THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
No. 2006 - 260
BEING A BY-LAW DESIGNATING CERTAIN LANDS WITHIN THE
GEOGRAPHIC TOWN OF KINCARDINE, NOT TO BE A REGISTERED PLAN
OF SUBDIVISION

Lots 42 and 43 Elgin Street, Municipality of Kincardine (geographic
Town of Kincardine)
WHEREAS Section 50(4) of the Planning Act, R.S.O. 1990 authorizes the
Council of a Municipality to pass a by-law designating any Plan of Subdivision, or
part thereof, that has been registered for eight years or more, not to be a
registered Plan of Subdivision for the purposes of Subsection (3) of the Planning
Act;
AND WHEREAS certain lots described on Registered Plan of Subdivision 3M-61
are within the geographic Town of Kincardine, Municipality of Kincardine;
AND WHEREAS the said Plan of Subdivision No. 3M-51 was registered in the
Registry Office for the Registry Division of the County of Bruce on the 13th day of
January, 1870;
NOW THEREFORE the Council of the Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the Registered Plan of Subdivision or parts thereof described in
Paragraph 2 of this by-law is hereby designated to be a Plan of Subdivision,
which shall be deemed not to be a Registered Plan of Subdivision for the
purposes of Subsection 3 of Section 50 of the Planning Act, R.S.O. 1990.
2. That the lands subject to this By-law are described as Lots 42 and 43,
Registered Plan 3M-51, in the geographic Town of Kincardine, in the
Municipality of Kincardine.
3. That the Clerk of the Municipality of Kincardine shall cause a certified copy of
this By-law to be lodged with the County of Bruce and to be registered in the
land Registry Office for the County of Bruce as required by the said Planning
Act, Sections 50 (26) and (28).
4. That notice of the passing of this by-law shall be given within 30 days of the
passing thereof as required by the said Planning Act, Section 50 (29).

5. That the Council of the Municipality of Kincardine shall hear in person or by
agent any person to whom a notice was sent and who within 20 days of the
mailing of the notice applies to be heard, respecting the Amendment or repeal
of this By-law.
6. That this By-law may be cited as the "Deeming By-law lots 42, 43 Elgin St.
By-law" .
READ a FIRST, SECOND and THIRD TIME and FINALLY PASSED this 6th day
of September 2006.
