THE CORPORATION OF THE MUNICIPALITY OF KINC INE
BY-LAW
NO. 2003 -128
BEING A BY-LAW TO ACCEPT A TENDER FOR THE CONS RUCTlON OF A
SHORELINE AREA DISTRIBUTION SYSTEM FOR THE M NICIPAlITY OF
KINCARDINE
(Omega Contractors Inc.)
WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25 Section 11 (2) authorizes
municipalities to pass by-laws respecting matters within the sp ere of jurisdiction
of water distribution; I
AND WHEREAS the Province of Ontario has enacted the Safe Drinking Water
Act, 2002, as amended, to protect human health through the c ntrol and
regulation of drinking-water systems and drinking-water testing
AND WHEREAS the Council for the Corporation of the Munici ality of Kincardine
has deemed it necessary to construct a Shoreline Water Distri ution System
along a route as outlined on the map attached as Schedule "A" to this by-law to
meet regulations in the Safe Drinking Water Act, 2002, as ame ded;
AND WHEREAS the Council for The Corporation of the MunicIpality of Kincardine
deems it expedient to accept a tender to construct a Shorelin, Water Distribution
System; I
AND WHEREAS Omega Contractors Inc. of London, Ontari has submitted the
lowest tenders for the Shoreline Area Water Distribution Syste project;
NOW THEREFORE the Council for The Corporation of he Municipality of
Kincardine ENACTS as follows:
1. That the tender of Omega Contractors Inc. of Lon on, Ontario in the
amount of $3,072,023.50, including all applicable taxes for the construction
of the Shoreline Area Water Distribution System, Con ract 1 consisting of
the supply, labour and construction of: 8200 m of 300 mm dia PVC
watermain; 5800 m of 150 and 200 mm dia pVC wate ain; 275 m of 200
and 350 MM P.E. watermain (by directional drill); 360 ater services, incl.
reconnections; 75 hydrants along a route as outlin d on the attached
Schedule "A", be hereby accepted.

That the tender of Omega Contractors Inc. of Lon on, Ontario in the
amount of $2,022,500.00, including all applicable taxe for the construction
of the Shoreline Area Water Distribution System, Con ract 2, consisting of
the supply, labour and construction of: 7300 m 0 300 mm dia PVC
watermain; 800 m of 150 mm dia PVC watermain; 10m of 350 mm dia
P.E. watermain (by directional drill and open trench); 340 water services;
45 hydrants along a route as outlined on the attach d Schedule "A", be
hereby accepted.

That the Mayor and CAO be hereby authorized to sign,1 on behalf of the
Council for The Corporation of the Municipality of Kincar~ine any contracts
and other documents required to authorize such work to cþmmence.
That the Mayor and CAO are authorized to make such ~chnical changes
to the construction contract documents as might be required to commence
and complete the contract provided that such changes ~o not in any way
make any material changes to the intent of the work ias referred to in
paragraph 1 and 2 of this by-law.
5. This by-law shall come into full force and effect upon its fi~al passage.

6. This by-law may be cited as the "Shoreline Area Water D stribution System
Contracts 1 & 2" Tender Acceptance By-law".
READ a FIRST, SECOND, and THIRD time and DEEMED TO IBE PASSED this
3rd day of September, 2003. .
