THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2006 - 279
BEING A BY-LAW TO ACCEPT AN OFFER TO PURCHASE AND
AUTHORIZE THE SALE OF LAND TO KND INVESTMENT CORP.
(Plan 3M-98, Blocks B & K and Part 1, Plan 3R-4529, former Town of
Kincardine, now Municipality of Kincardine, County of Bruce)
WHEREAS Section 268 of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended, provides for procedures for the sale of lands declared surplus by
municipalities;
AND WHEREAS the Municipality of Kincardine, on September 17, 2003 passed
By-law No. 2003-133, being a by-law to establish procedures regarding the sale
of real property;
AND WHEREAS the Municipality of Kincardine, on September 13, 2006,
declared as surplus to its needs those lands described as Plan 3M-98, Blocks B
& K and Part 1, Plan 3R-4529, former Town of Kincardine, now the Municipality
of Kincardine in the County of Bruce;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine
deems it advisable to dispose of the aforementioned lands;
AND WHEREAS KND Investment Corp. has submitted an Offer to Purchase the
aforementioned lands in the amount of $7,000.00;
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the Mayor and C.A.O. be authorized and directed to execute such
documents, on behalf of The Corporation of the Municipality of Kincardine,
as they may deem advisable to convey the lands described as Plan 3M-
98, Blocks B & K and Part 1, Plan 3R-4529, former Town of Kincardine,
now Municipality of Kincardine in the County of Bruce, to KND Investment
Corp.
2. That this transaction is subject to the conditions set out in the Offer to
Purchase attached hereto as Schedule "A" to this By-law and that KND
Investment Corp. is responsible for all associated costs to complete this
land transaction.
3.
The sale price for the said lands shall be seven thousand dollars
($7,000.00).

5. This By-law may be cited as the "KND Investment Corp. Land Sale By-
law".

Please accept this letter as KND Investment Corp.'s ("KND") proposal to purchase the lands, planned
to be deemed surplus by Municipality of Kincardine Council on September 13, 2006 and described as:
Plan 3M-98. Blocks B&K and ParI 1 Plan 3R4529.

As council may be aware, KND has entered into a firm purchase and sale agreement to acquire 700
Kincardine Avenue (assumed). Please see Figure 1 attached hereto for a map outlining the positions of 700
Kincardine Avenue and the Surplus Lands.
On August 24, 2006, KND submitted an Official Plan Amendment and Zoning By-law Amendment and
has been assigned File No.: KlNOPA # 12-06.22 and Z-216-06.22. We have applied to amend the Permitted
Use from Highway Commercial (Vacant) to Institutional.

Our intended use for the Surplus Lands as described above is:
1. to allow for closer access to Kincardine Avenue for the Institutional Use for better service to the
community,
2. greater security for the Institutional Use, and
3. enhanced visibility to and from Kincardine Avenue to the Institutional Use.
Please see Figure 2 attached hereto for KND's proposed Site Plan incorporating the Surplus Lands.
