BEING A BY-LAW TO ENTER INTO A CONTRACT FOR T~E SCOTT POINT
WELL SUPPLY AND WATER WORKS UPG~DES

WHEREAS Section 11 (2) of the Municipal Act, 2001, S.D. 20b1, c. 25 authorizes
municipalities to pass by-laws respecting matters within the sphere of jurisdiction
of water distribution; I

AND WHEREAS the Council for The Corporation of the MunictPality of Kincardine
deemed it necessary to modify the existing Scott Point wel, the treated water
reservoir and piping systems and also to construct standby ower facilities and
associated electrical systems; I

AND WHEREAS tenders were called for the Scott Point Well Supply and Water
I
Works Upgrades; I
AND WHEREAS Finnbilt General Contracting Limited subm' ed a tender for the
Scott Point Well Supply and Water Works Upgrades n the amount of
$182,249.94, including all applicable taxes;
AND WHEREAS at Council's request the Municipality' engineers have
ascertained that subject to: I
i) Ministry of the Environment approval of the Muni ipality's application
to use a portable generator in lieu of a permanen unit;
ii) Installation of a manual transfer switch for the portable generator;
and
iii) Subject to notification to the residents that a ta ker supply of water
during improvements to the well will be provided;
the diesel generator equipment and associated works and e temporary water
supply can be deleted from the original tender resulting in a reduction of
approximately $81,200 plus GST. I
AND WHEREAS the Municipality's engineers have estimatt that an additional
$20,000 should be added to the project to cover the st of an outdoor
connection, a manual transfer switch and a tanker for tempora water supply;

NOW THEREFORE the Council for The Corporation of th, Municipality of
Kincardine ENACTS as follows: .
1. That a revised contract of approximately $110,000, plµs all applicable
taxes, with Finnbilt General Contracting Limited be hereb~ entered into.
2. That the Mayor and CAD be hereby authorized to sign, I on behalf of the
Council for The Corporation of the Municipality of Kincard,ne any contracts
and other documents required to authorize such work to c¢>mmence.
3. This by-law shall come into full force and effect upon its fi~al passage.
4. This by-law may be cited as the "Scott Point Well Sup~ly, Water Works
Upgrades Tender Acceptance By-law".

BEING A BY·LAW TO ACCEPT A TENDER FOR THE SCOTT POINT WELL
SUPPLY AND WATER WORKS UPGRADES
WHEREAS Section 11 (2) of the Municipal Act, 2001, 5.0. 2001, c. 25 authorizas
municipalities to pass by-laws respecting matters within the sphere of Jurisdiction
of water distnbutlon;
AND WHEREAS the Council for Tha Corporation of the Municipality of Kincardine
deema it expedient to accept a tender to modify the existing Scott Point well, the
treated water reservoir and piping systems and also to construct standby power
facnitias and associated electrical systems;
NOW THEREFORE the Council for The Corporation of the Municipality of
Klncardine ENACTS as follows:
1. That the tender of Finnblit General Contracting Limited in the amount of
$182,249.94, Including all applicable taxes, be hereby accepted.
2. That the Mayor and CAO be heraby authorized to sign. on behalf of the
Council for The Corporation of the Municipality of Kincardine any contracts
and other documents required to authorize such work to commence.
3. This by-law shall come into full forceénd effect upon Its final passage.
4. This by~aw may be cited as the 'Scott Point Well Supply, Water Works
Upgrades Tender Acceptance By-law".

The low tenderer's prices for the diesel generator equipment and associated works, and
the temporary water supply are approximately $63,900 and $17,300, respectively
(excluding GST). These tasks can be deleted if:
· the MOE approves our application to use a portable generator in lieu of a
pennanent unit
· a manual transfer switch is installed for the portable generator
· the residents agree to a tanker supply during the improvements to the well
Although the total tendered price can be reduced from about $170,300 to $89,100 by
the reductions mentioned above, we estimate about $20,000 wiR be added to the project
to cover the cost of an outdoor connection and the manual transfer switch for the
portable generator, and the tanker for the temporary water supply. As a result, the
contract amount would be approximately $110,000 + GST.
The revised contract amou1t will need to be confinned by the contractor but hopefully
this provides sufficient inf9rmation to aWard the project to Flnnbilt and begin
negotiations. .
