34 of the Planning Act, R.S.O. 1990, authorizes councils of municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS The Corporation of the Township of Kincardine has enacted By-law No. 82-08, as Amended, being the Comprehensive Zoning By-law of the Township of Kincardine as it applies to certain lands annexed and now being within the Town of Kincardine; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law for The Corporation of the Township of Kincardine, as it applies to lands within the Town of Kincardine, is hereby amended by adding the following subsection to Section 10.1 thereof: 10.1.8a Notwithstanding their "A2" zoning designation, those lands delineated as "A2.96-60 .a" on Schedule "A" to this By-law may be----Used for restrictive agricultural purposes, in accordance with the "A2" zoning provisions, excepting however that: (i) The minimum lot area shall be 1.2 hectares (3.0 acres); (ii) The minimum lot frontage shall be 122 metres (400 feet); and, (iii) The minimum side yard for an accessory structure existing at the date of the passing of this By-law shall be 1.8 metres (6 feet). 10.1.8b Notwithstanding their "A2" zoning designation, those lands delineated as "A2. 96-60 .b" on Schedule "A" to this By-law may be-uBed for restrictive agricultural purposes, in accordance with the "A2" zoning provisions, excepting however that: (i) Residential uses shall be prohibited. . . ./2 · · · - Page 2 By-law 1996-60 Stewart Rezoning By-Law (Annexed Lands) 2. Schedule "A" to By-law No. 11-82, as amended, is hereby further amended by changing thereon from "A2-Restrictive Agricultural" to "A2. 96-60 . a Restrictive Agriculture Special" and "A2.96-60.b Restrictive Agriculture Special" those lands described as Part Lot 2, Lot 3, concession 1, S.D.R., in the Town of Kincardine, which are outlined in the heaviest black broken line of the attached Schedule "A". 3 . This its by-law shall come into full force and effect final passage. upon 4. This by-law may be cited as the "Stewart Rezoning, By-law" . READ a FIRST and SECOND time this 28th day of July, 1996. '<,;j(A.K~_~ that the Council of the Corporation of the Town of Kincardine passed By-law , .:~~n the 15th day of August, 1996 under Section 34 of the Planning Act, 1990. AND TAKE NOTICE that any person or agency may appeal in writing to the Ontario Municipal Board in respect of the By-law by filing with the Clerk of the Town of Kincardine not later than the 26th day of September, 1996 a written notice of appeal setting out the objection to the By-law and the reasons in support of the objection, accompanied by a cheque in the amount of $125.00 payable to the Treasurer of Ontario. Only individuals, corporations and public bodies may appeal the Zoning By-law Amendment to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an indMdual who is a member of the association of the group. An explanation of the purpose and effect of the By-law, describing the lands to which the By-law applies, and a 'Key Map' showing the location of the lands to which the By-law applies, has been provided. Maureen Couture Clerk-Administrator Town of Kincardine 707 Queen Street KINCARDINE, Ontario N2Z1Z9 =============================================================== EXPLANATORY NOTE ZONING BY· LAW NO. 96-60 OF THE CORPORATION OF THE TOWN OF KINCARDINE BEING A BY· LAW TO AMEND BY·LAW NO. 82-08 AS AMENDED, BEING THE ZONING BY-LAW OF THE CORPORATION OF THE TOWNSHIP OF KINCARDINE AS IT APPLIES TO CERTAIN LANDS RECENTLY ANNEXED BY AND NOW WITHIN THE TOWN OF KINCARDINE WAS PASSED UNDER SECTION 34 OF THE PLANNING ACT, 1990. The purpose of By-law No. 96-60 is to change the zoning of a particular property from 'A2 - Restrictive Agriculture" to 'A2-96-60a - Restrictive Agriculture Special', and "A2-96-60b - Restrictive Agriculture Special' , in order to permit the severance ot a surplus farm dwelling lot. The effect of By-law No. 96-60 is as follows: The 'A2.' zoning category generally agricultural activity on lands with a minimum lot frontage of 330 feet and a minimum lot area of 92 acres. The 'A2-96-60a' zoning category has been specifically designed to permit the creation of a 3.0 acre surplus farm dwelling lot wìfira-fflîr'iÎfi10mÎot írUflta9Jut~OOÍb'3:.· - ----- The 'A2-96-60b' zoning category has been specifically designed to restrict any future residential development on the balance of the farm land. The lands affected by By-law No. 96-60 comprise the Part of Lot 2, Lot 3, Concession 1, S.D.R., Town of Kincardine and are shown in more detail on the map on the reverse of this form. '. .. , .
