THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW
BY-LAW NO. 1997-28
A BY-LAW TO AMEND THE TOWN OF KINCARDINE CONSOLIDATED
PERSONNEL BY-LAW
WHEREAS By-law No. 1996-96 was passed on the 19th day of
December, 1996 to consolidate and establish personnel policies
for employees of the Town of Kincardine;
AND WHEREAS the Council for the Town of Kincardine deems
it expedient to amend the By-Law;
NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:
1. That article 28.0 of By-law 1996-96 passed on the 19th
day of December, 1996 be hereby repealed and replaced by
the following:

PREGNANCY AND/OR PARENTAL LEAVE
2. That article 28.1 of By-law 1996-96 passed on the 19th
day of December, 1996 be hereby repealed and replaced by
the following:

Requests for leave of absence without pay due to
pregnancy and/or parental leave shall be granted
in accordance with The Employment Standards Act of
Ontario.

That article 28.3 of By-law No.

SCHEDULE "M"
STAND-BY REMUNERATION
Effective date:
January 1, 1997
Outside Maintainers - Public works
$ 45.00 per week if on stand-by. Stand-by to be in effect from
December 1 to March 31 annually.
Waste Water Treatment and Water Treatment System Employees
$ 60.00 per week if on stand-by. Stand-by to be in effect from
January 1 to December 31 annually.
Public works Supervisor
$ 45.00 per week. Stand-by to be in effect from December 1 to
March 31. This stand-by pay will be paid throughout this
period with the exception being if the supervisor takes
vacation during this period, when it will not be paid.
Vacation consists of at least 5 days' consecutive absence.
This benefit is not transferable to the lead hand even in the
case of vacation, where the manager of public works will take
necessary calls.
Notes
1. Maximum of one waste water treatment system employee, one
water treatment system employee and two public works employees
to be on stand-by in anyone week, not including the public
works supervisor.
2. The Manager of Public Works may require stand-by shifts for
outside maintainers outside the months of December to March
should conditions warrant.
3. The $60.00 per week water services rate reflects a
certified employee (MOEE certification) and the $45.00 per week
public works rate represents an uncertified employee.

1)
Replacement allowance for chief building official shall
commence on the 3rd consecutive day of absence.
2)
Replacement allowance for public work supervisor, waste
water treatment system chief operator and water treatment
chief operator shall commence on the first hour worked,
but only if the supervisor is absent for more than four
(4) consecutive hours.
3) In the absence of both the public works supervisor and
the appointed lead hand, the manager of public works may
appoint an alternate acting lead at his/her discretion.
