BY-LAW
NO. 2003 . 120
A BYLAW TO REMOVE CERTAIN LANDS
FROM PART LOT CONTROL

WHEREAS Subsection 50 (7) ofThe Planning Act, R.S.O. 1991 permits councils
of local municipalities to exempt lands, within a plan of sub ivision, from the
requirements of Subsection 5 of Section 50 of the said act; I

AND WHEREAS the owner of Lots 2-7 and Part Lot 8 Registe¡d Plan 3M-145,
being Parts 1-13 Plan 5947 and Lots 14 & 15, 18-20 Register d Plan 3M-145,
being Parts 1-7 Plan 5948, (Reynolds Drive & Scougal Cou ) Municipality of
Kincardine (former Town of Kincardine), County of Bruce, has ade application
to the Municipality of Kincardine to remove part lot control from t~ose lands;
NOW THEREFORE the Council for The Corporation of tht' Municipality of
Kincardine ENACTS as follows:
1. That Subsection 5 of Section 50 of the Planning Act ~hall not apply to
those parts of the plans of subdivision described as foll0Yfs:

i) Lots 2-7 and Part Lot 8 Registered Plan 3M-145,lbeing Parts 1-13
Plan 5947 !
ii) Lots 14 & 15, 18-20 Registered Plan 3M-145, beirg Parts 1-7 Plan

2. This by-law shall come into full force and effect uponl approval by the

County of Bruce. I
Upon approval of the By-law by the County of Bruce, the Clerk of the
Municipality of Kincardine is hereby instructed and aut orized to register
this By-law in the Land Registry Office for Bruce County.
This By-law shall expire within three (3) years from the 4ate of passage of
the By-law. I

This by-law may be cited as the 'Part Lot Control Exetption for Parts of
Plan 3M-145 By-law".

20th day of August, 2003. '
