HomeMy WebLinkAboutKIN 97 060 Reg-Taxi Vehcls Hire / I / / e· e e - THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW BY-LAW NO. 1997-60 BEING A BY-LAW TO LICENSE, REGULATE AND GOVERN OWNERS AND DRIVERS OF TAXICABS AND OTHER VEHICLES REGULARLY USED FOR HIRE FOR THE CONVEYANCE OF PASSENGERS IN AND ABOUT THE TOWN OF KINCARDINE. WHEREAS Section 232 of the Municipal Act, R.S.O. 1990, chapter M.45, as amended, authorizes councils of towns to pass by-laws for licensing, regulating and governing the owners and drivers of cabs and other vehicles used for hire, for revoking and cancelling licenses so granted and for establishing the rates or fares to be charged by the owners or drivers of such vehicles. AND WHEREAS the Municipal Council of the Corporation of the Town of Kincardine deems it desirable to establish a by-law to license, regulate and govern the owners and drivers of cabs and other vehicles used for hire and for revoking and cancelling licenses so granted; NOW T~REFORE the Municipal Council of the Corporation of the Town of Kincardine ENACTS AS FOLLOWS: SECTION 1: Definitions 1.1 "Board" shall mean the Kincardine Police Services Board. 1.2 "Staff Sergeant" shall mean the Staff designee, Ontario Provincial Police, Detachment. Sergeant or Kincardine 1.3 "Driver" shall mean anr person licensed according to this by-law who ~s the holder of a valid Ontario Driver's Licence. 1.4 "Fare" shall mean the fee a person has to pay to be conveyed by taxicab or limousine and also means a person travelling or being conveyed by taxicab or limousine for a fee. 1.5 "License" shall mean a permit granted under this by-law by the Town of Kincardine under provisions of this by-law to own or operate any vehicle used for hire. .../2 - By-law No. 1997-60 Taxi Licensing Page 2 Definitions Cont'd e 1.6 "Limousine" shall mean a motor vehicle which does not bear any identification other than the number plate issued by the Ministry of Transportation for the Province of Ontario which does not have a taximeter and which is kept or used for hire for the conveyance of passengers wholly within the Town of Kincardine limits or to any point not more than five (5) kilometers beyond its limits but shall not include a taxicab. 1.7 "Owner" means any person owning a taxicab or limousine or having possession or control thereof under an instalment purchase agreement or by way of rental who is licensed as such or required as such under this by-law. e 1.8 "Passenger" shall mean in addition to its common meaning where used in context throughout this by-law, shall also mean a person travelling in a taxicab or limousine who is not paying a fare. 1.9 "Safety Standard Certificate of Mechanical Fitness" shall mean for the purposes of this by-law a Safety Standards Certificate of Mechanical Fitness is a certificate issued by a registered motor vehicle inspection station pursuant to the provisions of the Ontario Highway Traffic Act. 1.10 "Taxi Broker" shall mean any person or corporate entity who accepts calls in any manner for taxicabs used for hire and which are owned or driven by persons other than the broker. - 1.11 "Taxicab" shall mean any passenger motor vehicle regularly used for hire for the conveyance of persons wholly within the Town of Kincardine limits, having a normal seating capacity of not more than nine persons, but shall not include a public vehicle as defined in the Public Vehicles Act, R.S.O. 1990, chapter P. 54 and amendments thereto. 1.12 "Town" shall mean The Corporation of the Town of Kincardine. SECTION 2: Duties of the Staff Serqeant The staff Sergeant shall have supervision over all of the persons and vehicles licensed under this by-law together with equipment used by them. The following shall be the duties in connection with the provisions of this by-law: e 2.1 To consider all applications for licenses and where provided by this by-law, to recommend to Council the issuance of licenses. The Staff Sergeant shall submit a report to the Town and/or Police Services Board pursuant to the performance of these duties under this by-law whenever he shall be required to do so. Such report to include applications, approvals, denials, licenses and notices of revocation of any license. .../3 By-law No. 1997-60 Taxi Licensing Page 3 e Duties of Staff SerQeant Cont'd 2.2 To make all necessary inquiries concerning applications for licenses, renewals and transfers as may be required to secure a due observance of the law and of this by-law. 2.3 To make all qualifications for licenses. necessary inquiries concerning the of persons submitting applications 2.4 time to time, every necessary equipment of such taxicab or To examine and approve from taxicab, limousine and the thereof and the conditions limousine and equipment. 2.5 To receive the fees payable for all licenses and to transfer such fees to the Town Treasurer. e 2.6 To keep a register of all licenses which shall contain the name and addresses of the applicants for taxi licenses and the amount paid for the licence, the date of issue of license and such further records as the Town and/or Board may require. 2.7 To ascertain by inspection and inquiry from time to time and as often as may be required by the Board and/or Town whether any person receiving a license continues to comply with the provisions of the law and of this by-law. 2.8 To prosecute all persons who shall offend against any of the provisions of this by-law. 2.9 To furnish each person taking out a license one copy of this by-law. 2.10 The Staff Sergeant may delegate any act or duty authorized by this by-law. SECTION 3: Licenses e 3.1 The owner of a single taxicab or limousine who is also the sole driver of the vehicle, shall not use or operate the same or permit the same to be used or operated without a current valid license from the Town and such owner prior to obtaining his license shall complete and submit an application as set out in Schedule "C" of this by-law and pay such fee therefore as set out in the Consolidated Fee By-law. 3.2 No person shall drive or act as a driver of any taxicab or limousine for any licensed taxi broker without first obtaining a license from the Town by way of an application a set out in Schedule "B" of this by-law and the fee for such license, shall be as set out in the Consolidated Fee By-law. e 3.3 Every owner of one or more than one taxicab or limousine required to be licensed under this by-law shall complete an application for a separate license for each vehicle as set out in Schedule "A" of this by-law. The fee for each vehicle is as set out in the Consolidated Fee By-law. .../4 - By-law No. 1997-60 Taxi Licensing Page 4 e Licenses Cont'd 3.4 No person shall carry on the business as Taxi Broker without having a current valid license from the Town; an application for such license is as set out in Schedule "D" and the fee for which is set out in the Consolidated Fee By-law; said license shall at all times be prominently displayed at the place of business of the taxi broker. 3.5 No licensed owner incorporated under the laws of the Province of Ontario or any other jurisdiction shall permit the transfer of shares which would have the effect of changing control of The Corporation without the approval of the Town. 3.6 Any transfer of a license, replacement of a vehicle, issued shall be considered the issuance excluding the under this by-law of a new license. e 3.7 The person in whose name a license is applied for and taken out for a vehicle shall be considered the owner of the same for the purposes of this by-law and shall be liable for the penalties herein described. 3.8 No owner of a taxicab or limousine licensed under this by-law shall use or permit the use of any number plate upon any taxicab or limousine other than the plates issued by the Ministry of Transportation of Ontario for such vehicle. 3.9 Each license issued under this by-law shall be for the calendar year or part thereof and shall expire December 31st. . 3.10 Applicants for licenses under this by-law shall be required to sign a waiver of disclosure of police records check and driver record history to allow the OPP to conduct the necessary investigations under this by-law. The Staff Sergeant is authorized to disclose this information to the Police Services Board or the Town, as required. 3.11 All applicants, if requested,by the Staff Sergeant, shall provide fingerprints which will be submitted to the RCMP for examination. Such fingerprints may be kept on file at the discretion of the OPP and/or RCMP. 3.12 The Staff Sergeant shall only issue a maximum of three (3) owner licenses to be in force at anyone time in the Town of Kincardine. SECTION 4: Oualifications for License -- 4.1 Every applicant shall submit with his application a current safety standard certificate of mechanical fitness with respect to any vehicle to be licensed, certifying the said vehicle is in satisfactory condition of mechanical repair and suitable for use as a taxicab or limousine. 4.2 No person shall grant or hold a taxicab license unless the applicant establishes and maintains in effect proof of insurance covering each vehicle in respect of which a license is applied for or held by such applicant. Proof of insurance requirement shall be made by depositing with the Staff .../5 By-law No. 1997-60 Taxi Licensing Page 5 e Qualifications for License Cont'd 4.2 cont'd Sergeant a copy of a current valid policy of insurance issued by a company authorized to do business in Ontario. Such insurance shall apply to the vehicle or vehicles in respect of which the license is sought, and shall indemnify and protect the owner and the public, including passengers carried in such vehicle or vehicles of $1,000,000.00 legal liability for bodily injury or death of any person or damage to property. The required policy of insurance shall be endorsed with the condition that neither the insurer nor the insured shall cancel the policy unless thirty (30) days prior notice in writing is delivered to the Staff Sergeant. e 4.3 The OPP will issue a photo drivers identification card to each licensed driver and this i.d. card is to be carried by the driver whenever he is in operation of a taxicab or limousine and must be presented to any Peace Officer for the Province of Ontario together with a valid Province of Ontario driver's license when requested to do so. 4.4 The license of an owner, driver or broker may be declared forfeited if the person has been convicted of any offence under this by-law, or an offence under the Criminal Code of Canada, the Liquor Licence Act and/or the Highway Traffic Act of the Province of Ontario. 4.5 No person shall be granted a taxi driver's license unless he is the holder of a valid Class G or equivalent license for the Province of Ontario and is of the age of majority. e 4.6 No person or company shall be licensed as an owner of a taxicab or limousine unless registered with and licensed by the Ontario Ministry of Transportation as the owner or licensee. 4.7 Every person licensed as a broker will: 4.7.1 Prepare a list of the names of the owner or owners operating taxicabs or limousines in association with such broker and the number of taxicabs or limousines operated by such owner or owners, and; 4.7.2 The names of all drivers operating in association with such broker. e 4.7.3 All records regarding calls and dispatch particulars shall be made available to the Staff Sergeant upon written request. 4.7.4 Ensure that all vehicles and drivers are properly licensed under this by-law. 4.8 A leased vehicle that is permitted to be used as a taxicab must be leased for a minimum of one (1) year in duration. This license will not be transferrable among leased vehicles without written permission from the Staff Sergeant. .../6 By-law No. 1997-60 Taxi Licensing Page 6 e SECTION 5: EQuiÐment and Its uses 5.l Every owner shall have affixed to each taxicab, in respect to which such owner is licensed, a taxi meter which shall register the total distance (km/mi) driven, paid miles driven, trips, units, compute fares to be paid according to distance and time, showing the resulting total amount and having a manually operated counter for extras, to indicate the extra amount to be paid for a trip separately. Taxi meters must be positioned, in the taxicab, so that they may be, at all times, easily read by the customer. e 5.2 Every owner shall produce, upon renewal of his licences, a certificate showing that each meter used in his taxicab has been inspected, calibrated, tested and sealed. Every taxi meter shall be adjusted based on the rates set out in the Consolidated Fee By-law. The O.P.P. may, at its discretion, conduct a distance test on the meter at time of renewal and, if satisfied that the meter is in proper operating condition, may waive the requirement for the calibration certificate. 5.3 Any owner using an unsealed meter shall automatically suspended and/or revoked. or defective taxi have its license e 5.4 In an emergency, the Staff Sergeant may authorize an owner to operate a taxicab without a meter for a period of 48 hours. 5.5 No person licensed under this by-law shall carry or permit to be carried in any vehicle, a load in excess of that for which the commercial motor vehicle permit was issued as stated upon the permit. 5.6 No person licensed under this by-law shall carry in any vehicle a greater number of occupants or persons including the driver than the manufacturer's rating of seating capacity as such, and every vehicle licensed under this by-law shall be a model having at least four doors (exception of vans must have at least 3 doors). 5.7 No person shall use or operate a taxicab unless the same has affixed on the exterior thereof the word "TAXI" in letters large enough to be clearly visible to the public on a sign permanently mounted on the roof capable of illumination, and lighted at the same time as headlights are required to be lighted under the Highway Traffic Act. 5.8 The operator responsible to vehicle is in at all times. of a taxicab or limousine shall be ensure that the interior of his clean condition and in good repair - 5.9 The operator of a taxicab shall display in a prominent location within the taxicab in clear view of the passengers the rates or fares charged by the operator for the use of the taxicab. .../7 e By-law No. 1997-60 Taxi Licensing Page 7 EquiÐment and its uses Cont'd 5.10 The Town may, from time to time, by by-law the number of taxicabs and limousines for licenses may be issued under this by-law. limit which SECTION 6: InsÐection of Vehicle 6.1 Before a license authorizing the use of any vehicle is granted, the Staff Sergeant shall ascertain by the production of a valid Safety Standard Certificate of Mechanical Fitness, if such vehicle is in a safe condition to be operated upon a highway and such certificate must be dated no longer than thirty (30) days before the application for the license is submitted. In the event the vehicle is in a dangerous or unsafe condition, the Staff Sergeant shall require that such vehicle be placed in a safe condition before a license is issued. A vehicle is EXEMPT from the Safety Standard Certificate of mechanical Fitness which has travelled less than TWENTY THOUSAND (20,000) Kilometers or no more than 12 months has elapsed from date of first registration as a new motor vehicle. e SECTION 7: ResÐonsibi1ities of Taxicab Owner/Driver or Broker 7.1 Every person licensed as a taxicab owner/driver or broker shall: 7.1.1 e 7.1.2. 7.1.3 e 7.1.4 Keep a record of calls answered by vehicles licensed by him showing date, time, origin, destination, vehicle license number and driver; records to be kept in an orderly manner for a period of twelve (12) months and open for inspection by the Staff Sergeant. Submit his vehicle for examination prior to a license being issued for the same and following completion of each year period thereafter, or any other time as required by the Staff Sergeant. Safety Standard Certificates of mechanical fitness will be required annually at time of license renewal and such certificate must be dated no longer than thirty (30) days before the application for the license is submitted. Upon disposing of or replacing any vehicle licensed under this by-law, within one week, attend at the Kincardine opp Detachment Office and return said license or where a replacement vehicle license is being sought shall have such change made to the license in the presence of OPP Detachment staff. Before employing a taxicab driver, notify the Staff Sergeant of the proposed employee, who shall be required to obtain a driver license from the O.P.P. as prescribed in this By-law; and when said driver leaves his employ; notify the opp - Kincardine Detachment. . . . /8 By-law No. 1997-60 Taxi Licensing Page 8 e ResÐonsibi1ities of Owner/Driver Cont'd 7.1.5 Require that drivers employed by him have been approved by the company providing the insurance coverage. 7.1.6 Require drivers by-law. that persons engaged as taxicab are properly licensed under this SECTION 8: ResÐonsibilities of a Driver 8.1 Every Person to be licensed as a taxicab driver shall complete an application for a taxi cab driver's license as shown in Schedule "B" of this by-law. 8.2 Every person licensed as a driver under this by-law shall keep a daily record (herein referred to as a trip record) of all trips made by him and such record shall contain the following information: e 8.2.1 The provincial motor vehicle license number of the taxicab or limousine and the number of the taxicab or limousine owner's license issued under the provisions of this by-law. 8.2.2 The name, address and identification number of the driver. 8.2.3 The amount of fare for each trip. 8.2.4 The date, time, origin and destination of each trip. 8.3 Every driver who drives a taxicab or limousine of which he is not the owner, shall at the end of each day's tour of duty, deliver to the owner a copy of the said daily record. e 8.4 Every person licensed as a taxicab driver under this by-law shall: 8.4.1 Carry their driver's identification as issued by the opp at all times operating a taxicab or limousine. card when 8.4.2 Upon request of any police officer, provide full information as to passengers carried. 8.4.3 Shall supply his name when requested to do so by any passenger. 8.4.4 While on duty, be neat and clean in his person. e 8.4.5 Punctually keep all appointments and engagements and while on duty unless his taxicab or limousine has been previously engaged, serve at any place within the Town at any specified time, whether by day or night, any person who may lawfully require a taxicab or limousine, and he shall not neglect to fulfil his appointment or engagement, except for reasons beyond his control. .../9 By-law N60 1997- Taxi Licensing Page 9 e ResÐonsibilities of a Driver Cont'd 8.4.6 Take due care of all property delivered or entrusted to him and accepted by him for conveyance or safekeeping and immediately upon termination of any hiring or engagement, shall search his taxicab for any property lost or left therein and all money or property left in his taxicab or limousine shall be forthwith delivered to the person owning same, or if the owner cannot be found at once, then to an officer in charge at the Kincardine Provincial Police headquarters with all information in his possession regarding same. e 8.4.7 Travel by the most direct route to the point of destination unless otherwise directed by the person engaging the taxicab or limousine. 8.4.8 When called upon to do so, assist any police officer by conveying in his taxicab to a hospital or elsewhere as may be required, any person who has been wounded or who has met with an accident or been taken suddenly ill (provided such illness is not of an infectious nature) and shall be entitled to the fare on charge. 8.4.9 Search his vehicle at the beginning and termination his/her tour of duty for any alcoholic beverages, drugs or other illegal goods. 8.5 No driver licensed under this by-law shall: 8.5.1 Solicit any person to take or use taxicab or limousine by calling out shouting. Obstruct the use of any sidewalk or make any loud noises, disturbances or use abusive language or molest, annoy or insult any person whatsoever. e 8.5.5 8.5.4 Carry in any taxicab a greater number of persons than such vehicle is intended to seat according to manufacturer's rating or than specified in this by-law. In no case shall the driver be permitted to work more than sixteen (16) hours in any twenty-four (24) consecutive hours. 8.5.8 8.5.10 Any licensed person operating a taxicab may carry two or more "unrelated fares", from a common starting point to two or more destinations subject to the following regulations: (i) each stop to discharge a passenger shall be deemed to be the end of one trip and the commencement of a new trip; (ii) Limousines may not carry "unrelated fares" except on a time basis. 8.5.11 No licensed person shall pick up enroute any additional passenger after such vehicle has departed with one or more passengers from any starting point, unless the person who originally engages the vehicle desires same. Any persons employing a taxicab or limousine may require the driver thereof to furnish them with a receipt for charges made and paid, and drivers shall promptly furnish such receipt upon request, together with their name, address of the cab company and license number of the cab or limousine. ., ./11 e By-law N6060 1997- Taxi Licensing Page 11 SECTION 9: SusÐension or Revocation 9.l The Staff Sergeant may suspend a license, to take effect immediately where the licensee has been charged with any breach of the by-law or any statute referred to in Section 4.4 hereof, and for such period of time as he shall determine or if the circumstances appear to warrant such action, may revoke such license. Any person whose license is suspended or revoked by the Staff Sergeant or his designate may appeal to the Board. 9.2 The Staff Sergeant or any interested party may apply to the Board to have a license revoked for cause. Cause shall mean conviction of any breach of the by-law or any breach of the statutes referred to in Section 4.4. hereof. At a hearing before the Board where the suspension or revocation of a license is being considered, the holder of that license shall be given a least five (5) days notice by registered mail or delivered to his address last known to the Kincardine OPP, of the date, time and place of the hearing and the holder of the license shall be permitted either by himself or a representative, to appear before the Board to show cause why such license should not be suspended or revoked as the case may be. 9.4 In the event of any license issued under this by-law being cancelled or revoked, the previous holder thereof shall not, without approval of the Board, apply for another license before the lapse of six (6) months from the date of such cancellation or revocation. All licenses issued pursuant to this by-law, shall be in force for a period of one year or part thereof, unless they are sooner cancelled or revoked and in any case shall expire in each year at midnight December 31st. 9.6 A license issued pursuant to the by-law, which is not renewed for the next consecutive period, shall not thereafter be renewed and the previous license holder shall be required to submit a new application. 9.3 e 9.5 - SECTION 10: Penalties 10.1 10.2 e Any person who contravenes the provisions of this by-law is guilty of an offence and upon conviction is subject to the penalty set out in the provincial Offences Act, R.S.O. 1990, Chapter P.33, as amended. Any licensed owner of a taxicab or limousine that is involved in any contravention of this by-law is equally and separately guilty of the offence and upon conviction is subject to the penalty as set out in the Provincial Offenses Act R.S.O. 1990, Chapter P.33, as amended. .../12 e e - - By-law No. 1997-60 Taxi Licensing Page 12 Penalties Cont'd 10.3 Any taxi broker licensed under this by-law is equally and separately accountable for any contravention of this by-law committed by any licensed driver while assigned to them and upon conviction is subject to the penalty as set out in the Provincial Offenses Act R.S.O. 1990, Chapter P.33, as amended. SECTION 11: Gender and Number 11.1 Any reference herein to the male gender shall be construed to include the female gender as well, and any reference to singular or plural shall also be interpreted as the opposite number where the context so requires. SECTION 12: Bv-laws ReÐealed By-law #2232, as amended, be and the same is hereby repealed. SECTION 13: ExistinQ Licenses 12.1 13.1 All those taxicab owners and/or operators and limousine owners that hold valid taxi licenses as of the passage of this by-law shall be allowed to apply the license fee paid in 1997 for said existing license against any and all fees required under this by-law so as to arrive at a reduced fee when they apply for a new license under the requirements of the by-law. This application provision in no way reduces or eliminates these existing license holders from complying with all applicable rates and regulations of this by-law once it comes into full force and effect. 14.00 This by-law shall come into full force and effect upon its final passage. 15.00 This by-law may be cited as the "Kincardine Taxi By-law" .
