HomeMy WebLinkAbout03 118 zoning plouffe 82-08 e - e e THE CORPORATION OF THE MUNICIPALITY OF KINC INE BY-LAW NO. 2003 -118 BEING A BY-LAW TO AMEND ZONING BY-LA NO. 82-08, BEING THE ZONING BY-LAW FOR THE TOWNSHIP OF KINCARDINE DONALD PLOUFFE ~' PART OF LOT 27, CONCESSION 'A', MUNICIPALITY 0 KINCARDINE (FORMER TOWNSHIP OF KINCARDINE) I I WHEREAS Section 34 of the Planning Act, R.S.O 1990, Cha~er 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws hich comply with an approved official plan; ! AND WHEREAS the Council of the Corporation of the Townfip of Kincardine has enacted By-law 82-08, a zoning by-law enacted under Section of the said Planning Act; I AND WHEREAS the Corporation of the Township of Kincardine ~as restructured to now be a part of the Corporation of the Municipality of Kincardine; I AND WHEREAS the Corporation of the Municipality of Kincardin1 desires to amend By- law 82-08; ! NOW THEREFORE the Council of the Corporation of the MU7icipality of Kincardine ENACTS as follows: I I 1. Schedule 'A' to By-law No. 82-08 as amended, is hereby f rther amended by zoning those lands described as Part of Lot 27, Con cessio 'A', Municipality of Kincardine (former Township of Kincardine), 'R1-n-2003 - esidential Special' as outlined on the attached Schedule 'A'. I By-law 82-08, as amended, is hereby further amended tly adding the following subsection to Section 12.3 thereof: ! 12.3 Notwithstanding their 'R1' zoning designa ion, where lands are designated as 'R1-n-2003' on Schedule 'A' 0 this By-law, may be used in compliance with the 'R1' zone provo ions contained in this by-law, excepting however, that: (i) As an existing lot of record that h s access only from a Private Street (Whippoorwill Lane, a Limited Service Agreement shall be entered into with he Municipality prior to any development, alteration, or expan ion on the lands; and (ii) The minimum front yard setback shall be 6.0 metres; and (Hi) The minimum rear yard setback shall e 7.5 metres; and (iv) The lands shall be subject to Site Pia Control; and (v) The lands fronting onto Whippoorwill Lane shall be deemed to be the front lot line. 2. 3. This By-law takes effect from the date of passage by Cou cil and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. ...12 e e e e Amendment to Zoning By-law 82-08 Part of Lot 27, Concession A, Ward 2 By-Law 2003-118 Page 2 of 2 4. This By-law may be cited as the "Amendment to Zoning By-law 82-08, (Part of Lot 27, Concession 'A', Municipality of Kincardine [former Tci>wnship of Kincardine]), By-Law". READ a FIRST, SECOND and THIRD time and DEEMED TO BE!PASSED this 13th day of August, 2003.
