THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2006 - 267
BEING A BY-lAW TO ACCEPT A TENDER FOR PHASE 2 RECREATIONAL
IMPROVEMENTS TO REUNION PARK, MUNICIPALITY OF KINCARDINE
(Bomar landscaping Inc.)
WHEREAS Section 11 (2) of the Municipal Act, 2001, 5.0. 2001, c. 25, as
amended, provides that lower-tier municipalities may pass by-laws within the
sphere of jurisdiction of culture, parks, recreation and heritage;
AND WHEREAS pursuant to the said the Municipal Act, Sections 8 and 9 (1)
provide municipalities with powers of a natural person to enable them to govern
their affairs as they consider appropriate and to enhance their ability to respond to
municipal issues;
AND WHEREAS the Council for The Corporation of the Municipality of Kincardine
deems it advisable to continue with recreational improvements to Reunion Park in
the Municipality of Kincardine;
AND WHEREAS the Council for The Corporation of the Municipality of Kincardine
deems it expedient to accept the tender of Bomar Landscaping for the supply and
installation of of materials required to complete Reunion Park Recreational
Improvements Phase 2 as determined by Vafiades Landscape Architect Inc. in
Project Number 06-020 dated August 2, 2006;
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the tender of Bomar Landscaping Inc. for the supply and installation
of materials required for site preparation, electrical services, site amenities
and landscaping for recreational improvements to Reunion Park as detailed
in Vafiades Landscape Architect Inc. Project Number 06-020, in the
amount of $287,743.50, excluding GST, be hereby accepted.
2. That the Mayor and CAG be hereby authorized to sign, on behalf of the
Council for The Corporation of the Municipality of Kincardine any contracts
and other documents required to authorize such work to commence.

This by-law may be cited as the "Reunion Park-Recreational
Improvements-Phase 2 (Bomar) Tender Acceptance By-law".

The following changes are to be incorporated in the work prior to the award of contract in accordance with the requirements to the contract
documents. The cost of such revisions shall be included in the tender submission.
1.0 Contract Document
1.1 On Drawing L2. 1, Detail 2, South Boardwalk Node Layout Plan; the new wood boardwalk shall
be revised as indicated on the attached Drawing SK.1.
1.2 On Drawing L2.1, Detai/1, Wood Pavilion and Adjacent Deck Layout Plan; contractor to
include in price the removal of one 3" cal. (+1-) deciduous tree to allow for deck installation.
1.3 On Drawing L2.2, Pavilion Detail, add the following note;
"Contractor shall be responsible to provide engineered designed shop drawings for all
fasteners, knee braces, connections and footings that will ensure that the structure conforms
to all Ontario Building Code requirements including but not limited to Wind and Load Bearing
guidelines and with sufficient information to obtain a Building Permit for construction".

1. GENERAL
SEALED TENDERS will be received by the Parks and Recreation Department, Davidson
Centre, 601 Durham Street, Kincardine, Ontario, N2Z 1 L6 for the construction of:

Tenders shall be submitted in an envelope provided by the Contractor not later than 12:00
noon (local time)
on Wednesday, August 16, 2005
Envelopes containing Tenders should be sealed and plainly marked on the outside as to their
contents. Tender envelopes shall be addressed to: Ms. Karen Keiffer. Drawings and Tender
Documents may be obtained at the office of the Parks and Recreation Department.
Conditions relating to tendering as prescribed in the Tender Documents must be complied with.
The lowest or any Tender shall not necessarily be accepted.
All index and reference numbers in the Tender Documents are given for the convenience of
the Contractor and such must be taken only as a general guide to the items referred. It must
not be assumed that such numbering is the only reference to each item, but the Tender
Documents must be read in detail for each item.
Tenders received by the Recreation Department later than the specified closing time will be
returned unopened to the Tenderer.

3. TENDERERS MAY OBTAIN INTERPRETATION OF TENDER DOCUMENTS
Should any person contemplating submitting a Tender for the proposed Contract require
additional information concerning the scope of the work or the manner in which it must be
carried out, or should he be in doubt as to the meaning of the Drawings and Specifications, he
may submit a written request to the Contract Administrator for such additional information or for
such interpretation. The person submitting the request will be responsible for its prompt
delivery .
Any such information, interpretation or interpretations will be provided in an Addenda issued
three calendar days prior to the closing day for Tenders, if mailed, or one calendar day if hand-
delivered or faxed. A copy of such Addenda will be mailed. delivered or faxed to each person
who has taken out a set of Tender Documents. The Contract Administrator reserves the right
to issue any additional Addenda. Any Addenda issued during the time of tendering shall be
taken into account in preparing the Tender, and in closing the Tender, they shall become a part
thereof. The Corporation will not be responsible for any verbal instruction given to the
Contractor during the tendering period.

4. PRICES SUBMITTED
The tender price or prices quoted in the Tender shall be in full compensation for all labour,
equipment and materials and utility and transportation services necessary to perform and
complete all work under the Contract, including all miscellaneous work, whether specifically
included in the Tender Documents or not. It is the intention of the Drawings and Specifications
to provide finished work. Any items omitted there from which are clearly necessary for the
completion of the work shall be considered part of the work, though not directly specified in the
Tender Documents.
5. ALLOWANCE FOR CERTAIN ITEMS
No provision has been made in the Form of Tender to allow for certain items. A partial list of
such items may include the Contractor's site offices; stores and conveniences; maintenance of
flow and traffic, barricades, signs, flagmen, etc.; insurance; watchman, permits and approvals
(other than those to be paid for by the Corporation); items required by the Drawings or
Specifications but which have been omitted from the Schedule of Items and Prices and other
items required by the Contract, but not specifically related to or covered by the other items in
the Schedule of Items and Prices. Payment for such items shall be in accordance with
paragraph 02) of Ontario Provincial Standards General Conditions of Contract Clause
GC8.02.01 PRICE FOR WORK.
6. INSURANCE
Insurance requirements shall be in accordance with Ontario Provincial Section GCe
INSURANCE, PROTECTION AND DAMAGE.
7 . DeCLARATION - WORKERS' COMPENSATION/CORPORATION TAX ACT (WD-1)
At the time of execution of the Contract and prior to receiving payment for substantial and total
performance of the work, the successful Tenderer shall submit a Declaration stating that he
has paid all assessments or compensations payable ~nd has otherwise complied with all the
requirements ofthe Workplace Safety and Insurance Board, and that the successful Tenderer
has paid all taxes and/or penalties imposed on it by the Corporation Tax Act of the Province of
Ontario.
8. WORKPLACE SAFETY AND INSURANCE BOARD
, At the time of execution of the Contract, the successful Tenderer shall furnish the Corporation
with a Certificate of Clearance from the Workplace Safety and Insurance Board. The
successful Tenderer shall further maintain that good standing throughout the contract period.
In addition, the successful Tenderer will also be required to produce a Certificate of Clearance
from the Workplace Safety and Insurance Board throughout the Contract, including all payment
certificates.
If the Contractor fails to pay the required assessment or compensation, the Corporation may
pay such assessments or compensation to the Workplace Safety and Insurance Board and
deduct such amounts from the Contractor.

9. REQUIREMENTS AT TIME OF TENDERING
Failure of the Tenderer to comply with any of the following shall result in the Tender being
rejected
(a) The Tenderer shall submit an original signed and sealed bid deposit with his Tender.
(b) The Tenderer shall submit the Form of Tender issued by the Contract Administrator.
(c) The Tenderer's business name shall be inserted in at least one of the two spaces
provided in the Form of Tender.
(d) The signature of the person authorized to bind the Tenderer shall be inserted in the
space provided in the Form of Tender.
(e) The name ofthe bonding company shall be inserted in the space provided in the Form of
Tender.
(f) The Tenderer shall not apply any conditions whatsoever to the Total Contract Price.
10. TENDER OPEN FOR ACCEPTANCE
The Tenderer shall keep his Tender open for acceptance and irrevocable until 45 days have
elapsed from the closing date of the Tender or a formal contract is executed, based on a
Tender other than this one.
11. NOTIFICATION OF CONTRACT AWARD
The awarding of the Contract, based on this Tender, shall constitute and be an acceptance of
this Tender, and the Corporation shall notify the successful tenderer of the contract award.
12. INFORMAL OR UNBALANCED TENDERS
In addition to those errors in the Tender that shall result in the Tender being rejected, as
indicated in Clause 9 "REQUIREMENTS AT TIME OF TENDERING", Tenders which are
incomplete, illegible or obscure, or that contain additions not called for, erasures, alterations,
errors or irregularities of any kind, or contain prices which appear to be unbalanced as to be
likely to adversely affect the Corporation, may be rejected as informal.
All blanks must be legibly and properly filled in. Should any uncertainty arise as to the proper
manner of doing so, the required information will, upon request, be given by the Contract
Administrator.
T enderers who have submitted Tenders which have been rejected by the Corporation because
of informalities will be notified of the reasons for rejection. When checking Tenders, the
following procedures shall be used:
(a) If the amount tendered for a unit price item does not agree with the extension of the
estimated quantity and the tendered unit price, or if the extension has not been
made, the unit price shall govern and the total price shall be corrected accordingly.
(b) If both the unit price and the total price are left blank, then both shall be considered
as zero.
(c) If the unit price is left blank but a total price is shown for the item, the unit price shall
be established by dividing the total price by the estimated quantity.

(d) If the total price is left blank for a lump sum item, it shall be considered as zero.
(e) Ifthe Tender contains an error in addition and/or subtraction and/or transcription, the
error shall be corrected and the corrected total contract price shall govern.
13. REQUIREMENTS AT TIME OF EXECUTION
Subject to an award of the Contract by the Corporation, the Tenderer is required to submit the
following documentation in a form satisfactory to the Corporation for execution within seven (7)
days after being notified in writing to do so by the City.

14. WITHDRAWAL OF TENDERS
A Tenderer who has submitted a Tender may submit a further Tender at any time up to the
official closing time. The last Tender received shall supersede and invalidate all Tenders
previously submitted by that Tenderer for this Contract.
A Tenderer may withdraw his Tender at any time up to the official closing time by letter bearing
the signature of any person authorized by the Tenderer.
All withdrawn or superseded Tenders will be returned unopened.
15. ABILITY AND EXPERIENCE OF TENDERERS
No Tender will be considered from any Tenderer unless known to be skilled and regularly
engaged in work of a character similar to that covered by the Drawings and Specifications.

In order to aid the Corporation in determining the ability of any Tenderer, the Tenderer shall,
within 48 hours after being requested in writing by the Contract Administrator, furnish evidence
satisfactory to the Corporation of the Tenderer's experience and familiarity with work of the
character specified and his financial ability to prosecute the proposed work properly to
completion within the specified time. The evidence requested may, without being limited
thereto, include the following:
(a) The Tenderer's performance record with listing of work of a similar character and
proportions which he has constructed, giving the name of the owner, date built and
construction cost.
(b) A tabulation of other work now under contract, giving the location, type, size,
required date of completion and the percent of completion to date of each job.
(c) An itemized list of the Tenderer's equipment available for use on the proposed
Contract.
(d) A listing of the major parts of the work which are proposed to be sublet.
(e) The Tenderer's latest financial statement.
(f) Evidence that the Tenderer is licensed to do business in the Province of Ontario, in
the case of a corporation organized under the laws of any other Province or Country.
16. SINGLE TENDER
A single tender may be opened and the Corporation reserves the right to accept or reject it.
17. BID DEPOSIT WITH TENDER
Tenders must be accompanied by an original bid deposit in the form of a sealed and signed
Bid Bond, irrevocable Letter of Credit, Certified Cheque, or Canadian Currency (
PHOTOCOPIES OR FAXED COPIES OF BID BONDS WILL RESULT IN THE BID BEING
REJECTED). Subject to the written approval of the City Treasurer, prior to Tender closing,
other securities will be accepted as a bid deposit.
Bid bonds submitted as a security shall be in accordance with the standards of the Canadian
Construction Association and shall be from the same guarantee surety company supplying the
Performance and Labour and Material Bonds for this Contract. Should the Tenderer withdraw
his tender before 45 days have elapsed from the closing date of the Tender, or a formal
Contract is executed, based on a tender other than this one, or fail to comply with any or all the
requirements at the time of execution, the Corporation shall be at liberty to retain the money
deposited by the Tenderer to the use of the said Corporation as liquidated damages, and to
accept any other Tender or advertise for new Tenders, or carry out the work in any other way
as the said Corporation may in its sole discretion deem best; the Tenderer also agrees to pay to
the said Corporation the difference between the price or prices set out in this Tender and any
greater sum or sums which the said Corporation may expend or for which it may become liable
by reason of such default or failure, including the cost of any advertisement for new Tenders,
and fully to indemnify and save harmless the said Corporation and/or its officers, agents, or
servants from all loss, damage, liability, cost charges, or expense whatever which it, they or any
of them may suffer, incur or be put to by reason of any such default or failure.

Bid deposits will be returned to bidders upon award of the Tender by City Council except for
that of the successful Tenderer and the next lowest Tenderer who will have their bid deposits
returned upon execution of the Contract Document by the Corporation.
18. BONDS
The Contractor shall, on or before the execution of the Contract, produce and file with the City
Treasurer the following bonds:
(a) a bond in the amount of 50% of the total contract price, excluding G.S.T., guaranteeing
the full and faithful performance of the work, including maintenance of the works for the
stipulated period and the obligation to indemnify and save harmless the said Corporation,
as in the Form of Contract.
(b) a bond in the amount of 50% of the total contract price, excluding G.S.T., guaranteeing
payment for labour and materials.
Each bond shall:
(i) be issued by a surety bonding company approved by the City Treasurer and licensed to
carry on business in Ontario.
19. PRECONSTRUCTION REQUIREMENTS
The following documents are required for review and or approval prior to any construction
related activities:
i) Construction Schedule;
ii) List of sub contractors;
iii) material suppliers
20. SUB-5URFACE SOIL INVESTIGATIONS
Tenderers will not be permitted to carry out independent sub-surface soil investigations by the
excavation of "test pits".
21. ONTARIO PROVINCIAL SALES TAX
The prices tendered for the works shall be in accordance with the current legislation.
22. GOODS AND SERVICES TAX
Goods and Services Tax applies to all goods and services purchased by the Town of
Kincardine. G.S.T. is calculated at the rate of 6% on these purchases and is payable by the
town at the time payment is made for the purchase.
Contractors will be required to register for purposes of the tax, collect the tax on their taxable
supplies to the Town of Kincardine and remit as required by legislation. Contractors must
supply the Town of Kincardine with their G.S.T. registration number.

The total contract price shall be inclusive of all government sales taxes, including G.S.T.,
custom duties and excise taxes applicable with respect to the contract, and shall be paid by the
Contractor unless otherwise provided by statute. The estimated amount of Goods and
Services Tax must be disclosed separately on the Form of Tender. The City will pay the
Contractor all amounts of the G.S.T. in respect of the project.
G.S.T. is applicable at each trade level on virtually all goods and services consumed in
Canada. Registrants are entitled to a refundable input tax credit for tax paid on goods and
services to the extent the goods and services were acquired for use in a commercial activity.
Therefore, the tendered prices should not include G. S. T. on items for which the Contractor will
obtain an input tax credit.
All invoices and progress billings issued to the City must contain adequate information and
supporting documentation as specified in the G.S.T.legislation and prescribed by regulations
thereof, for the purpose of input tax credits and/or rebates in respect of the G.S. T. payable or
paid by the City. Specifically, the Contractor must provide his G.S.T. registration number and
must disclose the amount of G.S.T. payable on each billing. The Contractor shall make
available any other reasonable information which the City may require in respect of supporting
its claim for input tax credits or rebates.
G.S.T. is not due on amounts held back until the period for retaining the holdback has expired.
The Contractor will be required to exclude the amount of holdbacks from the consideration due
for calculation of the G.S.T. payable.

For the lump sum price for this item the Contractor shall supply bonding as indicated in Section 18 of the
Information to Tenderers.
SP 2 SUPPLY AND INSTALL CONSTRUCTION HOARDING FENCING
For the unit price for this item the Contractor shall supply all labour, equipment and material required to
install a 1.5m high construction hoarding fence as indicated on the Contract Drawings or directed by the
Contract Administrator.
The unit price shall include all regular maintenance of the fencing including any damage caused by
vandalism and the removal and off-site disposal of the fencing upon the completion of the contract.
Payment shall be made for each metre of construction fencing installed.
SP 3 WOOD PAVILION AND ADJACENT BOARDWALK DECK
For the total price for this item the Contractor shall supply all labour, equipment and materials required to
supply and install a pressure treated wood pavilion and deck complete with excavation, footings, beams,
joists. decking, roof, railings and hardware as noted on the Contract Drawings.
Payment shall be made as a lump sum payment.
SP 4 WOOD BOARDWALK IMPROVEMENTS
For the unit price for this item the Contractor shall supply all labour, equipment and materials required to
supply and install pressure treated wood boardwalks complete with excavation, footings, beams, joists,
decking and hardware as noted on the Contract Drawings.
Payment shall be made on a square metre basis.
SP 5 CRUSHED LIMESTONE PATHS
For the unit price for this item the Contractor shall supply all labour, equipment and materials required to
supply and install crushed limestone paths including excavation, materials and backfilling as noted on the
Contract Drawings.

SP 8 PRECAST CONCRETE CURB STOPS
For the unit price for this item the Contractor shall supply all labour, equipment and materials to install pre-
cast concrete curb stops as noted on the Contract Drawings.
Payment shall be made for each concrete curb stop installed.
SP 9 ELECTRICAL CONNECTIONS AND ENERGIZING
For the total price for this item the Contractor shall supply all labour, equipment and material, required to
energize the new light fixtures including work by Westario Power at the hydro pole at Albert Street and Huron
Terrace.
Payment shall be made as a lump sum payment.
SP 10 REMOVAL OF OLD LIGHT FIXTURES AND POLES
For the total price for this item the Contractor shall supply all labour, equipment and material, required to
remove the old light fixtures and poles as noted on the Contract Drawings and return to the Town of
Kincardine public works yard. Price to include de-energizing power and burying abandon wires at each light
location.
Payment shall be made as a lump sum payment.
SP 11 NEW LIGHT POLES AND FIXTURES
For the unit price for this item the Contractor shall supply all labour, equipment and material, required to
supply and install new light standards and fixtures on existing concrete bases as noted on the Contract
Drawings. Unit price shall include fixture, pole, electrical connections and fastenings.
Payment shall be made for each light pole and fixture installed.
SP 12 SITE FURNITURE
For the unit price for this item the Contractor shall supply all labour, equipment and material, required to
supply and install the site furniture as noted on the Contract Drawings.
Payment shall be made for each piece of site furniture installed.
SP 13 CHAIN LINK FENCE AND GATES
For the unit price for this item the Contractor shall supply all labour, equipment and materials required to
supply and install a 1.5m high black vinyl chain link fence complete with posts, rails, mesh and hardware as
noted on the Contract Drawings. Contractor to install one 1 m man gate for each property owner, at the
location agreed to by the home owner.
Payment shall be made on a per lineal meter basis.

Payment shall be made as a lump sum payment.
SP 16 SEEDING REPAIR
For the unit price for this item the Contractor shall supply all labour, equipment and materials required to
supply and install seed mix in areas disturbed during construction. The price shall include fine grading.
Payment shall be made for each square metre of seed installed.

(hereinafter called the "Corporation")

(hereinafter called the "Contractor")
OF THE SECOND PART
WITNESSETH
That the Corporation and the Contractor in consideration of the fulfilment of their respective promises and
obligations herein set forth, covenant and agree with each other as follows:
ARTICLE 1
(a) A general description ofthe work is:
The construction of a new wood pavilion, boardwalk improvements, crushed
limestone paths, wood bollards and planting oftrees, shrubs and perennials in
Reunion Park in The Municipality of Kincardine. The Contractor shall furnish all
labour, materials, tools and transportation, equipment, permits services and facilities
required for and during the installation and completion of the landscape works, listed
and described in these documents and illustrated on the contract drawings.
(b) The Contractor shall, except as otherwise specifically provided, at his own expense, provide all and every
kind of labour, machinery, plant, structures, roads, ways, materials, appliances, articles and things
necessary for the due execution of all the work set out in this Contract and shall forthwith according to the
instruction of the Contract Administrator commence the works and diligently execute the respective
portions thereof, and deliver the works complete in every particular to the Corporation within the time
specified in Clause 6, FORM OF TENDER.
ARTICLE 2
In the event that the Tender provides for and contains a Contingency Allowance, it is understood and agreed
that such Contingency Allowance is merely for the convenience of accounting by the Corporation, and the
Contractor is not entitled to payment thereof except for extra or additional work carried out by him in
accordance with the Contract and only to the extent of such extra or additional work.

ARTICLE 3
In case of any inconsistency or conflict between the provisions of this Agreement and the Plans or
Specifications or General Conditions or Tender or any other document or writing, the provisions of such
documents shall take precedence and govern in the following order, namely:
(a) Agreement
(b) Addenda
(c) Special Provisions
(d) Tender
(e) Specifications
(f) Working Drawings
ARTICLE 4
The Contractor shall not assign the Contract, either in whole or in part, without the written consent of the
Owner, as set out in Subsection GC3.09 - Ontario Provincial Standards - General Conditions of Contract.
ARTICLE 5
The Corporation covenants with the Contractor that the Contractor having in all respects complied with the
provisions of this Contract, will be paid for and in respect of all the work at the tendered unit prices after
measurement approved by the Engineer, the total which is presently estimated at THREE HUNDRED AND
THREE THOUSAND FIVE HUNDRED AND EIGHT DOLLARS AND ELEVEN CENTS including
G.S.T., cash allowances and contingency allowances together with such additional sum or sums including
G.S.T., for such extra or additional work at the unit rates or the amounts, as the case may be, stipulated in the
written orders of the Engineer authorizing the extra or additional work; such payment, however, shall be
subject to Article 2 hereof and subject to such additions and deductions as may be properly made under the
terms hereof, and further subject to the provisions that the Corporation may make payments on account
monthly or otherwise as may be provided in the General Conditions attached hereto.
ARTICLE 6
Where any notice, direction or other communication required to be or may be given or made by one of the
parties hereto to the other or to the Contract Administrator or to his agent, it shall be deemed sufficiently given
or made if mailed or delivered in writing to such party or to the Engineer at the following address:

Where any such notice, direction or other communication is given or made to the Engineer, a copy thereof shall
likewise be delivered to the Contract Administrator of the Engineer, if appointed, and where any such notice,
direction or other communication is given or made to such agent, a copy thereof shall likewise be delivered to
the Engineer.
ARTICLE 7
A copy of each of the Tender, Special Provisions, Addenda 1 to 1, plus Post Tender Addendum 1 inclusive is
hereto annexed and together with the plans, detailed drawings, Ontario Provincial Standards for Roads and
Municipal Services, Volumes 1 - 4 inclusive, relating thereto, all as listed in the Information for Tenderers are
made part of this Contract, as fully to all intents and purposes as though recited in full herein.
ARTICLE 8
No implied Contract of any kind whatsoever by or on behalf ofthe Corporation shall arise or be implied from
anything in this Contract contained nor from any position or situation of the parties at any time, it being clearly
understood that the express covenants and agreements herein contained made bv the Corporation shall be the
only covenants and agreements upon which any rights against the Corporation may be founded.
ARTICLE 9
Time shall be deemed the essence of this Contract.
ARTICLE 10
The Contractor declares that in tendering for the works and in entering into this Contract he has either
investigated for himselfthe character of the work and all local conditions that might affect his tender or his
acceptance ofthe work, or that hereby assume all risk of conditions arising or developing in the course of the
work which might or could make the work, or any items thereof, more expensive in character, or more onerous
to fulfil, than was contemplated or known when the tender was made or the Contract signed. The Contractor
also declares that he did not rely upon information furnished by any methods whatsoever, by the Corporation or
its officers or employees, being aware that any information from such sources was and is approximate and
speculative only and was not in any manner warranted or guaranteed by the Corporation.
ARTICLE 11
In compliance with the current regulations made under the Retail Sales Tax, Ontario, for the purpose ofthe
purchase of materials to be in the works which are the subject matter ofthis Contract, the Contractor is hereby
appointed as a special purchasing agent for the Corporation which will be provided to the Contractor.
ARTICLE 12
This Contract shall apply to and be binding on the parties hereto and their successors, administrators, executors
and assigns and each of them.

.1 Reunion Park - Recreational Improvements
The elements of this contract involve the construction of a new wood
pavilion, boardwalk improvements, the installation of new light fixtures
and plant material at Reunion Park in the Town of Kincardine. The
Contractor shall furnish all labour, materials, tools and transportation,
equipment, permits services and facilities required for and during the
installation and completion of the landscape works, listed and described

1.4 CONTRACT METHOD

1.6 CONTRACTOR'S USE OF PROPERTY
.1 The Contractor has unrestricted use of the portion of the site covered by

1.7 DRAWINGS
.1 Drawings include Scope of Work and the general and approximate
location, extent, arrangement and size of plantings, materials,
furnishings, equipment piping, conduits and outlets. Determine accurate
locations and arrangements and sizes by study and coordination of
landscape architectural drawings and shop drawings. Before proceeding
with Work, ensure that spaces and arrangements which affect
installations are adequate and coordinated. When construction
conditions require reasonable revisions to indicate locations and
arrangements, make such revisions at no additional cost to the Owner.
1.8 SITE PROGRESS RECORDS
.1 Maintain at site a permanent written record of progress of the Work.
Make the record available at all times with copies provided when
requested. Include in each day:
a) Weather conditions with maximum and minimum temperatures;
b) Conditions encountered during excavation;
c) Commencement and completion dates of the Work of each area
of Project.
d) Erection and removal dates of formwork in each area of Project
e) Dates, quantities, and particulars of each concrete pour.

f) Attendance of Contractor's and Subcontractors' work forces at
Project and a record of the work they perform.

1.9 EXAMINATION
.1 Site
a) Examine site, and ensure that each Section performing work
related to site conditions has examined it, so that all are fully
informed on all particulars which affect Project Work.
.2 Ensure by examination that all physical features of the Work, and
working restriction and limitations which exist are known, so that the
Owner is not restricted in his use of the premises for his needs.
.3 Previously Completed Work:
a) Where dimensions are required for fabrication, verify dimensions
of completed work in place before fabrication and installation of
work to be incorporated with it.
b) Verify that previously executed work and surfaces are
satisfactory for installation or application, or both, and that
performance of subsequent work will not be adversely affected.
c) Ensure that work installed in an unsatisfactory manner is
rectified by those responsible for its installation before further
work proceeds.
d) Commencement of work will constitute acceptance of site
conditions and previously executed work as satisfactory.
e) Rejected work resulting from application to, or installation on, or
incorporation with, unsatisfactory previous work will be
considered the responsibility of those performing the later work.
.4 Construction Measurements:
a) Before commencing installation of work, verify that its layout is
accurate in accordance with intent of Drawings, and that
positions, levels, and clearances to adjacent work are
maintained.
b) Before commencing any work, verify that all clearances required
by jurisdictional authorities can be maintained.

c) If work is installed in wrong location, rectify it before construction
continues.
1.10 PROTECTION OF WORK, PROPERTY AND PERSONS
.1 Provide necessary methods, materials, and construction to ensure that
no damage or harm to work, materials, property and persons results
from the Work of this Contract.
.2 Protect excavated areas from damage by frost, and water from natural
sources and from, backed up drain lines and sewers.
.3 Keep excavations free of water. Pump to maintain excavations
constantly dry.
.4 Protect adjacent private and public property from damage and, if
damaged, make good to match in all details. Re sod and replant
damaged lawns and planting to its original condition, except in areas
designated to receive landscaping under this Contract or other contract.
.5 Keep surfaces, on which finish materials will be applied, free from
grease, oil, and other contamination which would be determined in any
way to the application of finish materials.
.6 Protect glass and other finishes against heat, Slag and weld spatter by
provision of adequate shielding.
.7 Do not permit strippable tape or coatings to become baked on surfaces
which they protect.
.8 Do not apply visible markings to surfaces exposed to view in finished
state or that receive transparent finishes.
.9 Protect surfaces of completed work exposed to view from staining,
disfigurement and all other damage by restriction of access or by use of
physical means suitable to the material and surface location. Establish
with each Subcontractor the suitability of such protection in each case.
.10 Schedule finish work at end of construction when interference from
tradesmen is at a minimum.
.11 Enforce fire prevention methods at site. Do not permit bonfires, open
flame heating, devices or accumulation of debris. Use flammable
materials only if all safety precautions are taken, both in use and
storage. Provide and maintain in working order ULC labelled fire
extinguishers of types suitable for fire hazard in each case, and locate
them in prominent locations and to approval of jurisdictional authorities.

information has been recorded. Consultant will make a monthly
review of the Project Record Drawings to ensure that they have
been updated.
d) Completion of the project record drawing to current stage of
construction shall be considered a condition precedent for validation
of any application for payment made by the contractor. Failure to
comply may be cause for not issuing Substantial Performance
Certificate.

3.1 WORKMANSHIP
.1 Keep site well drained. Keep landscape excavations dry.
.2 Cleanup immediately, soil or debris spilled onto pavement and
dispose of deleterious materials.
3.2 PREPARATION OF SURFACES
.1 Loosen areas to be seeded to a cultivated surtace, fine grade free
of humps and hollows and free of deleterious and refuse material.
.2 Obtain Architect's approval of topsoil grade and depth before
starting seeding.
3.3 SEEDING
.1 Seed lawns during early spring or after 15th of August to within 4
weeks of freeze-up.
.2 Sow during calm weather (winds less than 10 km!h) using
equipment suitable to the area involved to the approval of the
Architect. Sow half of required amount of seed in one direction
and follow by sowing angles. Incorporate seed into soil to a
minimum depth of 5mm simultaneously or within one hour after
seeding operation. Mix carefully with light chain harrow or wire
rakes and roll area immediately afterward with light turf roller.
.3 Provide adequate protection of seeded areas against damage.
Remove this protection after lawn areas have been accepted by
Architect.
.4 In the case of dormant seeding (late fall), sufficiently protect
seeded areas from pedestrian and vehicular damage.
.5 Reseed at 2 week intervals where germination has failed.
3.4 MAINTENANCE
.1 Ensure maintenance equipment suitable to Architect.
.2 Keep soil moist during germination period and water lawns
frequently during remaining maintenance period.
.3 Apply water in sufficient quantities to ensuremoisture penetration
of 3-4": (75 to 100 mm). Control sprinkling to prevent wash-outs.

.4 Cut grass first time when it reaches height of 2-2 1/2" (60mm) and
cut thereafter frequently enough to maintain height of 1-1 1/2" to
2" (40-50mm). Remove clippings which will smother grassed
areas.
.5 Apply herbicide when it will not cause damage to new grass or
other plants. Apply during calm weather when air temperature is
above 10 degrees C., when broad leaf weeds start developing.
Prevent drifting of spray, repair damage to grass and plants.
.1 Use 2, 4-d amine herbicide for susceptible broadleaf
weeds. Apply at manufacturer's recommended rate.
.2 Use 2,4-0 plus propionic acid mixtures herbicide for
chickweed, clover, black medick, and other 2, 4-0
resistant plants. Apply at manufacturer's
recommended rate.
.3 Avoid use of dicambal and picloram solutions near trees
and shrubs.
.4 Use only mecocrop on Bentgrass turf areas.
.5 Fertilize seeded areas one month after seeding with 2: 1: 1
ratio fertilizer. Spread evenly at a rate .5 kg of nitrogen/
100 m2 and water well. Postpone fertilizing until next
spring if application falls within four weeks prior to
expected end of growing season in locality.
3.5 ACCEPTANCE
.1 Lawn areas will be accepted by Architect provided that:
.1 Seeded areas are properly established.
.2 Turf is free of bare and dead spots and without weeds.
.3 No surface soil is visible when grass has been cut to a
height of 1-1 1/2" (40mm).
.4 Seeded areas have been cut at least twice, the last cut
being carried out within 24 hours of acceptance.
.2 Lawns seeded in fall will be accepted in following spring one
month after start of growing season provided acceptance
conditions are fulfilled.

1.2 QUALITY ASSURANCE

done in accordance with C.S.A. 080-M4/74.
.3 All wood must comply with the grade specified.
.4 Welding contractor is to be fully approved by the Canadian
Welding Bureau under the requirements of C.S.A. W-47 and
welding is to be done in accordance with C.S.A W-59.
1.3 PRODUCT DELIVERY, STORAGE AND HANDLING
.1. Protect all materials from harmful exposure during
transportation to the site.
.2 On delivery, store all materials off the ground and protect from
adverse conditions to prevent deterioration, damage, or
impairment of structural or other essential properties.
.3 All damaged or deteriorated materials will be rejected and must
be removed from the site immediately.
1.4 JOB CONDITIONS
.1 Report in writing to the engineer prior to, commencing work, of
any conditions or defects encountered on the site upon which

1.5 INSPECTION
.1 All materials are subject to inspection by the Landscape Architect

.2 All timber, wood and plywood which has been pressure treated,
must bear an inspection and classification label of the
Underwriter's Laboratories of Canada.
.3 Obtain the approval of the Landscape Architect of the completed
installation before applying finish.
.4 Give timely notice, in writing to the Landscape Architect when
final acceptance is required.
1.6 MAINTENANCE
.1. Protect and maintain all timber work, woodwork and finishes from
time of installation until acceptance.
1.7 GUARANTEE
.1 Guarantee all timber work and wood work for a period of one year.
.2 Guarantee all finishes for a period of one year.

2.1 MATERIALS
.1 Pressure treated timber and lumber: of the grade and type
specified on the drawings. conforming to C.S.A. 0141 for nominal
size, fully incised before pressure treatment, with min. penetration
of 13 mm on all faces and pressure treated to the densities as
stated in C.S.A. 080-M4n4. All timber and lumber must be
straight, sound and free of splits, warps, checks large knots or
other defects.
.2 Other timber and lumber: conform to the above description with
the exception of items related to pressure treatment.
.3 Plywood: exterior type, free of all checks, splits, open joints,
cracks, knot holes or loose knots and other defects, conforming
to C.S.A. 0151 and 0121 for thickness and grade and, if required
or specified, pressure treated in accordance with C.S.A. 080-

1.2 QUALIFICATIONS OF CONTRACTORS
.1 The work specified in this Section shall be performed by a
recognized specialist contractor, who has adequate plant,
equipment and skilled tradepersons to expeditiously perform the
work, and is known to have at least five (5) years of proven
satisfactory experience in the field of sodding, seeding and
planting work of the type and quality specified.
1.3 SOURCE QUALITY CONTROL
.1 Obtain approval of plant material at source.
.2 Notify Landscape Architect of source of material at least 7 days in
advance of shipment. No work under this Section is to proceed
without approval.
.3 Acceptance of plant material at its source does not prevent
rejection on site prior to or after planting operation.
.4 Imported plant material must be accompanied with necessary
permits and import licenses. Conform to federal and provincial
regulations.
1.4 SHIPMENT AND PREPLANTING CARE
.1 Supply manufactured items such as fertilizer, bone meal, mulch,
etc., in standard containers, clearly indicating contents, weight,
component analysis and the name of the manufacturer.

.3 Landscape Architect reserves the right to extend Contractor's
warranty responsibility for an additional one year if, at the end of
the initial warranty period, leaf development and growth is
not sufficient to ensure future survival.
1.6 REPLACEMENTS
.1 During warranty period, remove from site any plant material that
has died or failed to grow satisfactorily as determined by
Landscape Architect.
.2 Replace plant material in the next planting season.
.3 Extend warranty on replacement plant material for a period equal
to the original warranty period.
.4 Continue such replacement and warranty until plant material is
acceptable.

too far advanced will not be accepted unless prior
approval is obtained.

Cold storage: approval required for plant material which has been
held in cold storage.

Balled and burlapped: Deciduous trees in excess of 3m height
must have been dug with large firm ball. Root balls must include

Collected or native plant material: use only native trees
indigenous to area in to which they are to be transplanted. Select
trees from reasonably open stands. Trees must have well
developed crowns and must be characteristically branched. Not
more than 40% of overall tree height may be free of branches.

Trees native to site need not be placed in wire basket if tree is
transplanted and moved on site in tree spade.

Horticultural topsoil shall be a fertile, friable, natural loam containing not
less than 5% organic matter. After the addition of soil amendments, the
organic matter content shall not exceed 40%. Topsoil shall be free of
stones greater than 25mm in diameter, subsoil, refuse or other
extraneous material and be capable of sustaining healthy plant growth.
Topsoil that is in a frozen or muddy condition shall not be used.

Soil amendments shall be mixed with horticultural topsoil in the following
ratio:
Loam Mix
Compost
Peat Moss

The mixing of the topsoil and soil amendments according to the
specified proportions shall be performed using a mechanical shredder.
If the mixing is to be performed oft the contract site, the Contract
Administrator shall be notified prior to mixing.
PART 3: EXECUTION
3.1 WORKMANSHIP
.1 Stake out location of trees and planting beds as per planting
plan. Obtain approval prior to excavating.
.2 Apply anti-desiccant in accordance with material manf. 's
instructions.
.3 Co-ordinate operations. Keep site clean and planting holes
drained. Immediately remove soils or debris spilled in to
pavement.
3.2 PLANTING TIME
.1 Plant deciduous plant material during dormant period before buds
have broken. Plant material noted for spring planting only. must
be planted in dormant period unless container grown stock.
.2 Plant material imported from region with warmer climatic
conditions can only be planted in early spring.
.3 When permission has been obtained to plant deciduous plant
material after buds have broken, spray plants with anti-desiccant
to slow down transpiration prior to transplanting.
.4 Plant only under conditions that are conducive to health and
physical conditions of plants.
.5 Provide planting schedule. Extending planting operations over
long period using limited crew will not be accepted.

3.3 EXCAVATION
.1 Trees: excavate to depth at least 200mm deeper than the height
of root ball, with width 760mm greater than diameter of root ball.
In heavy soils, place root ball on a slight mound at bottom of
excavation so that top of root ball extends appx. 100mm above
surrounding finished grade and increase width of excavation at
top of hole.
.2 Shrub beds: excavate shrub beds to a depth of 450mm minimum and
install Triple Mix as outlined in Section 02212, Topsoil and Finish
Grading.
.3 Provide drainage for planting holes in heavy soil if natural
drainage does not exist. Have method approved.
.4 Protect bottom of excavations against freezing.
.5 Remove water which enters excavations prior to planting. Ensure
that source of water is not ground water.
3.4 PLANTING
.1 Loosen bottom of planting hole to depth of 100mm to 150mm.
Cover bottom of each excavation with min. of 150mm of topsoil
mixture.
.2 Plant trees vertically with roots placed straight out in hole. Orient
plant material to give best appearance in relation to structure,
roads and walks.

Place plant material so that top of root ball is 100mm above
surrounding finished grade.
.4
With balled and burlapped root balls, loosen burlap and cut away
min. top 1/3 without disturbing root ball. Do not pull burlap or rope
from under root ball. With container stock, remove entire
container without disturbing root ball. Non bio-degradable
wrappings must be removed.
.5
Tree spade excavated material:
a. Dig tree pit with same mechanical equipment as used to
dig plant material. Ensure that hole dug is as upright as
possible. Place in a hole of mixture of 40 litres of planting
soil and fertilizer mixed with water to soupy consistency.
This will be forced up sides of ball as root ball is placed in
hole.

b. In heavy clay soil, dig planting pit as specified for
excavation of large trees. Pit preparation: loosen bottom
of each excavation with min. 150mm topsoil mixture.
.6 Tamp planting soil around root system in layers of 150mm eliminating
air voids. Frozen or saturated planting soil is unacceptable. When 2/3 of
planting soil has been placed, fill hole with water. After water has
completely penetrated into the soil, complete back filling.
.7 Build 100mm deep saucer around outer edge of hole to assist
with maintenance watering.
.8 When planting is completed, give surface of planting saucer
dressing or organic 10-6-4 fertilizer at rate of 12 Kg.l100m2 for
shrub beds or 40 to 50 g.lmm of caliper for trees. Mix fertilizer
thoroughly with top layer of planting soil and water well.
3.5 TREE SUPPORT
.1 Tree support is shown on planting details.
.2 Guy wires for trees:
a. For deciduous trees, fasten tree wires to tree where a
branch will prevent slipping down. Use tree rings to
prevent abrasion of bark.
b. Fasten guy wires to anchors at distance from tree base
equal to height of where wire is attached to trunk. Break
wires, installwire tighteners and tighten slightly.
c. Where guy wires are used close to pedestrian traffic
ways, fasten metal flags to wires to make them clearly
visible.
3.6 WRAPPING
.1 Wrap deciduous trees, spirally from ground up to height of
second branches. Treat trunk with paste of long residual
insecticide, lindane or equivalent before applying wrapping.
Secure burlap with binder twine wound in opposite direction to
burlap at 100mm intervals. Place wrapping neatly and snugly with
13mm overlap.
3.7 PRUNING
.1 Prune trees and shrubs after planting, as indicated, to
compensate for loss of roots suffered during transplanting.

Postpone pruning, of those trees where heavy bleeding may
occur until in full leaf. Employ clean sharp tools and make cuts
flush with main branch, smooth and slope as to prevent
accumulation of water.
.2 Remove projecting stumps on trunks of main branches that rub
causing damage to bark. Trim out crown of trees and shrubs
without changing their natural shape. Do not damage lead
branches or remove smaller twigs along main branches. Treat
cuts in excess of 100-130mm dia. and damaged parts with
application of wound dressing.
3.8 MULCHING
.1 Where a decorative wood chip mulch is called for place at min. 50mm
depth or to depth indicated on drawings and in locations shown on
drawings. Wood chips to be 'Gro-Bark' type or approved alternate.
3.9 MAINTENANCE
.1 Water once a week for first 4 weeks and then sufficiently there-
after to maintain optimum growing conditions. Ensure adequate
moisture in root zone at freeze-up
.2 Keep soil within confines of planting saucer around trees
shallowly cultivated and free from weeds.
.3 Spray plants to combat pests and diseases. Do not use DOT or
sprays prohibited by Agriculture Canada.
.4 Keep tree guy wires in proper repair.
.5 Provide adequate protection against winter damage
including damage caused by rodents.
.6 Maintain plant material from date of planting up to date of
acceptance.
3.10 CLEAN UP
.1 At the completion of the planting operations, remove all surplus
material from the site at no extra cost.
.2 Make good all damage resulting from planting operations at no
extra cost.
