HomeMy WebLinkAboutKIN 96 062 Sidewalk Display - - - - THE CORPORATION OF THE TOWN OF KINCARDINE ~ð~ 'Y( .Æ>. r-.. ~ .-:-~ '~.. ) ~...~ BY-LAW BY-LAW NO. 1996-62 A BY-LAW TO REGULATE THE USE OF MUNICIPAL SIDEWALKS ON MUNICIPAL ROAD ALLOWANCES IN THE TOWN OF KINCARDINE. WHEREAS Section 314 (1) of the Municipal Act, R.S.O. 1990, chapter m.45, authorizes the council of all municipalities to pass by-laws for the prohibiting or regulating the obstructing, encumbering injuring or fouling of highways or bridges; AND WHEREAS Section 297 (1) (e) of the Municipal Act, R.S.O. 1990, Chapter m.45 authorizes the council of every municipality to pass by-laws for setting apart and laying out such parts as may be considered expedient of any highway for the purpose of carriage ways, boulevards and sidewalks, and for beautifying the same, and making regulations for their protection; AND WHEREAS the Council for The Corporation of the Town of Kincardine wishes to regulate the use of sidewalks in the Town of Kincardine; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. In this by-law: a) "Place of business" shall mean the premises where a business is carried on. b) "Merchant" shall mean a person who, ordinary course of business, in the i) sells tangible personal property; ii) sells or tenders a service, or iii) operates a place of amusement. 2. Merchants may display merchandise and/or advertising devices (e. g. sandwich board signs) from their place of business on the road allowance immediately in front of their place of business under the following conditions: i) the merchandise and/or advertising device is restricted to a maximum width of 76cm (30 in.) and a maximum height of 1.2 metres (4 feet); ii) in all cases where merchandise and/or an advertising device is placed on the sidewalk, a minimum of 127 em. (50 in.) clearance must be maintained on the sidewalk for pedestrian travel; . . . /2 e e e - By-Law 1996-62 Page 2 2. Merchandise and/or advertising devices shall only be displayed on public property if there is insufficient private property in front of the place of business. 4. The display of merchandize and/or advertising devices is permitted in all commercial and industrial zones in the Town of Kincardine. 5. Every person who contravenes any provisions of by-law is guilty of an offence and is subject to penalties as prescribed in the provincial Offences R.S.O. 1990, Chapter P.33. this the Act, 4. By-Law No. 1988-49 passed on the 21st day of July, 1988, and By-Law No. 1996-23, passed on the 4th day of April, 1996, be and the same are hereby repealed. 5.
