HomeMy WebLinkAboutKIN 96 004 Amend No. 88 01 Zone e e e e THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 1996-4 A BY-LAW TO AMEND BY-LAW 1988-1, AS AMENDED, BEING THE COMPREHENSIVE ZONING BY-LAW OF THE CORPORATION OF THE TOWN OF KINCARDINE WHEREAS Section 34 of the Planning Act, authorizes councils of municipalities to enact by-laws which comply with an approved official R.S.O. and amend plan; 1990, zoning AND WHEREAS the Council of The Corporation of the Town of Kincardine has enacted By-law No. 1988-1 being the Comprehensive Zoning By-law for the Town of Kincardine; AND WHEREAS this by-law complies with the Town of Kincardine's Official Plan; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows; 1. By-law No. by adding re-numbering accordingly: 1988-1, as amended, is hereby further amended following definition to Section 2, and all subsequent definitions in Section 2, "2.67 Retail Warehousincr shall mean a building or structure or portion thereof having a minimum of 1900 square feet, wherein goods, wares, or merchandise are offered for sale at retail, but shall not include a food store or other retail uses defined herein." 2. By-Law No. 1988-1, as amended, is hereby further amended by deleting the Section 3.1.1 and replacing it with the following: "3.1.1 Holdincr ('h') Zone Where any of the zone symbols described in Section 3.1 above are preceded by the Holding classification 'h', the removal of the Holding Classification and the use of the land in accordance with Section H12 of the Town of Kincardine Official Plan. In the interim, before the Holding classification is removed, no person shall use any land, building or structure for any purpose except those uses, buildings or structures which legally existed on the date of the passing of the By-law." e e e e Page 2 By-law No. 1996-4 3 . By-law No. 1988-1, as amended, is by adding the following to the Section 4.18, Yard Encroachments: hereby further amended fourth paragraph of "provided that a minimum 1 metre yard setback is maintained." 4. By-law No. by adding identified 1988-1, as amended, is hereby the following zone to the in Section 3.1, Classification further amended list of zones of Zones: "M2 Prestige Industrial" 5. By-law No. 1988-1, as amended, is hereby further amended by deleting the title of Section 7, plus the first paragraph of that Section and replacing is with the following: "SECTION 7 - INDUSTRIAL ZONES - MI, M2 In any Industrial M1, M2 Zones, no person shall use any building, structure or land nor erect any building or structure except in accordance with the following provisions." 6. By-law No. 1988-1, as amended, is hereby further amended by adding the following new subsection to Section 7, Industrial Zones: "7.2 PRESTIGE INDUSTRIAL "M2" 7.2.1 Permitted Uses A business or professional office A retail warehouse A public utility A research & development facility A computer & electronic processing establishment A scientific or technological establishment A business or government service A recreation facility or oriented to fitness A kennel A Veterinary Clinic A private education and/or training centre An automotive repair shop A cartage, express or truck transport terminal A contractor's or tradesman's shop A dry-cleaning establishment A fabricating plant A fuel storage tank or supply yard A laundry shop A manufacturing plant A municipal service garage, warehouse or storage yard A parking lot A printing or publishing plant A retail outlet, a wholesale outlet or a business office accessory to a permitted use A service shop A warehouse and lor commercial storage A manufacturing, servicing, or repair of marine and boating equipment A banquet hall or club house A accessory use e e e e Page 3 By-law No. 1996-4 7.2.2 Zone Recrulations for presticre Industrial 1) Lot Area (Minimum) 1850 square metres 2) Lot Width (Minimum) 30.0 metres 3) Front Yard (Minimum) 9.0 metres 4) Exterior Side Yard (Minimum) 9.0 metres 5) Interior Side Yard (Minimum) i) When not abutting a Residential Zone 3.0 metres ii) When abutting Residential Zone 6.0 metres 6) Rear Yard (Minimum) 7.5 metres 7) Buildincr Heicrht (Minimum) 15.0 metres 8) Open Storacre - The open storage of goods or materials shall be permitted only to the rear of the main building and provided that: i) Such open storage is accessory to the use of the main building on the lot line; Such open storage complies with the side yard requirements of this Section, and is located no closer than 3.0 metres to the rear lot line; Such open storage does not cover more than 15% of the lot area nor exceed the gross floor area of the main building on the lot; and, Any portion of the area used for open storage where it does not adjoin the outside wall of of the building is concealed from view from the street by a fence or wall. ii) iii) iv) 9) Plantincr Strips- (Refer to to Section 4.13) Loadincr Space- (Refer to Section 4.10) Off-Street parkincr (Refer to Section 4.12) 10) ll) 7.2.3 Zone Recrulations for Marine Sales & Service Establishments. This by-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 9. This by-law may be cited as the "Zoning Amendment By-law NO.8". READ a FIRST and SECOND time,this 20th day of July, 1995.
