PART OF LOT 27, CONCESSION 'A',MUNICIPALlTY OF ~INCARDINE (FORMER TOWNSHIP OF KINCARDINE) I I ! I I , WHEREAS Section 34 of the Planning Act, R.S.O 1990, ChaPt~r 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws vfhich comply with an approved official plan; I I AND WHEREAS the Council of the Corporation of the Municipal'ty of Kincardine has enacted By-law 2003-25, a zoning by-law enacted under Seqtion 34 of the said Planning Act; : , AND WHEREAS the Corporation of the Municipality of Kincardine ~esires to amend By- law 2003-25; I NOW THEREFORE the Council of the Corporation of the Munif· ipality of Kincardine ENACTS as follows: , I I Schedule 'A' to By-law No. 2003-25 as amended, is hereby~urther amended by zoning those lands described as Part of Lot 27, Concession 'A', Municipality of Kincardine (former Township of Kincardine), 'R1-n - Resid ntial Special' as outlined on the attached Schedule 'A'. By-law 2003-25, as amended, is hereby further amended bL adding the following subsection to Section 12.3 thereof: r 12.3.14.1 Notwithstanding their 'R1' zoning deSignatiOntlands are designated as 'R1-n' on Schedule 'A' to this By-law, may e used in compliance with the 'R1' zone provisions contained in his by-law, excepting however, that: : (i) As an existing lot of record that ha~ access only from. a Private Street (Whippoorwill Lane), a Limited Service Agreement shall be entered into with t e Municipality prior to any development, alteration, expansio on the lands; and The lands shall be subject to Site Plan Control; and The lands fronting onto Whippoorwill ane shall be deemed to be the front lot line. This By-law takes effect from the date of passage by CounJ,iI and comes into force and effect pursuant to the provisions of the Planning ¡ct, R.S.O. 1990. I 1. 2. (ii) (iii) 3. .../2 e e e e 4.
