HomeMy WebLinkAboutKIN1929-996 Paving of Harbour St., Lambton St., & Durham Streeta I 258 'i i� 0�4e �I 0 A Ay -Law to authorize the construction of a pavement on Harbor Streot,Lambton Street and Durham street,west of Huron Terrace Street in the Town of Kinourdine. i7H:LLUS Celinda Talker and others have petitioned the Council of the Corporation of the Town of Kinourdine to oonetruot,as a local improvement,a pavement on Harbor Street from Huron Terrace Street to the west limit of John Stein's property; AND WiliHiAS Ltary Gledhill and others have petitioned the said council to construct,as a Local Improvement,a pavement on Lambton Street from Huron Terrace Street to Saugeen Street; i AIID THcILM Thomas Leakey and others have petitioned the said council to construct,as a local improvement,a pavement on Durham Street from Huron Terrace Street to Saugeen street; AnD 41ILMPA3 the Clerk of the said Corporation has certified that each of the said petitions is sufficient and it is expedient to grant j the prayer of eaoh of said petitions in the mannor hereinafter I provided; THE LIUIIICIPAL COUIICIL Oi M COAPoArt 2IOPI OF 1'11 TOTII I THAAEFORL' " OF KIIIC.,cONS .` I CT3 AB FOLLOW3;- (1) That an asphalt pavement with ourb and gutter.bo constructed on Harbor Street from Huron Terrace Street to the west limit.of John Stein's property;on Lambton Street from Huron Terrace street to Saugeon Street and on Durham Street from Huron Terrace - itreet to Saugoon street as Local Improvements under the provisions of Oc aallImp ovement Act; jkle (2) That the Engineer of the Corporation, do forthwith ma ke such plane,profiles and anacifioa,tions and furnish such information as may be necessary for the making of a oontrrot for the execution of the v7ork. (3) The work shall be carried on and executed under the superintendence and according to the orders and directions of such engineer. (4) The I.Iayor and Clerk are authorized to cuuso a contract for the construction of the work to be made and entered into with come person or porsons,firm or Corporation, subject to the approval of the Council to be declared by resolution. (b) The Treasurer may (subject to the approval of the Council) agree x t i with any Dank or person for temporary advances of money to meet the I. cost of the work pending the completion of it. li (6) The Special Assessment shall b9 paid by twenty annual instalments. (7) Twenty -five per cent of the cost of construction of said pavement shall be paid by the Corporation at large and seventy -five per vent thereof shall be paid by the ratepayers whose property abuts upon the work to be oonstruoted.this by -law being passed by a vote of three - fourths of all the members of the Council. (8) The debentures to be issued for the loan to be effects& to pay for the coat of the work when oompleted,shall bear interest at five per ILA cent per annum and shall be payable within twenty years in the instal- 'f ment plan.and in settling the sum to be raised annually to pay the deft the rate of interest on investments shall not be estimated at more than four per cent per annum. ` (9) Any person whose lot is specially assessed may commute for a pay- ment in cash the special rates imposed thereon.by paying the portion of the coat of construction assessed upon each lot,without the interest forthwith after the Special Assessment !toll has been certified by the Olerk.and at any time thereafter by the payment of such eum as when invested at four per cent per annum will provide an annuity sufficient to pay the speol.al rates for the unexpired portion of the term as they fall due.
