BY-LAW NUMBER 1998 - 66
OF THE CORPORATION OF
THE TOWN OF KINCARDINE
·
A BYLAW TO AUTHORIZE THE PRESENT COUNCIL OF THE TOWN OF
KINCARDINE TO CONDUCT SUCH ROUTINE BUSINESS AS MAY BE
REQUIRED FOR THE TOWN OF KINCARDINE AFTER VOTING DAY.
WHEREAS on January 1 S\ 1999 the Corporation of the Town of Kincardine will
become amalgamated with the Township of Kincardine and the Township of Bruce
and will no longer exist as a separate local municipal corporation;
AND WHEREAS voting day for the election of the council of the newly formed
amalgamated municipality is November 9th, 1998;
AND WHEREAS the said Municipal Act, RS.O. 1990, C.M.45, Section 107
prohibits the council of local municipalities from doing certain acts after voting day;

AND WHEREAS the said Municipal Act, Section 107(1)(d) allows the council of a
local municipality to do corporate acts authorized by resolution or by-law passed
before the day the vote is held;
AND WHEREAS it is desirous that the present council of the Town of Kincardine be
authorized to complete the routine business of the Town of Kincardine;
NOW THEREFORE the Council for The Corporation of the Town of Kincardine
ENACTS as follows:
1. To do such corporate acts as may be required after November 9th, 1998 for the
purpose of completing the ongoing and routine business of the Corporation of the
Town of Kincardine.
2. Such corporate acts to include but not be limited to the following;

Waterfront Development Contract
Huron Terrace Sewer Pumping Station Upgrade Contract
Kincardine Harbour to the Municipality
Kincardine Klassics Administration Agreement
Lease of 663 Queen Street
Rotary Club Food Booth Agreement
Authorization of municipal tax write-offs
Negotiations pertinent to Phase 1 of the development of the new
commerciallindustriallands at Highway 9 & 21

3. That this by-law shall not empower the Council of the Corporation of the Town of
Kincardine to do such acts as would otherwise be prohibited or require the
consent of the Transition Board as established by the Bruce County Restructuring
Order made under the Municipal Act on January 30th, 1998.
4. This by-law shall come into full force and effect upon its final passing.
5. This by-law may be cited as the "Routine Business After Voting Day By-law".
READ a FIRST and SECOND time this 5th day of November, 1998.
READ a THIRD time and FINALLY PASSED this 5th day of November, 1998.
