THE CORPORATION OF THE TOWN OF KINCARDINE 4~~ ,(O~ "'Xð;~ ìl~. !~\ --#\' -.~..~o~:a- !) .........%. ß: ..... /.:'" "~ BY-LAW BY-LAW NO. 1996-87 A BY-LAW TO AMEND BY-LAW NO. 1, 2, AND 3, PLAN 347. 1988-1 IN ORDER TO REZONE LOTS WHEREAS Section 34 of the Planninq Act, R.S.O. 1990, Chapter P.13 authorizes the councils of municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of The Kincardine has enacted By-law No. enacted under Section 34 of the said Corporation of the 1988-1, a zoning Planninq Act; Town of by-law AND WHEREAS the Council of The Corporation of the Town of Kincardine desires to amend By-law No. 1988-1; AND WHEREAS this By-law complies with the Kincardine's Official Plan which was approved by the of Municipal Affairs on January 31, 1989; Town of Ministry NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. By-Law No. 1988-1, as amended, being the Comprehensive Zoning By-law for The Corporation of the Town of Kincardine, ~s hereby further amended by adding the following subsection to Section 5.1.4 thereof: 5.1.4.16a) Notwithstanding their "Rl-5" zoning designation, those lands described as Part of Lots 2 and 3, Plan 347, Town of Kincardine, and delineated as "Rl-5-2a-h" on Schedule "A" to this By-law, may be used for residential purposes in compliance with the "Rl-5" zone provisions contained in this By-law, excepting however that: i) the "minimum lot area" shall be 269 square metres (2900 square feet) ; the "minimum front yard" shall be 1.5 metres (4.9 feet); the "minimum lot depth" shall be 14.3 metres (47 feet); the "minimum rear yard" shall be 6.7 metres (21.6 feet); "Lot Area" shall be defined as the total horizontal area within the lot lines of a lot; and public water supply and sanitary sewers shall be required. ii) iii) iv) v) vi) .. ./2 . ~ . , ~~ '- Page 2 5.1.416 b) Notwithstanding their "Rl-5" zoning designation, those lands described as Part of Lots 1 and 2, Plan 347, Town of Kincardine, and delineated as "Rl-5-2b-h" on Schedule "A" to this By-law, may be used for residential purposes in compliance with the "Rl-5" zone provisions contained in this By-law, excepting however that: i) the "minimum exterior side yard" shall be 1.5 metres (4.9 feet); ii) the "minimum lot depth" shall be 14.3 metres (47 feet); iii) the "minimum rear yard" shall be 6.7 metres (21.6 feet); iv) "Lot Area" shall be defined as the total horizontal area within the lot lines of a lot; and v) public water supply and sanitary sewers shall be required. 2 . Schedule "A" to By-law 1988-1, as amended, is hereby further amended by changing thereon from "Rl-5" to "Rl-5-2a-h" and "Rl-5-2b-h" the zoning designation of those lands described as Part of Lots 1, 2, 3, Plan 347, Town of Kincardine, which are outlined in the heaviest black broken line of the attached Schedule "All. 3. This by-law shall take effect from the date of passage by Council and comes into full force and pursuant to the provisions of the Planninq Act. final effect 4. This by-law may be cited as the "Webb Re-Zoning By-law" . READ a FIRST and SECOND time this 3rd day of October, 1996.
