CONSTRUCTION BY -LAW N064
A BY -LAW to authorize the construction of an asphalt pavement on
Huron Terrace Street from Harbor Street to Broadway Street and on
Prinoese Street from Russell Street to Broadway Street as a Local
Improvement under the provisions of The Local Improvement Act.
WHEREAS William Pollock and others have petitioned the Council of
the Corporation of the Town of 8inoardine to oonstruot.as a Local
Daprovement.an asphalt pavement twenty -six feet wide with curb and
gutter upon Huron Terrace Street from Harbor Street to the north
limit of James Malcolm's garage;
AND WHEREAS Mrs-George Blair and others have petitioned said Council
to oonetruot as a local improvement.an asphalt pavement twenty -teat

wide from the north limit of James Malcolm's garage to Broadway Street
AND WHEREAS JohnJ.Hunter and others have petitioned said Council to
conetruot.as a local improvement.an asphalt pavement thirtyone3 feet
seven inches wide on Princess Street from Russell Street to Lambton

Street and twenty /feet wide from Lambton Street to Broadway Street;
AND WHEREAS the Clerk has oertified that each of the said petitions
is sufficient and it is expedient to grant the prayer of each of said
Petitions in the manner hereinafter provided;
THEREFORE THE MUNIOIPAL COUNCIL OF THE CORPORATION OF THE TOWN OF
$INCARDINE enacts as follows;.
(1) That an asphalt pavement be construoted on Huron Terrace Street
twenty -six feet wide with curbing from Harbor Street to the north
limit of James Mal eolm'B garage;on Huron Terrace street twenty feet
in width from the north limit of James Malcolm's garage to Broadway
Street and on Princess Street from Rue ell rba 1!i-fif- bton Street

(S) The Engineer of the Corporation, �1���� .do forth.

execution of the work.
I (3) The work shall be oarried on and executed under the superintendence

(4) The Mayor and Clerk are authorised to cause to- on -timm a contract
for the construction of the work to be made and entered into with some
pardon or pereone,firm or oorporation.subjeot to the approval of the
Council to be declared by resolution.
(b( The Treasurer may (subject to the approval of the Council) agree
with any Bank or person for temporary advances of money to meet the
cost of thw work pending the completion of it.

(6) The Special Assessment shall be paid by twenty annual instalments.
(7) Twenty -five per cent of the cost of construction of said pavement
shall be paid by the Corporation at large and seventy -five per cent
thereof shall be paid by the ratepayers whose property abuts upon the
work to be oonstruotedithis by-law being passed by a vote of three.

(8) The debentures to be issued for the loan to be effected to pay
for the cost of this work when oompleted.shall bear interest at five
per cent per annum and shall be payable within twenty years on the in.
stalmant plan.and in settling the am to be raised annually tompay the
debt.the rate of interest on investments shall not be estimated at
more than four per cent per annum.
(9) Any person whose lot is speoially aeaeaaed may commute for a
payment in cash the special rates imposed thereon.by paying the portion
of the coat of construction aesesaed upon saoh lot.without the interest
forthwith after the Special Assessment Roll has been certified by the
Clerk.and at any time thereafter by the payment of such sum as when
Invested at four per cent per annum will provide an annuity sufficient
to pay the special rates for the unexpired portion of the term as they
fall due.
