THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW
BY-LAW NO. 1996-2
A BY-LAW TO AMEND BY-LAW 1988-1 AS AMENDED, BEING THE
COMPREHENSIVE ZONING BY-LAW OF THE CORPORATION OF THE TOWN
OF KINCARDINE.
WHEREAS Section 34 of the Planning Act,
authorizes councils of municipalities to enact
by-laws which comply with an approved official
R.S.O.
and amend
plan;

AND WHEREAS the Council of The Corporation of the Town of
Kincardine has enacted By-law No. 1988-1 being the
Comprehensive Zoning By-law for the Town of Kincardine;
AND WHEREAS this by-law complies with the Town of Kincardine's
Official Plan;
NOW THEREFORE the Council for The Corporation of the Town of
Kincardine ENACTS as follows;

By-law
amended
parking
No. 1988-1, as amended, is hereby further
by deleting Section 2.61, Definitions,
space, and replacing it with the following:
2.61
"PARKING SPACE" shall mean an area of not less
than 15.1 square metres, having a minimum width
of 2.75 metres and length of 5.5 metres,
exclusive of any aisles, or ingress or egress
lanes, for the temporary parking or storage of
motor vehicles, and any include a private
garage.

By-law No. 1988-1, as amended, is hereby
amended by deleting the last sentence in
4.12.2 and replacing it with the following:

Provided that in the case of dwelling houses
containing four or more dwelling units or a
property zoned C1 "General Commercial" such
parking space and driveway shall be paved with
an asphalt or concrete surface and have all
parking stalls adequately marked and
maintained.

"SHARED USE PARKING" shall mean the provision
of parking spaces that can be used to serve
two or more individual land uses, located on
the same property, without conflict or
encroachment. This concept is based on the
fact that peak parking demands for different
land uses often occur as different times of
the day. Therefore the sum of the parking
requirements in a multi-use development may be
in excess of the maximum number of parking
spaces required.

No. 1998-1, as amended, is hereby further
by adding the following new subsection to
6.5.5. Resort Commercial Special Provisions:
6.5.5.1 Notwithstanding their 'C5' zoning designation,
those lands delineated as 'C5-1' on Schedule
'A' to this By-law may be used for Resort
Commercial purposes, in accordance with the
'C5' zoning provisions, excepting however
that:

1) Permitted uses shall be restricted to a
marina, a marina sales and service
establishment, a restaurant, a gift shop,
convenience store, artisans shop,. a
sports and beach wear shop, a parking
lot, and uses accessory to a permitted
use.
Schedule "A" to By-law No. 1998-1, as amended, is
hereby further amended in accordance with Schedule "A"
attached hereto and forming part of this By-law.

7. This By-law shall come into full force and effect
pursuant to the provisions of the Planning Act, R.S.O.
1990."
8. This by-law may be cited as the "Zoning Amendment
By-law NO.7".
READ a FIRST and SECOND time this 20th day of July, 1995.
READ a THIRD time and FINALLY PASSED this 4th day of January,
1996 .
