THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2006 - 289
BEING A BY-LAW TO CLOSE PART OF THE PUBLIC HIGHWAY
KNOWN AS MAHOOD-JOHNSTON DRIVE, MUNICIPALITY OF
KINCARDINE, FORMER TOWN OF KINCARDINE, COUNTY OF
BRUCE, TO PUBLIC TRAVEL
WHEREAS the Municipal Act, 2001, S.D. 2001, c. 25, as amended, "The Act"
provides as follows:
1. A lower tier Municipality may pass by-laws in respect of a highway
over which it has jurisdiction (s.27(1)).
2. Before passing a by-law for permanently closing a highway a
Municipality shall give public notice of its intention to pass the by-
law (s.34(1 )).
3. A Municipality may pass by-laws prescribing the form and manner
of giving notice required by the Act(s. 251).
AND WHEREAS the street known as Mahood-Johnston Drive was established
as a public highway by By-law No. 1990 - 38 of the Town of Kincardine
registered as Instrument No. 268919 on July 9, 1990;
AND WHEREAS the Municipality of Kincardine has notified the public of its
intention to permanently close to public travel, part of the public highway known
as Mahood-Johnston Drive and located at Part of Lots A, Band C, Concession A
(former Town of Kincardine), designated as part of Part 2 on Plan 3R-4985,
Town of Kincardine, Municipality of Kincardine, County of Bruce.
AND WHEREAS no one appeared or otherwise notified the Council of the
Municipality of Kincardine of any reason why the said street should not be closed
permanently to public travel.
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That part of the street known as Mahood-Johnston Drive and located at
Part of Lots A, Band C, Concession A (former Town of Kincardine),
designated as Part of Part 2 on Plan 3R-4985, in the Geographic Town of
Kincardine, Municipality of Kincardine, County of Bruce be permanently
closed to public travel.
2. This By-law shall come into full force and effect upon its final passage.

3. ' This By-law may be cited as the "Mahood-Johnston Drive Road Closing
By-law" .
READ a FIRST, SECOND and THIRD TIME and FINALLY PASSED this 18th
day of October 2006.
